ORDINANCE TO IPJSURE COi~1PLIANCE WITH REQiJIREMENTS OF THE FEDERAL
EMERGENCY MANAGE;~iENT AGENCY .
~~liIEREAS the Federal Emergency Management Agency has
recently revised the rational Flood insurance Program Flood
Plain Management criteria and
rIHEREAS the City of Riverside desires to maintain its
ordinance and reguiatioris in compliance with said criteria by
making r:ecessary amendments to its coda.

i. That Ser.tion 13.714(a) be added L-o read Gs follows
"In the event the City institutes proceedings in the
Circuit Court tc enforce the provisions of this Zoning
Ordinance pursuant to Section 13.714 and such
proceeding results in a decision in favor cf the City,
the adverse party thereto shall be obligated t.o pay
aJ.1 court cosi.s, attorney's fees and other costs of
iitiga.ion incurred by the City and sha d in addition
thereto pay any punitive damages awarded to the City
in such proceeding, the assessment of 4.~hich i s hereby
specifically authorized.'°
2. That Section 13.715(e) be added to read as follows:
Upon conviction of violation of this Zoning Ordinance
any such violator shall be sente,.red to pa>> a fine of
not less than Ten Dollars (~10.0U) nor more than One
'"i'housand Dollars (~1,000.G0) or shall be sentenced to
serve a term of imprisonment not to exceed one (1)
year or shall be punished by both such fine and
imprisonment."
3. That Section 13,815F. shal.7. be amended to add the
following sentencer.o thc- end cf the existing section:
"In addition, it caill be assured that the flood
carrying rapacity within the altered or relocated
portion of arty water couse is m<~intained."
4. That Section ).3.815G.(J_)a. shall be amended to
read as foiiews:
"Subdivision proposals and other proposed new
development; shall be required to assure that (a) all
such proposals are consistent with the need to
au r,i_mize flood damage, (k;i all public utilities and
facilities such as sewer, gas, electrical, and water
systems are located, elevated and constructed to
minimize or eliminate f_locd damage, (c) adequate
drainage is provided so as to reduce exposure to flood
hazards, and (d) proposals for development of five (5)
acres or fifty (50) lots whichever is lesser, include
within such proposals the regulatory flood elevation."
5. 5"hat Section 13.815G.(1)b shall be amended r.o
read as fO110WS:
"t~'ew development and substantial improvements shall:
(7} use construction materials and utility equipment
ti:at are resistant to flood damage, (2) use
construction methods and practices that will
minimize flood damage consistent with economic
practic~rbiiity, and (3) electrical, heating,
ventilation, plumbing, aril air-conditioning
equipment. and other service facilities shall be
designed and/or located so as to prevent water from
entering or accumulating within the components
during conditions of flooding".
5 . A r.ew code section i3 .815G. (j ) shay be added to read
as follows
"For all new construction and substantial
improvements, fully enclosed areas below the lowest
floor that are subject to flooding sha.11 be designed
to autemati.caliy equalize hydrostatic flood forces on
exterior walls by allowing for the entry and exit of
flood waters. Designs for meeting this requirement
must either be certified by a registered professional
engineer or architect or must meet or exceed the
following minimum criteria: a minimum of two openings
having a total net area of not less than one square
inch fer every square foot of enclosed area subject to
f.':.oodir.a shall be provided. The bottom of all
openings shall be no higher than one foot above
grade. Openings may be equipped with screens,
louvers, or other coverings or devices provided that
they permit the automatic entry and exit. of flood
waters."
7, A new coda section 13.81~G.(k) shall be added to read
as follows:

lowest enclosed area (including basement). An
unfinished or flood resistant enclosure, usable solely
for parking of vehicles, building acct-ss or storage,
in an area other than a basement area, is not
considered a building's lowest floor, provided that
such enclosure is not built so as to render the
structure in violation of the applicable non.-elevation
design requirements of this ordinance."
8. That Section 13.1000 (92) be amended to read as
fol]ows:
"Structure - a Waller'. and roofed structure including a
ga> or liquid storage tank that is principally above
the ground including but without limitation to
buildings, factories, sheds, cabins, manufactured
homes, mobile homes, ar.d other similar uses."
9. That Section 13.1000 be amended by adding thereto the
fallowing subsections:
111. Development means any manmade change to improved
or unimproved real estate including '~~ut not limited to
buildings or other. structures, mining dredging,
filling, grading, paving, excavation or drilling
operations.
112. Manufacti;red Home means a structure
transportable .in one or more section which is built on
a permanent chassis and is designed for use with or
without a permanent foundation when connected to the
require utilities. For flood plain management
purposes the term manufactured home also includes
p%rkc:d trailers, travel trailers, and other similar
vehicles placed on a site for greater than .180
consecutive days. For insurance purposes the term
manufactured Home does not include parked trailers,
travel trailers and other similar_ vehicles.
113. Manufactured Home Park or Subdivision means a
parcel (or contiguous parcels) of land divided into
two or more r;anufactured home lots for rent or sale.
1i4. Manufactured Home Site means a plot of ground
within a manufactured home park or subdivision
designed for accommodation o~ one manufactured home.
ll5. Mean Sea Level. means the average height of the
sea for ail stages o` the tide.
