HomeMy WebLinkAbout2010-084 BNSF Surface Installation Resolution No. R-2010-084 A RESOLUTION AUTHORIZING FHE MAYOR TO ENTER INTO AN AGREEMENT BY AND BETWEEN THE CITY OF RIVERSIDE, MISSOURI AND BNSF RAILWAY COMPANY FOR CROSSING SURFACE INSTALLATION AT MATTOX ROAD WHEREAS, BNSF Railway Company operates a freight transportation system by rail with operations throughout the United States and Canada, including rail operations through the City of Riverside; and WHEREAS, the City and the BNSF Railway Company have reached an agreement to provide for the replacement of the existing crossing surface at Mattox Street with a new concrete crossing surtace; and WHEREAS, the Board of Aldermen have determined it is in the best interest of the City to enter into an agreement with BNSF Railway Company in substantially the same form as attached hereto as Exhibit A to construct such new crossing surface; NOW, THEREFORE, BE IT RESOLVED, by the Board of Aldermen of the City of Riverside, Missouri, as follows: THAT the Crossing Surface Installation Agreement (hereinafter the "AgreemenY') between the City and BNSF Railway Company in substantially the same form attached hereto as Exhibit A, is hereby approved, including payment for the new concrete crossing surface at Mattox Street in the amount of One Thousand Five Hundred Sixty-five and No/100 Dollars ($1,565.00) perfoot, for an estimated total cost of One Hundred Twenty-five Thousand One Hundred Ninety-nine and No/100 Dollars ($125,199.00); FURTHER THAT the execution and delivery of the Agreement by the City Administrator is hereby authorized and approved, and the City Administrator and city staff are authorized to take such other actions reasonably necessary to carry out the intent of the Agreement on behalf of the City, the execution of the Agreement being conclusive evidence of such approval.
