HomeMy WebLinkAbout2007-05-01Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri May 1, 2007 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on May 1, 2007 at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Fuller, Bruns, Darata, Hurt, Salyer and Super. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Gregory Milts, Brent Miles, Duector of Planning & Economic Development and John McClelland, City Attorney. Minutes of Apr. 17th Alderman Bruns moved to approve the minutes for April 17, 2007 seconded Approved by Alderman Hurt, the vote was: Aye: Aldermen Slayer, Datata, Fuller, Bruns, Super and Hurt. Motion carries. Minutes of Apr. 24`s Alderman Hurt moved to approve the minutes of April 24, 2007, seconded by Approved Alderman Fuller, the vote was: Aye: Aldermen Dazata, Fuller, Salyer, Bruns, Hurt and Super. Motion carries. Public Hearing Opened Mayor Rose opened the Public Hearing at 7:03 p.m. concerning a petition for annexation of certain real property into the City filed on March 6, 2007 and the property is located West of the City limits marked by Northwood Road and North of the City limits Homing parallel to Missouri State Highway 9. Brent Miles, Duector North River Holdings, LLC filed for voluntary annexation and John and David of Planning & Economic Barth and Mike Pursell are associates. These associates now have a prepared Development comments plan. Annexation was talked about during the Master Plan meetings. The Comprehensive Master Plan Goals: "According to the ETC Citizens Survey administered in 2006, 64% of Riversides' residents aze supportive of annexation if it comes without a tax increase or a reduction in services to current residents." The City does have the ability to annex this piece of property in compliance with State Statutes. The plan says this is an opportunity for "high quality"residential. Brent summarized the benefits of the proposed annexation: The site plan shows new single family homes (villas) hopefully, maintenance provided. This is comparable to the east side of 169 Highway (Briarcliff, $300,000 villas). The price range of the proposed homes will be from $350,000 to $750,000. These will be some "high end" homes because of the Kansas City skyline view. This is amulti-phased development with 4-5 phases. Positives of Annexation: Northwood Road Improvements. The City and developer entered into a cost shaze agreement for Phase I Northwood Road Mins. Improvements. The developer pays 100% of the design of the road and for the construction costs, the developer pays roughly 70% and the city pays 30% of construction cost fees for Phase I. The timeline for Phase I is June ls` (as soon as Mins. 5/1/07 school ends) and there is a five to seven year build out, depending on the market. Northwood Road brought up to city standards, includes asphalt, curb & gutter, sidewalks, pedestrian trail and storm water facilities. This plan includes 290 new single family homes, 870 new residents, franchise taxes ($115,000 yearly) fuel taxes ($35,000 yearly) and demographics impact; estimated $150,000 annually for both. Sales tax should increase with businesses brought into the City. The City is now 70% renters and 30% owner occupied. With this annexation and the development of Gatewoods property and Briarcliff redevelopment, this percentage would flip to 62-65% owner occupied. From the Line Creek water shed, everything that happens north comes through this area and with steep bluffs and a pool table river bottom, this must be dealt with. A way to do this is by annexing this property and the City can have control over storm water management. The City can work with the developer on Northwood Road improvements to go above and beyond the set standards, thus improving the storm water standards, decreasing fees and fears when flooding occurs in the river bottoms. Two items being worked on aze fire protection and an ambulance district. The fire protection of this property is now within the boundaries of the Southern Platte Fire District. There is a discussion going on now as to whether this should be covered by the Southern Platte Fire District as to whether the City should provide protection. If the City would provide fire protection, there is a formula provided by State Statute, either the City, the City and Developer or Developer would need to negotiate with the fire district to pay off the taxes that the fire district would have received to serve this azea. The ambulance district's service provider, Mast takes caze of this azea and it is staff's recommendation this stay in the ambulance district and they receive the tax. The annexation will not cause taxes to the Riverside residents. Public comments Irene Paulhe, 4700 Petronella asked how the franchise figure was calculated. and boazd members Brent said house price for the lots ,backed that out to into a squaze footage size, used an estimate of utility usage for that size of house and took that times how many there were and for each utility there was a different franchise fee, somewhere from 5% to 2 %2 per cent. The franchise fee was calculated on the squaze footage basis. Irene wanted to know what it is going to cost the City to improve the road, street lights and sidewalks, in conjunction with the $150,000 received from franchise tax and gasoline tax. Irene said she is not in favor of the houses being so close, there needs to be more green space, especially in the southwest corner. Brent said HNTB did the design and these lots aze very large to accommodate lazge homes. There is meandering trails, green space, a club house, proposed water fall and fountains. There is some limited green space in certain areas. This can be brought back for discussion to the Planning & Zoning Commission and Boazd of Aldermen if there were more comments on green space. Brent said the City is not building any of the public streets in the subdivision. All