AN ORDINANCE ESTABLISHING AMENDMENTS TO THE ZONING CODE
ADOPTED BY ORDINANCE N0. 39-15.
WHEREAS, the City of Riverside, Missouri adopted a new
Zoning Code on February 21, 1989 by Ordinance ido, 89-15.
WHEREAS, in reviewing the Zoning Code, changes were
suggested to be made to allow ~-he Zoning Code to work more
effectively and efficiently.
WHEREAS, in reviewing the Zoning Code, a typographical
error was found.
WHEREAS, the City of Riverside wishes to enact and enforce
the new amendments to the Zoning Code,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. Section 4.010 a reference to the term
"automated teller machine (ATM)" shall be appropriately
alphabetically inserted and shall be adopted to read as follows:
"PERMITTED SPECIAL USE
Automated Teller Machine (ATM)...,,,,,X~~
The Table of Contents shall be changed to conform with }he
above, The Permitted Uses Chart shall be changed to conform
with the above,
Section 2. Section 5.010 a reference to the +-erm
"automated teller machine (ATM)" shall be appropriately
alphabetically inserted and shall be adopted to read as follows:
"PF,RM:CTTED
Automated Teller Machine (ATM)........X"
SPECIAL USE
The Table of Contents shall be changed to conform with the
above, The Permitted Uses Chart shall be changed to conform
with the above,

Section 3. Section 4.010 (2) a reference to the following
terms:

Office supplies, retail ............................... X"
shall be deleted and replaced by the following•
"PERMITTED SPECIAL USE
Office supplies ............... X
Office supplies, retail ............... X"
The Table of Contents shall be changed to conform wish the
above. The Permitted Uses Char* shall be changed to conform
with the above.
Section 4. Section 5.010 (2) a reference to the following
terms:
"PERMITTED SPECIAL USE

Office supplies, retail ............................... X"
shall be deleted and replaced by the following•
"PERMITTED SPECIAL USE
Office supplies ................... X
Office supplies, retail ............... X"
The Table of Contents shall be changed to conform wi}h the
above. The Permi!-ted Uses Chart sha1.1 be changed to conform
with the above,
Section 5. The Subdivision Regulations in +-heir revised
form shall be adopted.

Section 6. Section 23.020, a new definition of the term
"Garage, Private" shall be adop~ed as follows:
"GARAGE, PRIVATE: .For any dwelling house there shall be
permitted only one (1) private garage, either ate-ached or
freestanding, for the storage only of not more than ~-hree
(3) passenger motor vehicles and o*her smaller accessories
owned by and for the use of the tenants with a maximum of
eight hundred (800) square feet unless the lot area exceeds
ten thousand (10,000) square feet in which event. the square
footage may be increased by ten percent (10g) for each one
thousand (1,000) square feet over ten thousand (10,000)
square feet with a maximum of one thousand (1,000) square
feet and a height not to exceed sixteen (16) feet or one
(1) story, Provided that such garage shall be located no+-
less than thirty-five (35) feet. from the front lot line,
and not less than ten (10) feet from any side lot line and
not less than thirty-five (35) feet from the rear lot
line, In the case of corner lots, such building shall be
at least the distance required for a residential front side
street, A garage, carpor* or servant's quarters
constructed as an in~egral part of }he main building shall
be subject to the regulations af:Eecting the main building,
except that on a corner lot, a private garage, when
attached to the main building and not exceeding the heighr-
of the main building, may extend into the required rear
yard to a point not less than eighteen (18) feet from the
rear lot line, and shall not. occupy more than r-hirty
percent (30s) of the required rear yard. No part of the
detached accessory building shall be closer than ten (10)
feet to the main building,"
Section 7. Section 2,020(3)(4)(1-4) is hereby repealed in
its entirety,
Section 8. A new Section 2.020(3)(4)(1-5) shall be adopted
as follows:
"(d) Private garages,
(1) For any dwelling house there shall be permitted
only one (1) private garage, either a~tached or
freestanding, for the storage only of not more
than three (3) passenger motor vehicles and other
smaller accessories owned by and for the use of
the tenants with a maximum of eight hundred (800)
square feet unless the lot. area exceeds ten
thousand (10,000) square feet in which event the

square footage may be increased by ten percent
(l00) for each one thousand (1,000) square feet
over ten thousand (10,000) square feet with a
maximum of one thousand (1,000) square feet and a
height not to exceed sixteen (16) feet or one (1)
story.
(2) Provided that such garage shall be loca~ed not
less than thirty-five (35) feet from the front
lot line, and not less +-han +-en (10) feet from
any side lot line and not less than thirty-five
(35) feet from the rear lot. line,
(3) In the case of corner tots, such building shall
be at least the distance required for a
residential front side street.
(4) A garage, carport or servant's quarters
constructed as an integral part of the main
building shall be subject to the regulations
affecting *he main building, except *ha* on a
corner lot, a private garage, when attached +-o
the main building and not exceeding the height of
the main building, may extend into the required
rear yard to a point not less than eighteen (18)
feet from the rear lot line, and shall not occupy
more than thirty percent (30~) of +-he required
rear yard.
(5) No part of the detached accessory building shall
be closer +-han *en (10) feet }o }he main
building."
Section 9. Section 3.020(3)(d)(1-4) is i~ereby repealed in
its entirety.
Section 10. A new Section 3.020(3)(d)(1-5) shall be
adopted as follows:
"(d) Private garages.
(1) For any dwelling house there shall be permitted
only one (1) private garage, either attached or
freestanding, for the storage only of not more
than three (3) passenger motor vehicles and other
smaller accessories owned by and for the use of
the tenants with a maximum of eight hundred (800)
square feet unless the lot area exceeds ten

