R-2010-099 A RESOLUTION AUTHORIZING AND APPROVING GREENFIELD INVESTMENTS, LLC TO SUPPLY AND DELIVER FILL DIRT TO THE RIVERSIDE INDUSTRIAL PARK AT THE HOOVER UNIVERSAL SITE WHEREAS, the has entered into an agreement with Hoover Universal, Inc. to deliver a rough graded project site within the Horizons Development area; and WHEREAS, Greenfield Investments, LLC (hereinafter "Greenfield") owns property within the City and located less than one mile from the Hoover Universal project site; and WHEREAS, Greenfield has a need to remove dirt from its property in order to complete further development within the Montebella Subdivision; and WHEREAS, Greenfield is uniquely situated to provide the necessary fill dirt in a timely fashion to provide the rough graded project site to Hoover Universal, which will stimulate additional economic development within the City; and WHEREAS, the City has negotiated with Greenfield and Greenfield has agreed to provide supply and deliver such fill dirt at a cost less than the City obtained such dirt on the Argosy North Bridge Project; and WHEREAS, the Board of Aldermen find it is in the best interest of the City to enter into a contract with Greenfield Investments, LLC to perform such project and that it necessary to waive the strict requirements of the City's Purchasing Policy in order to meet the timeline necessary to provide the necessary fill dirt to the Hoover Universal project site and that the terms and conditions of the agreement between the City and Greenfield are found to be reasonable and in the best interest of the citizens; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MIS50URI, A5 FOLLOWS: THAT an execution of agreement by and between the City of Riverside and Geenfield Investments, LLC. in substantially the same form as attached hereto in Exhibit "A" and incorporated herein by reference is hereby authorized and approved; and FURTHER THAT the project is subject to the requirements of Section 292.675 RSMo, which requires all contractors or subcontractors doing work on the project to provide, and require its on-site employees to complete, a ten (10) hour course in construction safety and health approved by the Occupational Safety and Health Administration (OSHA) or a similar program approved by the Missouri Department of Labor and Industrial Relations which is at least as stringent as an approved OSHA program. Such training must be completed within sixty (60) days of the date work on the Project commences. On-site employees found on the worksite without documentation of the required training shall have twenty (20) days to produce such documentation; and FURTHER THAT the City Administrator is hereby authorized to execute all documents and agreements necessary or incidental to carry out the terms and conditions of such agreement and the City Clerk is authorized to attest thereto.
