April 3, 2007
A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the
City Hall, of Riverside, Missouri, on Apri13, 2007 at 7:00 p.m
Those in attendance were Mayor Kathy Rose, Aldermen, Darata, Hurt, Beard, Bruns
and Super. Alderman Jones arrived later.
Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief
Gregory Mills, Brent Miles, Director of Planning & Economic Development, and John McClelland, City
Attorney.
Minutes, Mazch 6'~ Alderman Darata moved that the Mazch 6's minutes be corrected and approved,
Approved seconded by Alderman Hurt, the vote was:
Alderman Jones arrived at this time.
Aye: Aldermen Bruns, Super, Hurt, Beazd, Dazata and Jones.
Motion carries.
Minutes, March 20s' Alderman Bruns moved to approve the minutes of Mazch 20's, seconded by
Approved Alderman Hurt, the vote was:
Aye: Aldermen Darata, Jones, Beard, Bruns, Hurt and Super.
Motion carries.
Merrimac Drainage Mike Duffy, Shafer, Kline & Warren spoke to the boazd on the
proposed improvements for the Men-imac Drainage system. The Leaders,
property owners, had questions about filling in the areas on the other side
of their driveway as it is difficult to maintain. They aze getting a signifi-
cant amount of drainage coming off of Merriman Shafer, Kline & Warren
has a design they believe will take to resolve this; fill to be placed and ground
leveled out then make some improvements to the overall system.
Tlris involves the location of two field inlets on the south edge of their property
and one upstream on the north side. A 24" pipe would be connected to
2 field inlets and from there extend a 48" pipe that goes undeneath the
Snyder's driveway. Then cut the Snyder's driveway, remove the existing metal
pipe that goes underneath the driveway because it is in bad condition.
Erosion was occurring so a material called "scourstop" is proposed. This
allows for vegetation to grow. They have met with property owner's ex-
plaining all the impacts on thew property for this project and believes
everyone is comfortable with the project.
Alderman Beard asked why the Snyder's property is public and everyone
else's private. Mike said because they are taking the water (public) off of the
street and that would become part of the public system. The City would
require a permanent easement on the Snyder's property and a small portion
of the Leader's property.
Mike said it has been explained to the Leader's a smaller diameter pipe will be

Mike said it has been explained to the Leader's a smaller diameter pipe will be
placed underneath the driveway and if it fails the property owner must maintain
it. Mike said estimates for the cost of this should be ready by the April 17`~
boazd meeting.
Mayor's comment Mayor Rose said the Argosy event was great, it's a beautiful facility and we're
proud to have it in the City.
Bill No. 2007-29 Alderman Hurt moved to place Bill No. 2007-29 on its first reading,
Payment of said Bill authorizing the payment of certain indebtedness listed therein,
Indebtedness seconded by Alderman Jones the vote was:
Aye: Aldermen Darata, Beazd, Bruns, Hurt, Jones and Supers.
Motion carries.
Ordinance No. 2007-29 Alderman Darata to place Bill No. 2007-29 on its second reading,
Approved and upon passage of same become Ordinance No. 2007-29, seconded
by Alderman Jones, the vote was:
Aye: Aldermen Bruns, Super, Jones, Dazata, Hurt and Beard.
Motion carries.
Bill No. 2007-30 Alderman Darata moved to place Bill No. 2007-30 on its fast reading, said Bill
Hiring Court Clerk authorizing the City of Riverside, Missouri to employ Shalah Jones as the Court
Clerk for the City of Riverside, Missouri and the salary for this position is
$16.50 per hour and upon Court Administrator Certification, the salary will
be $17.00 per hour and the start date will be April 18, 2007 with full benefits,
seconded by Alderman Hurt, the vote was:
Aye: Aldermen Dazata, Super, Hurt, Beazd, Bruns and Jones.
Motion carries.
Ordinance No. 2007-30 Alderman Jones to place Bill No. 2007-30 on its second reading,
Approved and upon passage of same become Ordinance No. 2007-30, seconded
by Alderman Bnuvs the vote was:
Aye: Aldermen Bruns, Super, Jones, Dazata, Hurt and Beard.
Motion carries.
Bill No. 2007-31 Alderman Super moved to place Bill No. 2007-31 on its first reading,
Cost Participation said Bill authorizing the City of Riverside to enter into a Cost Participation
Agreement with Agreement with the Missouri Highways and Transportation Commission for
MODOT for the Vivion Road Planning Study in an amount not to exceed $151,333.33,
seconded by Alderman Darata, the vote was:
Aye: Aldermen Bruns, Hurt, Beazd, Jones, Super and Dazata.
Motion carries.
Alderman Super asked if this was budgeted and Brent said "Yes".

Ordinance No. 2007-31 Alderman Hurt to place Bill No. 2007-31 on its second reading,
Approved and upon passage of same become Ordinance No. 2007-31, seconded
by Alderman Jones the vote was:
Aye: Aldermen Bruns, Super, Jones, Darata, Hurt and Beard.
Motion carries.
Bill No. 2007-32 Alderman Jones moved to place Bill No. 2007-32 on its first reading, said
Approval to Acquire Bill authorizing and Approving the City of Riverside, Missouri to Acquire
Certain Land for Certain Land for the Horizons Parkway Phase II Project in the amount of
Horizons Pky Phase II $6,500,000.00, seconded by Alderman Hurt, the vote was:
Aye: Aldermen Beard, Bruns, Darata, Jones, Super and Hurt.
Motion carries.
City Attorney comment John said this is the final contract that we have for each acquisition of
that tract. This is the tract that allows completion over the BNSF railroad and
completes the connection from I-635. The negotiated price was $6,500.000.00
and closing cost paid by the City. The price includes all costs of relocating,
moving their equipment and any business reestablishment expenses that they
would incur in having to shut down then opening in a new location.
The contract provides for the City to have a 30 day right of inspection to go on
the property for invasive environmental testing. At the end of that period, if the
City wants to go forward, the City would then close on the property and lease
the property back to the current occupant (triple net lease) meaning the tenant
assumes all costs and maintenance and pay levee assessments until April 1,
2008. This is the date they have agreed to vacate the property and if they are not
out by April 1", there are liquidated damages at a cost of $4,300 per day. Ninety
days worth of liquidated damages are being held back from the purchase price.
This number is higher than previously budgeted, but Phase I Horizons came in
under budget.

Approved and upon passage of same become Ordinance No. 2007-32, seconded
by Alderman Super the vote was:
Aye: Aldermen Super, Jones, Darata, Bruns, Hurt and Beard.
Motion carries.
City Administrator David said the test for the "Quiet Zone" for the train hom will be April

Motion for Closed Alderman Super moved that the meeting go into closed session, pursuant to
Session at 7:25 p.m RSMo 610.021(1) Legal and 610.021(2) Real Estate Issues with the City
Attorney, seconded by Alderman Jones, and the vote was:
Aldermen Beard, Darata, Jones, Super, Bnms and Hurt.
