ORDINANCE NO. `1i'~ AN ORDINANCE ESTABLISHING A CURFEW WITIIIN THE CITY OF RIVERSIDE FOR CHILDREN UNDER TISE AGE OF 17 YEARS, PROHIBITING THE PARENTS, GUARDIAN OR OTHER ADULT HAVING THE CARE OR CUSTODY OF A MINOR UNDER THE AGE OF 17 FROM KNOWINGLY PERMITTING SUCH MINOR TO VIOLATE THE CURFEW ESTABLISHED HEREUNDER, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. A new section of the Riverside City Code is hereby enacted which shall be known as Section 23.020 of the City Code and which shall read as follows: "?.3.020 CURFEW FOR CHILDREN UNDER 17 AND PARENTAL RESPONSIBILITY (a) It is unlawful for any minor under the age of 17 years to ].oiter_, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks playgrounds, or other public grounds, public places, public buildings, places of amusement, eating places, vacant tots or any place unsupervised by an adult having the lawful authority to be at such places, between the hours of 11:00 o'clock p.m. on any day and 6:00 o'clock a.m. of the following day; provided, however, that on Fridays and Saturdays the effective hours are between 12:00 o'clock midnight and 6:00 o'clock a.m. of the following day; and provided, that the provisions of this section shall not apply in the following instances: (1) When a minor is accompanied by his or her parent, guardian or other adult person having the lawful care and custody of the minor; (7.) When the minor is upon an emergency errand directed by his or her parent or guardian or other adult person having the lawful care and custody of such minor; (3) When the minor is returning directly home from a school activity, entertainment, recreational activity or dance; 2 (4) When the minor is returning directly home from lawful employment that makes it necessary to be in the above-referenced places during the prescribed period of time; (5) When the minor is attending or traveling directly to or from an activity involving the exercise of first amendment rights of free speech, freedom of assembly or free exercise of religion; and (6) In interstate travel through the City of Riverside, Missouri. (b) It shall be unlawful for the other adult person having care under the age of 17 years to minor to violate the provision this section. (2) Upon further convictions, a person shall be subject to the penalties for violation set forth in Section 25.003 of this Code. (c) The Department of Public Safety shall track the violations as described in the above sections." SECTION 2. SEVERABILITY. If any section, paragraph, subdivision, phrase, or provision of this ordinance shall be adjudged invalid or. held unconstitutional, the same shall not effect the validity of any other part of this ordinance. SECTION 3. REPEAL OF INCONSISTENT ORDINANCES AND INCORPORATION INTO THE CITY CODE. Any ordinance currently in effect which is in conflict with this ordinance is hereby repealed. The City Clerk is hereby directed to incorporate this ordinance into the City Code of Riverside as Section 23.020.
