HomeMy WebLinkAbout2010-096 - Excessive Force CDBG Resolution No. R — 2010-096 A RESOLUTION ESTABLISHING RULES AND REGULATIONS REGARDING THE USE OF EXCESSIVE FORCE DURING NON—VIOLENT CIVIL RIGHTS DEMONSTRATIONS, INCLUDING PHYSICALLY BARRING ACCESS TO A FACILITY OR LOCATION WHICH IS THE SUBJECT OF SUCH DEMONSTRATION, AND PROVIDING PENALTIES FOR VIOLATION THEREOF IN THE CITY OF RIVERSIDE, MISSOURI WHEREAS, the City of Riverside desires to adopt a policy establishing rules and regulations regarding the use of excessive force during �on-violent civil rights demonstrations; NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF ALDERMEN OF RIVERSIDE, MISSOURI, AS FOLLOWS: THAT the City of Riverside hereby adopts and will enforce this policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individual engaged in non-violent civil rights demonstrations; FURTHER THAT it is the policy of the City of Riverside to prohibits the physical barring of any entrance or exit to any such facility where a non-violent civil rights demonstration occurs and will enforce all applicable State laws in this regard; and PASSED AND ADO TED by the B ard of Ald rmen and APPROVED by the Mayor of the City of Riverside, Missouri, the�/�ay of 10. � , • . . �,z`��,�c��✓'��� -' � Kathleen L. Upstream from ordinary. 2950 NW Vivion Road Riverside, Missouri 64150 MEMO DATE: December 17, 2010 AGENDA DATE: December 21, 2010 TO: Mayor and Board of Aldermen FROM: Nancy Thompson RE: Resolution Establishing a Policy Regarding Use of Excessive Force During Non- Violent Civil Rights Demonstrations BACKGROUND: As part of the CDBG Grant process, the City is required to provide evidence it complies with certain standards and policies established by the State of Missouri and Department of Economic Development — and that the City has enacted its own administrative policies consistent with such standards. This Resolution establishes a city policy relating to the use of excessive force during non-violent civil rights demonstrations. RECOMMENDATION: Staff recommends approval of the resolution. BUDGETARY IMPACT: There is no budgetary impact. i
