HomeMy WebLinkAbout1028 - Levying Special Assessments BILL NO. 2010-052 ORDINANCE NO. /0� &' AN ORDINANCE LEVYING THE SPECIAL ASSESSMENTS AND ANNUAL INSTALLMENTS FOR THE BRIARCLIFF PROFESSIONAL PLAZA NEIGHBORHOOD IMPROVEMENT DISTRICT AND AUTHORIZING THE PREPARATION AND SUBMISSION OF THE ANNUAL INSTALLMENT ROLLS ASSOCIATED THEREWITH. WHEREAS, the City, after filing of a proper petition (the "Petition") with the City Clerk on April 1, 2008, pursuant to the Neighborhood Improvement District Act (the "Act"), Sections 67.453 through 67.475, inclusive, RSMo, as amended, and in compliance with all requirements of the Act, created the Briarcliff Professional Plaza Neighborhood Improvement District (the "DistricY') within the City to acquire, construct and improve certain public landscaping, entrance and street improvements (the "Improvements"), with the final cost of the Improvements to be assessed against the benefited property as set forth in the Petition; and WHEREAS, the City has (i) found and determined that the Improvements have been completed, (ii) established the final costs to be assessed against the benefited properties within the District; (iii) found that benefits of the Improvements exceeded such costs; and (iv) made such other findings as were required under the Act; and I, WHEREAS, the City, pursuant to Ordinance 2009-88 adopted August 4, 2009, assessed the final costs as special assessments against the benefitted properties within the District (the "Special Assessments"); and WHEREAS, the City provided to the property owners within the District notice (i) of the Special Assessments, (ii) that the Speciai Assessments could be paid in full until August 26, 2009, and (iii) that any Special Assessment not paid in full by such date would be payable in substantially equal installments over twenty years at five percent interest per annum ("Annual InstallmenY'); and WHEREAS, only one property owner, Riverside Medical Complex, LLC, paid its Special Assessment in full; and WHEREAS, the Annual Installment for the remainder of the assessments due and owing for calendar year 2009 were approved and levied by the City pursuant to Ordinance 2009-139; and WHEREAS, Section 67.463(4) allows for the certification of all of the installments, together with the interest to accrue thereon to be certified by the City clerk to the county in one instrument at the same time, which certification shall be good for all of the installments and payable as special assessments; and WHEREAS, the City desires to certify all of the installments set forth in Exhibit A attached hereto and made a part hereof by reference and authorize the city officers to take all further actions required in connection therewith; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— SPECIAL ASSESSMENT OF ANNUAL INSTALLMENTS FOR BRIARCLIFF PROFESSIONAL PLAZA NID. The Board of Aldermen hereby confirm the levy of the Special Assessments for the Briarcliff Professional Plaza Neighborhood Improvement District and hereby approves and levies the annual installments of the Special Assessments, BILL NO. 2010-052 ORDINANCE NO. together with interest at the rate of five percent (5%) per annum against the properties within the District as set forth on the Special Assessment Annual Installment Roll set forth in Exhibit A ("Roll") attached hereto and made a part hereof by reference. SECTION 2— DUTY OF FINANCE OFFICER. The Finance Officer is hereby authorized , and directed to file, at the same time as ad valorem taxes are levied and billed, during the Installment Period, levy and bill or cause to be billed all of the assessments, together with interest thereon in accordance with the installment schedule set forth in the Annual Installment Roll attached as Exhibit A; and such amounts so certified shall be placed on the tax rolls and levied and collected at the same time and in the same manner as property taxes of the City are levied collected, the assessment and levy for each year being a portion of the principal amount of the total assessments plus one years' interest on the unpaid assessments. SECTION 3— LIEN ON PROPERTY. The special assessments made for the District Improvements pursuant to the actions duly taken by the City, including this Ordinance, shall be a lien upon each of the properties assessed on behalf of the City to the same extent as a tax upon real property. SECTION 4— AUTHORIZATION OF OTHER OFFICERS. The City shall, and the officers and agents of the City are hereby authorized and directed to, take such further action, I and execute such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Ordinance. SECTION 5— SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6- EFFECTIVE DATE. That this Ordinance shall be in full force and effect from and after its passage and approval.