Thousand (10,000) square feet in which even} the
square footage may be increased by +-en percen*
(10%) for each one thousand (1,000) square feet
over ten thousand (10,000) square .feet with a
maximum of one thousand (1,000) square feet and a
height not to exceed sixteen (16) feet or one (1)
story.
(2) Provided that such garage shall be located not
less than thirty-five (35) feet from the front
lot line, and not less ~-han ~-en (10) fee* from
any side lot line and not less than }hirty-five
(35) feet from the rear lot line.
(3) In the case of corner lots, such building shall
be at least the distance required for a
residential front side street.
(4) A garage, carport or servant's quarters
constructed as an integral part of the main
building shall be subject ~-o *he regulations
affecting the main building, except ghat on a
corner .lot, a private garage, when attached ~-o
the main building and not exceeding the heigh!- of
the main building, may extend into the required
rear yard to a point not less than eighteen (18)
feet from the rear lot line, and shall not occupy
more than thirty percent (30~) of the required
rear yard.
(5) No part of the de}ached accessory building shall
buildi~ge^ than ten (10) feet to the main
Section 11. Section 2.040(5) of the City of Riverside
Zoning Code is hereby repealed in its entirety,
Section 12. A new Section 2.040(5) shall be adopted as
follows:
"(5) MINIMUM FLOOR AREA. The minimum floor area, finished
for living purposes shall no} be less }han one
thousand three hundred (1,300) square feet."
Section 13. Section 11.010(2) of the City of Riverside
Zoning Code is hereby repealed in its entirety.

Section 14. A new Section 11.010(2) shall be adopted as
follows:
"(2) PROCEDURE AND FEE. Upon returning }he sign permi*
application form to the Ci~-y Clerk, *he Zoning
Enforcement Person shall review the application and
either approve or disapprove the application. Upon
approval, the sign permit fee shall be paid in }he
amount of 125.00 and then a sign permi* shall be
1SSUed."
Section 15. Section 2.050(3) shall be repealed in its
entire}-y,
Section 16. A new Section 2.050(3) shall be adopted as
follows:
"(3) PARKING SPACE. A parking space shall be (exclusive of
driveway, alley, street) nine (9) feet in width by
eighteen (18) feet in length. A parking space shall
be connected with a street or alley by a surfaced
driveway which affords satisfactory ingress or egress
for automobiles."
Section 17. Section 3.060(3) shall be repealed in its
entirety.
Section 18. A new Section 3.060(3) shall be adopted as
follows:
"(3) PARKING SPACE. A parking space shall be (exclusive of
driveway, alley, street) nine (9) feet in width by
eigh*een (18) feet in length. A parking space shall
be connected with a street. or. alley by a surfaced
driveway which affords satisfactory ingress or egress
for. automobiles."
Section 19. Section 2.020(3) of the City of Riverside
Zoning Code is hereby repealed in its entirety.
Section 20. A new Section 2.020(3) shall be adopted as
follows:
"(3) a. Tool Sheds. Tool sheds shall be so loca~-ed }ha~-
they are not. less than ten (10) feet from the
rear to* line or side lot lines and in no case
shall be in front of the front building line of
the residence."

Section 21. Section 3.020(3) of the City of Riverside
Zoning Code is hereby repealed in its entirety.
Section 22, A new Section 3.020(3) shall be adopted as
follows:
"(3) a, Tool Sheds. Tool sheds shall be so located that
they are not less than *en (10) feet from }he
rear lot line or side lot lines and in no case
shall be in front of the front building line of
the residence."
Section 23. Section 3,040(2)(b) of the City of Riverside
Zoning Code is hereby repealed in its entirety,
Section 24. A new Section 3.040(2)(b) shall be adopted as
follows:
(2) (b) SIDE YARD. There shall be a side yard on each
side of a building of not less than ten (10) feet
from the side lot line or closer Shan twenty five
(25) feet to a public street right-of-way. Each
accessory building shall provide a yard between
the building and the property line other than a
street line, of not less than ten (10) feet.."
Section 25. Section 5,030(2)(b) of *he City of Riverside
Zoning Code is hereby repealed in its entirety.
Section 26. A new Section 5.030(2)(b) shall be adopted as
follows:
(2) (b) SIDE YARD, There shall be a side yard on each
side of a building of not less than ten (10) feet.

Section 27. Section 6.020(2)(b) of the City of Riverside
Zoning Code is hereby repealed in its entirety.
Section 28. A new Section 6.020(2)(b) shall be adopted as
follows:
"(2) (b) SIDE YARD. There shall be a side yard on each
side of a building of not less than ten (10) feet
from the side lot line."

Section 29, ,Section 7.020(2)(b) of the City of Riverside
Zoning Code is hereby repealed in its entirety.
Section 30. A new Sec*ion 7.020(2)(b) shall be adopted as
follows:
"(2) (b) SIDE YARD, There shall be a side yard on each
side of a building of not less than ten (10) feet
from the side lot line,"
Section 31. The "Subdivision Regulations of Riverside,
Missouri", shall be repealed in its entirety.
Section 32, Pdew "Subdivision Regulations of Riverside,
Missouri", shall be adopted as set forth in attached Exhibit
nA".
Section 33. The City Clerk is hereby directed ~-o make *he
appropriate changes to the Riverside Zoning Code of the City of
Riverside, Missouri.
