WHEREAS, proceedings have been initiated for the vacation of the following lots and easements in the City of Riverside, Platte County, Missouri, more particularly described as follows: Lots 4 through 7, inclusive Blk. 3, INDIAN HILLS FIRST ADDITION. Lots 4 through 12, inclusive, Blk. 5, INDIAN HILLS FIRST ADDITION. Let 1, Blk. 1, INDIAN HILLS SECOND PLAT. All of Lots 2 and 3 in Block 5 in INDIAN HILLS FIRST ADDITION, a subdivision of land in Platte County, Missouri, except that part thereof described as follows: Beginning at a point in the Southwesterly line of Lot 3, Block 5, INDIAN HILLS FIRST ADDITION, where the Easterly prolongation of a straight line which passes through the Northwest corner and the Southeast corner of Lot 3, Block 3, in said INDIAN HILLS FIRST ADDITION, intersects with said Southwesterly line of said Lot 3, Block 5, in said INDIAN HILLS FIRST ADDITION; thence continuing along said Easterly prolongation of said straight line to its intersection with the Northeasterly line of Lot 2, Block 5, in said addition; thence Southeasterly along the Northeasterly line of said Lot 2, Block 5, to the Southeast corner of said Lot 2, Block 5, thence along the Southerly line of said Lot 2, Block 5, to the Southwest corner thereof, thence Northwesterly along the Westerly lines of Lots 2 and 3, Block 5, in said INDIAN HILLS FIRST ADDITION to the point of beginning. All of Lot 3 in Block 3, in INDIAN HILLS FIRST ADDITION, a subdivision of land in Platte County, Missouri, except that part thereof described as follows: Beginning at the Northwest corner of said Lot 3; thence Southeasterly along the West line of said Lot 3 to the Southwest corner of said Lot 3; thence Northeasterly along the Southerly line of said Lot 3 to the Southeast corner of said Lot 3; thence Westerly along a straight line to the Northwest corner of said Lot 3, being the point of beginning. All in the City of Riverside, Platte County, Missouri. ~~~ ~. 0749 PA6t 6~5 WHEREAS, a notice was published for a public hearing for the vacation of said lots and easements, and that the Board of Aldermen does now consider the adoption of an ordinance vacating the same. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: Section 1: That by notice published in the Platte County Gazette, a newspaper published in Platte County, Missouri, and being of general circulation in the City of Riverside, Missouri, for two consecutive insertions, namely the 5th day of December, 1990, and the last insertion on the 12th day of December, 1990, public notice was given that at the hearing on the 18th day of December, 1990, the Mayor and Board of Aldermen of said City would consider the vacation of the above-mentioned lots and easements. Section 2: That it is deemed necessary or expedient to vacate the said lots and easements located in the City of Riverside, Platte County, Missouri, as described in Section 3 hereof. Section 3: That on the 18th day of December, 1990, in regular session, the Mayor and Board of Aldermen of the City of Riverside, by unanimous vote, approved the vacation of the following lots and easements in the City of Riverside, Platte County, Missouri, more particularly described as follows, to-wit: Lots 4 through 7, inclusive Blk. 3, INDIAN HILLS FIRST ADDITION. Lots 4 through 12, inclusive, Blk. 5, INDIAN HILLS FIRST ADDITION. Lot 1, Blk. 1, INDIAN HILLS SECOND PLAT. All of Lot 3 in Block 3, in INDIAN HILLS FIRST ADDITION, a subdivision of land in Platte County, Missouri, except that part thereof described as follows: Beginning at the Northwest corner of said Lot 3; thence Southeasterly along the West line of said Lot 3 to the Southwest corner of said Lot 3; thence Northeasterly along the Southerly line of said Lot 3 to the Southeast corner of said Lot 3; thence Westerly along a straight line to the Northwest corner of said Lot 3, being the point of beginning. All in the City of Riverside, Platte County, Missouri. Provided that the City retains the right to maintain, operate, repair and replace by itself or by any licensee or holder of a franchise from the City any poles, wires, pipes, conduits, sewer mains, water mains or any other facility or equipment for the maintenance or operation of any utility now located in, over or under any portion thereof vacated by this ordinance. Section 4: That the City Clerk of the City of Riverside, Missouri, is hereby authorized and directed to acknowledge a certified copy of this ordinance in the form required by law for the acknowledgment of deeds, and such ordinance so acknowledged and the consents of the property owners herein required which are contained within the Petition for Vacation shall be filed for record in the Office of the Recorder of Deeds of Platte County, Missouri. ~~ / PASSED THIS /~~~~c, DAY OF ~~~ ~~~~:)i.G~~~t't , 1990. ~~ . .
