AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION AND THE BURLINGTON NORTHERN RAILROAD RELATIVE TO CERTAIN CROSSING IMPROVEMENTS AT VAN DE POPO[JLIER ROAD. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized to execute a contract with Missouri Highway and Transportation Commission and the Burlington Northern Railroad relative to certain crossing improvements at VanDePopoulier Road. Section 2. Vg /~ Crossing No. 079 382U `~. ~ ~~..~ L~ _~:_~ L~ ~--~ ,.-~ z-~, ~ T- ~'Pro~~c~` RRP-000S (086 ) SUPPLEMENTAL AGREEMENT FOR ADDITIONAL WARNING DEVICES This agreement is entered into by the Missouri Highway and Transportation Commission (hereinafter called "Commission"), the Burlington Northern Railroad (hereinafter called "Railroad"), and the City of Riverside, hereinafter called "Agency"), pursuant to the terms of a Master Agreement between the Railroad and Commission executed by the Railroad on August 20, 1980, and by the Commission on September 11, 1980. WITNESSETH: WHEREAS, the installation of active warning devices appears to be warranted at an existing grade crossing in Clark, Missouri, where Vandepopoulier Street intersects Railroad's tracks at a point know as DOT #079 382U. WHEREAS, the parties agree that this installation shall be in substantial compliance with the Manual on Uniform Traffic Control Devices (MUTCD), and will enhance safety to both highway and Railroad traffic at said grade crossing; NOW, THEREFORE, in consideration of these premises and of the mutual covenants herein contained, the parties agree as follows: (1) PURPOSE: The purpose of this agreement is to provide for funding, installation, and maintenance of additional warning devices at this highway-railroad crossing. (2) SCOPE OF WORK: The work consists of the installation of flashing light signals with gates and constant warning time devices by Railroad. (3) FUNDING: Commission will reimburse Railroad for 90$ of the project cost utilizing federal funds. The remaining 10$ of the financing which is not covered by federal funds is the Agency's share. Deparment of Economic Development, Division of Transportation (DED/DOT) staff will make application to their division for authority to improve the crossing devices. Through the application process, DED/DOT will determine if state funds are available and eligible to provide the Agency's cost. If DED/DOT is not able to pay 10~ of the total cost, this supplemental agreement may be declared null and void unless Railroad elects to assume the Agency's share of the cost. (4) COST OF PROJECT: The cost of the project shall be the total monies expended by Railroad to complete the installation, all in accordance with the plan and estimate. 1 (5) PRELIMINARY WORK: Railroad shall prepare and submit to Commission a plan and cost estimate for the work described on the diagnostic review attached hereto for the subject crossing. (6) CHANGE ORDERS: If any change is made in the original plan and extent of the work, Railroad agrees that reimbursement shall be limited to costs covered by a change order having approval of the Commission PRIOR to the performance of the work. (7) INSTALLATION: Railroad, upon receipt of notification from Commission, shall furnish all labor and material and complete the installation in accordance with the Master Agreement and in accordance with the plan and estimate attached hereto, and the rules and regulations contained in FHPM 1-4-3, and any revisions thereto which by reference are made a part of this agreement. (8) MAINTENANCE AND OPERATION: Railroad shall operate and maintain the signal installation as long as it operates trains through the crossing or until DED/DOT orders that signals are no longer necessary at the crossing; or until the crossing is abandoned, closed, or for any reason the operation and maintenance of the signals becomes unnecessary. (9) RELOCATION OF SIGNALS: In the event the signals become unnecessary for any of the above reasons, Railroad shall remove and install the devices at another crossing mutually acceptable to Commission and subject to the approval of DED/DOT. (10) PAYMENT PROVISIONS: Commission shall, upon receipt of Railroad's final statement of costs and after a review of the statement in relation to the work performed, reimburse Railroad for Commission's obligation which is 90$ of the total costs. If audit reveals that Railroad has been overpaid, Railroad will immediately refund to Commission such overpayment. If audit reveals that Railroad has been underpaid, Commission will immediately reimburse Railroad for such underpayment. (11) AGENCY OBLIGATION: Agency hereby agrees to cooperate in the handling of traffic during construction. Agency is obligated to install and maintain at their expense advance warning signs and pavement markings in accordance with the MUTCD and as instructed by the diagnostic review. 2 IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by their duly appointed officials.
