HomeMy WebLinkAbout1994-17 - Amendments to the Zoning OrdinanceBILL NO. #28855; 02/24/94 Revised 03/01/94//// ORDINANCE NO. 7'~ AN ORDINANCE ESTABLISHING AMENDMENTS TO THE ZONING CODE ADOPTED BY ORDINANCE NO. 89-15, THAT ADD THE LEGAL DESCRIPTION FOR THE COMMERCIAL VESSEL DISTRICT TO CHAPTER 22 OF THE ZONING CODE, ADD TEMPORARY STRUCTURES TO THE COMMERCIAL VESSEL DISTRICT AND TO CHAPTER 13 OF THE ZONING CODE, DEFINITIONS. WHEREAS, the City of Riverside, Missouri adopted a new Zoning Code on February 21, 1989 by Ordinance No. 89-15. WHEREAS, in reviewing the suggested to be made to allow effectively and effir_iently. Zoning Code, changes were the Zoning Code to work more WHEREAS, in reviewing the Zoning Code no provision for temporary structures was found. WHEREAS, the City of Riverside wishes to enact and enforce the new amendments to the Zoning Code. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. Section 13.130(2) a. and b. shall be eliminated with an addition to Section 22.020 Legal Descriptions, District 5 - Industrial and which shall be amended to add Tract 8 and Tract 9 which are as follows: TRACT 8: A tract of land in parts of fractional Sections 8 and 9, Township 50 North, Range 33 West and situated in Riverside, Platte County, Missouri, more particularly described as follows: Commencing at the Northwest corner of said fractional Section 9; thence S 00° 02' 00" E along the West line of said fractional Section 9 a distance of 1,591.58 feet to the West Quarter corner of said fractional Section 9, said corner also being the point of beginning; thence S 89° 20' 30" E, along the Quarter Section line, 1,303.50 feet to the East line of the West half of the West half of fractional section 9; thence S 00° 02' 00" E, along said East line, 961.64 feet to the mean vegetation line of the Missouri River as it now exists; thence meandering along the mean vegetation line of said River, S 32° 14' 03" W a distance of 30.34 feet; thence S 60° 12' 35" W continuing along said River 800.22 feet; thence S 760 04' 06" W continuing along said River 168.99 feet; thence S 670 42' 27" W continuing along said River 196.13 feet; thence S 400 37' 13" W continuing along said River 64.32 feet; 2 thence S 56° 54' 24" W continuing along said River 31.94 feet; thence S 67° 28' 38" W, continuing along said River, 105.85 feet; thence S 44° 04' 48" W, continuing along the mean vegetation line of said River, 50.17 feet; thence S 61° 40' 26" W, continuing along said River, 51.81 feet to the West line of fractional Section 9; thence continuing along last named course and continuing along said River, 225.74 feet to the East right-of-way line of Missouri Highway Route 169/69 as it now exists; thence N 16° 02' 10" W along said East right-of-way line 825.31 feet; thence N 01° 35' 55" E continuing along said East right-of-way line 165.05 feet; thence N 07° 38' 34" W continuing along said East right-of-way line 442.17 feet; thence N 18° 15' 21" W continuing along said East right-of-way line 421.49 feet to the North line of the Southeast Quarter of fractional Section 8, Township 50 North, Range 33 West; thence S 89° 20' 14" E along said North line 612.00 feet to the point of beginning and containing 56.4657 acres more or less. TRACT 9: All that portion of the plat of Red X Plaza, a subdivision of land in Riverside, Platte County, Missouri, which lies south of the Chicago, Burlington and Quincy Railroad right-of-way line, which was not previously vacated by Ordinance No. 89-62 recorded in the Recorder of Deeds office of Platte County, Missouri at Book 735, Page 528, except the North 125 feet of Zeke Road more particularly described as follows: Starting at a point where the East line of Zeke Road meets the South right of way line of the Chicago, Burlington and Quincy Railroad, then South along the East line of Zeke Road 125 feet, thence N 69° 0' 03" W a distance of 80 feet to a point on the West line of Zeke Road, thence North on West line of Zeke Road 125 feet to point on South right of way line of the Chicago, Burlington and Quincy Railroad, thence Southeast along the South line of the Chicago, Burlington and Quincy Railroad a distance of 80 feet to the true point of beginning. Section 2. Section 13.130 (7) shall be amended as follows: "(7) a. ACCESSORY BUILDINGS. Unless expressly waived by the Planning Commission and Board of Aldermen, no accessory structures shall be permitted. b. TEMPORARY STRUCTURES. Temporary structures may be permitted within this district with preliminary approval by the Zoning Enforcement Officer and prior approval of the Planning Commission after meeting the following requirements: 3 1. On or before the expiration of the special use permit the temporary structure shall be moved a distance greater than 10 feet, including the disconnecting of all utilities, i.e., water, sewer and electrical. 2. A building permit application must be submitted and approved prior to the expiration date. 3. A plan for the moving of the temporary facilities which shall include a time frame from a responsible agency or firm which shall provide for i:he man power, equipment and the relocation and reconnection of all utilities." Section 3. Section 23.020 a definition of the term "Temporary Structure" shall be appropriately alphabetically inserted and shall be adopted to read as follows: "TEMPORARY STRUCTURE: A temporary structure is a structure permitted within Section 13.130 only that is permitted for a period up to 180 days and is required to be moved at the expiration of the permit period." MAYOR RECOMMENDATION OF THE PLANNING COMMISSION The Planning Commission acting pursuant to public notice does recommend to the Board of Aldermen their adoption of the proposed amendment to the Zoning Code set forth in the attached proposed Ordinance, marked Exhibit "A" and made a part of this as though fully set forth herein.
