C~9~~ AN ORDINANCE ENACTING A NEW SECTION OF THE CITY CODE OF RIVERSIDE, MISSOURI, TO BE KNOWN AS SECTION 21.006, PROr~IBITING THE VIOLATIOr1 OF CERTAIN PRO'T'ECTION ORDERS ISSUED PURSUANT TO CHAPTER 455 R.S,MO. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION l: A new Section 21.006 of the Code of Ordinances of the City of Riverside, Missouri is hereby enacted and reads as follows 21.006 ENFORCING COURT ORDERS OF PROTECTION (1) It shall be unlawful for a party, against whom a protective Order has been entered pursuant to Chapter 455 R.S.Mo, to commit an act of abuse in violation of that Order. (2) It shall be unlawful for a person, against whom an Order of Protection has been entered pursuant to Chapter 455 R.S.T~~o. to fail to surrender custody of minor children to the person to whom custody was awarded in the Order of Protection. (3) An Ex Parte Order of Protection or a Full Order of Protection entered pursuant to Chapter 455 R.S.Mo, has been violated under this ordinance when the terms and conditions regarding abuse, child custody, or entrance upon the premises of another have been violated and the violator has "notice" of the Order. (4) For the purposes of this ordinance, in addition to the notice provided by actual service of the Order, a party is deemed to have notice of an Order of Protection if the law enforcement officer responding to a call of a reported incident of abuse or violation of an Order of Protection presents a copy of the Order of Protection to the Respondent. (5) The fact that an act by Respondent is a violation of a valid Order of Protection shall not preclude prosecution of the Respondent for other crimes arising out of the incident in which the Protection Order is alleged to have been violated. (6) Any law enforcement officer who has probable cause to believe a violation of this ordinance has occurred, shall have the authority to arrest the Respondent whether or not the violation occurred in the presence of the arresting officer. (7) Upon conviction of any violation of Section 21.006, any person so convicted shall be punished by imposition of a fine of not less than One Dollar (1.00) nor more than Five Hundred Dollars (500.00) or by imprisonment for a term not to exceed ninety (90) days or by both such fine and imprisonment. SECTION 2: All provisions of the code of the City of Riverside, Missouri which are inconsistent herewith are repealed and amended to conform with this ordinance. The City Clerk is directed to incorporate the provisions of this ordinance into the appropriate sections of the City Code. PASSED THIS DAY OF ATTEST: CITY CLERK 1989.
