BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized to execute a lease for sign location with Missouri Gaming Company which is attached as Exhibit "A" and made a part of this ordinance as though fully set out herein. Section 2. MAYOR " 7275S; 11/30/95 LEASE FOR SIGN LOCATION THIS LEASE, entered into this /f(./- day of ;~L<, c<-:~e,«e.~.. , 199•> , between the CITY OF RIVERSIDE, MISSOURI and MISSOURI GAMING COMPANY. WHEREAS, Missouri has installed and maintained the sign on the City Park next to the street that will become Argosy Parkway, and WHEREAS, Missouri desires to redesign and continue the use of this area for a sign location, and WHEREAS, the City is willing to lease the property to Missouri for the purpose of allowing the maintenance of the sign. NOW, THEREFORE, BE IT AGREED AS FOLLOWS: 1. LEASED PREMISES. The City leases Missouri and Missouri takes as lessee the space only for a sign at its present location near Argosy Parkway in the City's Park, the area described as follows: A tract of land located in fractional Section 9, Township 50 West, Range 33 North, Riverside, Platte County, Missouri, being more particularly described as follows: Beginning at the Northwest corner of said fractional Section 9; thence S 890 20' 14" E along the North line of said fractional Section 9 a distance of 1,303.50 feet to a point on the East line of the West One-Half of the West One-Half of said fractional Section 9; thence S 00° 02' 00" E along said East line a distance of 662.65 feet; thence N 890 58' 00" E perpendicular to the last described course a distance of 718.15 feet to the point of 2 beginning of the tract of land to be described; thence S 720 03' 10" E a distance of 24.00 feet; thence S 170 56' 50" W a distance of 48.44 feet; thence N 720 03' 10" W a distance of 24.00 feet; thence N 17° 56' 50" E a distance of 48.44 feet to the point of beginning. Contains 1,163 square feet or .0267 acres more or less. Provided however, the City shall have right of access over the realty for any reasonable purpose including installation of letters on a portion of the sign that is to be used by the City and Missouri shall have a right of access in the area between Argosy Parkway and the legal description described herein for the purpose of going and from the sign for maintenance purposes. Provided however, Missouri shall repair any damage and restore the property to as good of condition as practical before the entry. 2. TERM. The term of the lease shall be the same as the initial development agreement executed June 7, 1993. 3. SIGNAGE PLAN REQUIRED. Missouri shall file with the City the sign which it wishes to reconstruct and this lease is expressly subject to approval. The reconstructed form shall be on file at City Hall. 4. PAYMENT FOR LEASE. The consideration for this lease shall be the sum of $100.00 per year payable monthly in advance. The first lease payment shall be due January 1, 1996 payable in advance and yearly thereafter on the 1st day of each year until the conclusion of this lease. 5. BOTTOM MESSAGE BOARD. A bottom message board of a ~ u ) ~ size of at least ~~ x ld- shall be maintained on the sign 3 and available for the City to use in advertising the Park or other City events. Missouri will provide the letters but it shall be the obligation of the City to install the letters on the sign. 6. INDEMNITY CLAUSE. Missouri shall indemnify and hold the City harmless for any and all losses, damages or claims of all types and descriptions which may be claimed against the City as a result of the use of the leased property. 7. LIMITATION ON LANGUAGE. Missouri agrees that no language that is vulgar, profane or generally regarded to be offensive to small children shall be placed on the sign. 8. MAINTENANCE. It shall be the obligation of Missouri to maintain the sign at all times. In the event that Missouri shall fail in its maintenance obligation, then the City may give thirty (30) days written notice and in the event the sign is not maintained, it shall be removed. 9. LANDSCAPING. It shall be the obligation of Missouri to do the appropriate landscaping on the sign. Missouri will file a landscaping plan with the City and acceptable to the City prior to the effective date of this lease.
