FOR RENNER BRENNER PARK IMPROVEMENTS WHEREAS, the City of Riverside, Missouri ("City") by the adoption of its purchasing policy has approved the practice of using other governmental entities cooperative bidding process and was therefore able to engage in negotiations with Fry & Associates, Inc. ("Fry") for provision of new shelter houses and accompanying items at Renner Brenner Park (the "EquipmenY'), pricing per Kansas Contract #08303 based on 2010 pricing; and WHEREAS, the City and Fry have reached an agreement concerning the provision of and payment for such Equipment. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: THAT it is hereby determined and declared to be necessary to accomplish and serve the public purpose of enhancing and improving Renner Brenner Park; FURTHER THAT the City of Riverside shall enter into an agreement whereby Fry shall provide and install the Equipment at Renner Brenner Park, at a total cost of $113,434,65 (the "AgreemenY'); FURTHER THAT the execution and delivery of the Agreement, in substantially the form attached hereto as Exhibit A is approved, and the City Administrator and/or the Mayor are authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Resolution on behalf of the City, the execution of the Agreement being conclusive evidence of such approva�; FURTHER THAT the Mayor, City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary of convenient to perform all matters herein authorized. This agreement with Fry and Associates is for: - A new large shelter house and a new concrete pad - R�emoving the gazebo and installing a small shelter house on a concrete pad in its place - New picnic tables, trash and recycling receptacles and grills RECOMMIENDATION: The Park Board voted to recommend the Board of Aldermen approve the agreement with Fry and Associates at their October 6, 2010 meeting. BUDGET,ARY IMPACT: The Park Board originally designated $100,000 toward shelter house improvements out of their FY11 budget. Since this agreement is for $113,434.65, they have decided to delay work at EH Young Park a year and utilize a portion of the $100,000 they had designated for work in that park to cover the remaining improvements at Renner Brenner Park.
