Ahl ORDINANCE AUTHORZING, APPROVING AND RATIFYING CHANGE ORDER 7 TO
THE AGREEMENT BY AND BETWEEN THE CITY OF RIVERSIDE AND APAC-KANSAS,
INC. FOR THE ARGOSY CASINO PARKWAY — NORTH PROJECT RESULTING IN A
REVISED CONTRACT AMOUNT OF $7,526,719.29.
WHEREAS, the City issued an Invitation to Bid for the Argosy Casino Parkway — North
Project within the City which was awarded to APAC-Kansas, Inc. pursuant to Ordinance 2009-
1fi1; and
WHEREAS, the City has previously approved Change Orders 1-6 on the Argosy Casino
P�arkway — North Project in the total amount of $896,438.61; and
WHEREAS, the Board of Aldermen find it in the best interest of the City to authorize,
a��prove and ratify Change Order 7 to the agreement with APAC-Kansas, Inc resulting in a total
revised contract amount not to exceed $7,526,719.29;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1— APPROVAL OF CHANGE ORDER. Change Order 7 to the Agreement
entered into by and between the City and APAC- Kansas, Inc. and incorporated herein by
reference resulting in a revised contract amount not to exceed $7,526,71929 is hereby
authorized, ratified and approved.
SECTION 2— AUTHORITY TO EXECUTE. The City Administrator and all other
required city officials are authorized to execute the change order authorized herein together with
any and all documents necessary or incidental to the performance thereof and to take such
other actions and/or execute and deliver for and on behalf of the City all certificates,
instruments, agreements and other documents as may be deemed necessary or convenient to
carry out and comply with the intent of this Ordinance.
SECTION 3— SEVERABILITY CLAUSE. The provisions of this ordinance are severable
arid if any provision hereof is declared invalid, unconstitutional or unenforceable, such
de:termination shall not affect the validity of the remainder of this ordinance.
SECTION 4— EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.

RE: Change Order 7 for Argosy Casino Parkway North Project.
BACKGROUND: Staff previously presented change orders I through 6 for the Argosy Casino
Parkway North project. Change Order 7 includes; regulatory traffic signs,
adjustment in conduit size, and a change in levee district ditch requiremenu.
Original Contract Amount $6,591,573.61
Total of Previous Changes $896,438.61
Total this Change Order $38,707.07
Current Contract Total $7,526,719.29
RECOMMENDATION: Staff recommends approval of the resolution and acceptance of the change order
with APAC - Kansas to continue work for the Argosy Casino Parkway North
project.
BUDGETARY IMPACT: Approximately $38,707.07 will be expended out of the Argosy Casino Parkway
North budget for the construction under this contract.
