HomeMy WebLinkAbout1996-078 - Amendment to Zoning OrdinanceBILL NO. 96- '"lB ORDINANCE NO. 96- "~~% AN ORDINANCE AMENDING THE RIVERSIDE ZONING ORDINANCE TO (i) ALLOW, AS A SPECIAL USE, HOTEL(S) IN THE VICINITY OF A COMMERCIAL VESSEL IN DISTRICTS ZONED M-2; AND (2) CHANGE MINIMUM PARKING REQUIREMENTS FOR A COMMERCIAL VESSEL IN DISTRICTS ZONED M-2 WHEREAS, an application has been filed to amend the Riverside Zoning Ordinance to (1) allow, as a special use, hotel(s) in the vicinity of a commercial vessel in Districts zoned M-2; and (2) reduce the minimum number of parking spaces required under Section 13.130(11)(a) to one-half (.5) parlting spaces per patron for the legal capacity of a commercial vessel in Districts zoned M-2 (collectively, the "Amendments"); WHEREAS, on July 11, 1996, the Planning Commission ("Commission") held a hearing on the Amendments; WHEREAS, on July 11, 1996, the Commission approved the Amendments and forwarded them to the Board of Aldermen ("Board") for a public hearing and action thereon; WHEREAS, proper notice of the public hearing was given as required by Missouri statutes; WHEREAS, the Board held a public hearing on July 16, 1996, and the Board heard and considered all protests, objections and comments submitted by any interested persons; WHEREAS, the Board has reviewed the zoning request together with the Commission's recommendations regarding same; NOW, THEREFORE, be it ordained by the Board of Aldermen of Riverside, Missouri: Section 1. The Riverside Zoning Ordinance is amended as follows: a. Section 1.070 of the Riverside Zoning Ordinance is amended to allow, as a special use, hotel(s) in the vicinity of a commercial vessel in districts zoned M-2 and such amendment shall be inserted in alphabetical order under Section 1.070 H. as follows: R-1 R-2 C-O C-1 M-1 M-2 Hotel(s) in the vicinity of a commercial vessel X b. Section 7.010 of the Riverside Zoning Ordinance is amended to add hotel(s) in the vicinity of a commercial vessel as a special use in M-2 districts and such amendment shall be inserted in alphabetical order under Section 7.010 H. as follows: Pennitted Special Use Hotel(s) in the vicinity of a commercial vessel X c. Section 13.135 is added to the Riverside Zoning Ordinance and shall read as follows: Section 13.135. Hotel(s) in the Vicini~ of a Commercial Vessel. (1) APPROVAL. (a) Hotel(s) in the vicinity of a Commercial Vessel in districts zoned M-2 will be permitted only by special use permit of the Board of Aldermen after a review and recommendation by the Planning Commission. (b) Each application for a hotel in the vicinity of a commercial vessel in a district zoned M-2 shall, in addition to the special use permit requirements, be made in a form required for site development plan approval as required in Chapter 14 of the Zoning Ordinances. (c) The Planning Commission shall review and may recommend for approval of the site development plan as a part of its recommendation to the Board of Aldermen on the special use permit. (2) GENERAL CONDITIONS. The following regulations shall apply to all property for which a special use permit has been issued pursuant to this Section 13.135: (a) The Height and Area Regulations set forth in Section 5.030 of the Riverside Zoning Ordinance; (b) The Performance Standards set forth in Section 5.040 of the Riverside Zoning Ordinance; (c) The Building and Landscaping Requirements set forth in Section 5.060 of the Riverside Zoning Ordinance; and -2- (d) The Parking Regulations set forth in Section 5.070 of the Riverside Zoning Ordinance. d. Section 23.020 of the Riverside Zoning Ordinance is amended as follows to add the definition of "vicinity:'° VICINITY: When used in connection with "hotel(s) in the vicinity of a commercial vessel, "vicinity" shall mean within the area bounded on the eastern side by Line Creek, along the northerly side by Burlington Northern Railroad tracks, along the westerly side by Highway 169 and along the southerly side by the Missouri River. Section 2. Section 13.130(11)(a) of the Riverside Zoning Ordinance is deleted in its entirety and replaced with the following: (a) Unless expressly waived by the Planning Commission and the Board of Aldermen, there shall be a minimum of parking spaces based on one-half (.5) parking space per patron for the legal capacity of the commercial vessel.
