AN ORDINANCE GRANTING TO MISSOURI-AMERICAN WATER COMPANY A
WATER LINE EASEMENT.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:

THIS INDENTURE made and entered into this lv7`L day of
December, 1995, between THE CITY OF RIVERSIDE, MISSOURI,
hereinafter referred to as Grantor, and MISSOURI-AMERICAN WATER
COMPANY, a Missouri Corporation, hereinafter referred to as
Grantee.
WITNESSETH:
1. For and in consideration of the sum of One Dollar
($1.00) and other good and valuable considerations paid by the
Grantee to the Grantor, receipt of which is hereby
acknowledged, Grantor does hereby grant to the Grantee,
Grantee's successors and assigns, a permanent easement fifteen
(15) feet in width, situated in Platte County, Misscur~,
described as follows:
The Westerly 15' of the following described tract of land:
A tract of land located in the West Half of the West Half
fractional Section 9 and Southwest Quarter of Section 4,
Township 50, Range 33, Riverside, Platte County, Missouri,
more particularly described as follows: Beginning at the
Northwest corner of said fractional Section 9; thence N
00° 02' 44" W along the West line of said Section 4 a
distance of 125.89 feet to a point on the Southerly right
of way line of the Chicago, Burlington and Quincy Railroad;
thence S 69° 35' 25" E along said Southerly right of way
line a distance of 1,229.01 feet; thence S 66° 46' 47" W
a distance of 495.85 feet; thence S 02° 55' 40" E a
distance of 545.20 feet; thence S 17° 15' 29" W a
distance of 260 feet; thence S 18° 11' 33" E a distance
of 240.00 feet; thence S 71° 48' 27" W a distance of
109.58 feet; thence on a curve to the left, tangent to the
last described course, having a radius of 468.00 feet and
an arc distance of 57.18 feet; thence S 78° 48' 27" W a
distance of 113.34 feet; thence N il° il' 33" W a
distance of 8.C0 feet; thence S 78° 48' 27" W a distance
of 85.52 feet; thence N 89° 20' 301° W a distance of
377.65 feet to the West line of fractional Section 9;
thence N 00° 02' 00" W along said West line a distance of
1,591.38 feet to the point of beginning. Contains
1,183,613 square feet or 27.17 acres more or less.
2. Grantee, Grantee's successors, appointees and assigns
are granted the right, privilege and authority to construct,
replace, renew and maintain a water line or tines together with

necessary connections, valves and other appurtenances, to be
located under the above-described property, and to trim and
remove roots, shrubs, bushes and plants which affect the
operation of said lines.
3. Title to the utilities constructed hereunder shall
remain in the Grantee, Grantee's successors, appointees and
assigns.
4. The Grantor and its assigns may fully use and enjoy
said premises for any use not inconsistent with Grantee's use.
5. Grantor is hereby granted the right to use said water
line at any time subject to the payment of customary hookup
charges and the payment of the mo:~thly mater bill.
6. Grantee agrees to replace and impact the earth removed
from said strip of ground and will restore the surface of the
ground in said easement in as good a condition as it was before
the ground was broken into after the original installation and
any future maintenance thereof of said water line or lines.
The ground shall be seeded and mulched or sodded if required by
the Grantor.
7. This agreement shall be binding upon the parties
hereto, their heirs, administrators, executors, successors and
assigns.
IN WITNESS WHEREOF, Grantor has executed this instrument in
the State of Missouri the day and year first above written.
