HomeMy WebLinkAbout1995-021 - Contract with Missouri Gaming Company5536S; 04/10/95 BILL NO. ~~'~ "~ ORDINANCE N0 . `~~%~ l ~~ AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER INTO A CONTRACT WITH MISSOURI GAMING COMPANY WITH REGARD TO THE PLACING OF FILL ON CITY PROPERTY. WHEREAS, Missouri anticipates a significant excavation at its permanent site and will have available fill, and WHEREAS, the City has need of fill for the location of the proposed golf course and road. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. L~ MAYOR i CONTRACT ~ _ TffiS CONTRACT made and entered into this /~ day of ( 1995, by and between MISSOURI GAMING COMPANY, hereinafter called "Missouri" and the CITY OF RIVERSIDE, hereinafter called "Cit}~'. WHEREAS, Missouri anticipates a significant area next to the Missouri river will be excavated for the purpose of installing a gaming boat at the new site, and WHEREAS, the City has need of significant fill for the elevation of the areas where greens are to be placed on the golf course and will allow the placing of fill on the site of the future golf course, and WHEREAS, all parties understand that an additional amount of fill may be placed on the property of Phillip Snowden at his request. NOW, THEREFORE BE TT AGREED consistent with the promises made by and between the parties as follows: 1. Missouri shall excavate and remove such soil as it desires from its realty at or near what is now known as the permanent site, in accordance with all applicable laws, regulations and also all ordinances of the City. 2. Missouri shall place certain fill in the general area designated by the City where the "golf course" is to be built, including but limited to, the area of the club house, roadways into the club house, parking facilities at or near the club house, and greens. Final grading shall be the City's responsibilities. 3. All work with regard to fill placed on the City shall be done under the direction of the City Engineer or the City. Missouri shall have no obligation to fill all of the areas for greens and Missouri may but shall not be required to grade on the areas where the fill is placed. The City shall have a right to inspect any and all fill material to be placed on City property and may elect to reject any load or any portion at its absolute discretion. 4. The parties agree that the fill may be placed on the golf course and the Snowden property in a manner to best facilitate and coordinate the mooring basin excavation. 5. Missouri shall comply with all prevailing wage laws, all other laws and ordinances and shall maintain at all times sufficient insurance to protect the City from liability for injuries or claims caused by this activity. 6. City and Snowden shall file a drainage plan and grading plan with regard to the Snowden property and the City property, and each shall grade the fill received in accordance with that plan.
