WHEREAS, Section 311.095, RSMo, authorized the State to issue liquor by the drink licenses to resorts; and WHEREAS, Chapter 3 of the Riverside Municipal Code does not currently allow for the issuance of resort licenses; and WHEREAS, the City desires to allow the issuance of resort licenses pursuant to Chapter 311 of the Revised Statutes of ?Missouri and Chapter 3 of the Riverside Municipal Code as amended hereby; NOW, THEREFORE, BE IT ORDAII~lED by the Board of Aldermen of the City of Riverside, iviissouri, as follows: Section 1. Section 1: Definitions of Section 3.1 of the Riverside Municipal Code shall be amended by adding the following: RESTAURANT-BAR -- A restaurant which, annually, has at least 50% of its gross income from the year immediately preceding derived from the sale of prepared foods or meals consumed on the premises. RESORT -- means any establishment having at least 30 rooms for the overnight accommodation of transient guests, having a restaurant or similar facility on the premises, at least 60% of the gross income of which is derived from the sale of prepared meals or food or means arestaurant-bar provided with special space and accommodations where, in consideration of payment, food, without lodging, is habitually furnished to travelers and customers, and which restaurant-bar establishment's annual gross receipts immediately preceding its application for a license, and each renewal license, shall not have been less than $75,000 per year with at least $50,000 of such gross receipts from non-alcoholic sales, or means a seasonal resort restaurant with food sales as set forth in Section 311.095, RSiVfo. Any new resort establishment having been in operation for less than 90 days may be issued a temporary license to sell intoxicating liquor by the drink at retail for consumption on the premises for a period not to exceed 90 days if the resort establishment can show, to the reasonable satisfaction of the Board of Aldermen, a projection of an annual gross receipts of not less than 575,000 per year with at least 550,000 of such gross receipts from non-alcoholic sales. Section 2. Section 4: Classification of Section 3.1 of the Riverside Municipal Code shall be amended by adding the following classification: 1:A61492`,000071RESORT.ORD RESORT LICENSE -- A resort license shall authorize a "resort" to sell for consumption on premises liquor by the drink. Section 3. Section ~: Restriction on Number Issued of Section 3.1 of the Riverside Municipal Code is amended by adding the tollowing: RESORT LICENSE -- There shall be no limit on the number of resort licenses in the City of Riverside, Missouri. Section -l. Section 6: Fee Amounts of Section 3.1 of the Riverside Municipal Code is amended by adding the following: RESORT LICENSE -- Fee to be 550 payable yearly in advance. SUNDAY SALES RESORT LICENSE -- Fee to be 5300 payable yearly in advance. Section ~. Section 8: License Term of Section 3.1 of the Riverside Municipal Ordinance shall be amended as follows: Section 8: License Tetra/Conditions. As a condition precedent to the issuance of a license under the provisions of this Chapter, the applicant must also procure a permit and license from the State, under the provisions of RSMo, Chapters 311 and 312. Additionally. no license shall be issued unless and until there has been shown compliance with the fire code, health code, buildine code, zonine ordinance and all other ordinances of the City. Prior to the issuance of any resort license, or renewal license, the applicant shall the verified statements showine the total amount of Bross receipts, the total amount of gross receipts from the sale_ of alcoholic beveraees, and the total amount of gross receipts from the sale of prepared foods made on the premises for the immediately precedins year. Each license issued pursuant to this ordinance shall terminate on the 30th day of June of each year. Section 6. Section 11: Form of Application, Licenses and Permits of Section 3.1 of the Riverside Municipal Code shall be amended by adding a new section k which will read as follows: k. If the applicant is requesting a resort license, the applicant must submit detailed and verified information supporting its claim to a resort license. Section 7. This Ordinance shall be in full force and effect from and after the date of its passage.
