HomeMy WebLinkAbout1993-47 - Appointment of Larry Reese as Emergency Zoning Enforcement Officer13305; 08/02/93 BILL N0. ~~~ ~ ORDINANCE _ /~_'T~ AN ORDINANCE ESTABLISHING A NEW APPOINTIVE OFFICE OF EMERGENCY ZONING ENFORCEMENT OFFICER, APPOINTING AN EMERGENCY ZONING ENFORCEMENT OFFICER, AND ESTABLISHING AN EMERGENCY SUBCOMMITTEE OF THE PLANNING COMMISSION OF THE CITY. WHEREAS, the 1993 flood damage has presently damaged approximately 170 businesses within the City of Riverside, which is approximately g5 ~ of the businesses; and WHEREAS, the City desires to process applications for rebuilding as rapi6ly as possible for those businesses while at the same time requiring compliance with all City, State and Federal laws; and WHEREAS, the existing zoning enforcement officer has other duties in the City making it impractical for the rapid processing of applications; and WHEREAS, the difficulties of assembling a Planning Commission and processing applications through both the Planning Commission and Board of Aldermen may cause a significant detrimental effect to both the businesses damaged and to approximately 6,000 employees who are out of work due to the damage caused by the 1993 flood; and WHEREAS, the Board of Aldermen are concerned with the health, welfare and safety of its residents. NO4u, THEREFGRE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The office of Emergency Zoning Enforcement Officer is created with exclusive jurisdiction to deal with applications for waiver of special permits and applications of special permits within the flood hazard area for buildings damaged in the 1993 flood. Section 2. harry Reece is hereby appointed the Emergency Zoning Enforcement Officer. Section 3. The Emergency Zoning Enforcement Officer shall have those duties set forth in Ordinance No. 89-17 . Section 4. The Mayor is directed to appoint a Subcommittee of the Planning Commission to advise and assist the Emergency Zoning Enforcement Officer in processing of all such applications and a majority of the Subcommittee members shall have authority to approve waivers of special permit fees in the absence of the Emergency Zoning Enforcement Officer. 2 Section 5. All meetings of the Subcommittee shall be held in compliance with 610.010 et seq. of the Missouri Law (otherwise known as the Opening Meetings Law). PASSED THIS ~~ DAY OF ATTEST: __~_, 19 9 3 .