the City is involved in, is the 30% for Northwood Road improvements. The developer got approval from the road district for City control. That 30% is Minn. 5/1/07 $250,000 to $280,000. At full build out, this would cost the City roughly $36,000 for trash. Street lights cannot be figured at this time because the details of the street lighting plan are not complete. The Developer pays for the street lights and the City only pays for a lease per light. The new Public Works Duector will take care of the street sweeping, plowing snow, but repair will be minimal because of them being new streets. Evelyn Poe, 3002 NW Florence said we already have 4 areas for planned housing and when the bottoms starts developing, she thinks this 5th azea is "stretching" fire, police, maintenance etc. She wonders how faz can we can stretch without adding onto (hiring more people) for Public Safety and Public Works and not end up being taxed. She does feel if we keep getting bigger, the residents will have to pay taxes. Mrs. Poe did not understand the fire and ambulance discussion. Brent explained this is in the boundaries of the Southern Platte Fire District and the Southern Platte County Ambulance District. The City entered into a contract with Mast for service to the City. The resident's in the proposed development would pay an ambulance tax and these residents will receive an assessment from Southern Platte Ambulance District. This is in the boundaries of the So. Platte Fire District and they would receive a tax off of this development. If the City wants to take control of this, there is a formula (per State Statute). At this point, the Southern Platte Fire District would come in conflict with that we would owe the fire district. There aze internal discussions going on now with South Platte Fire District and we need to work with the fire district, developer and boazd of aldermen to come up with a solution for the fire protection. The Pazkville fire station would take care of the new residents in the proposed azea for now. Bill Bright, 4411 Pawnee said there is a sub shift between spending before and no increase in cost to the City to no increase in taxes. Brent said there is an increase in trash service cost and the staffing issues are going to be apparent no matter what happens. Mayor Rose said when the development in Horizons occurs, we are probably looking at an off-sight fire station and this will take more staff. Mr. Bright said if it was something that was going to be built regardless, the City wouldn't be out the increased costs. Mr. Bright wonders why it would it be beneficial to the City to annex unless the City is just looking for more places to spend money. Aldermen Super said there would be an increase in revenue. It's not strictly a "cost thing" because we don't know how much sales tax will be generated. Mr. Bright says it wouldn't make any difference sales tax wise if they were in artificial boundaries or not. The difference in sales tax happens when somebody inside the City subbing something and has something that the people want to buy. He feels the only part the sales tax directly in the City would be the purchase of vehicles. Whether they go to the Corner Cafe, the hazdware or else has nothing to do within the city boundaries. Mayor Rose said if there were $400,000 to $700,000 homes, the likelihood of people buying new homes would be pretty good. Mins. 5//1/07 Mr. Bright said what he is trying to get at is how much money the City would be out. Brent said it is very easy for the City to quantify the cost of trash and very difficult to quantify the positives, but we know they are there. Brent said the Mayor, Board and many people that showed up at the meeting for the Master Plan were very intent on changing the demographics, image and reputation of the City and this project accomplishes that. Alderman Bruns said if this is not annexed, we must ask, "Do we want to carry that burden if taxes come along or do we want to share the burden?" Mr. Bright said his understanding is when Horizons is developed there will be an Industrial base for taxes and they will carry their fare share and no extra burden on the residents. Mayor Rose said the board is trying to do what people want from the town hall meetings. The people said, "clean the place up" and make it better. Evelyn Poe, 3002 NW Florence, said the concern is the resident's have had no taxes, the City is getting bigger and she is concerned about having to pay taxes. Brent said the sewer system will be built by the contractor/developer. Alderman Darata asked if the tax would have to go to the voters. Brent said, "Yes". Brent said there is no concern on any financial burden of the City. Phyllis Reece, 4551NW High Drive said there is a different range of people that lives here, some on a fixed income. If the City taxes the older people they will have to pay. She believes all ranges of people should be considered. David Blackburn mentioned the storm water control that is a major issue. One of the reasons the annexation was considered was because there are 2 large pipes that has to go through the levee and when it rains and the water starts rising the water is pumped out to storm outlets. When it gets to river flood stage at the top of the levee, they have to be shut off because there's no ability to move the water back into the river. At this point, water is running out down tributaries into the proposed annexed area. The idea is if this property stays in the County, the City has no control over this. Irene asked about how the water is controlled before it comes into the City versus being in the County. Mike Duffy, Shafer, Kline & Warren said Continental Engineers did a storm water study for the entire Horizons area. One of their comments when they were taking care of everything that was occurring within the levee area, but they had concerns about off site water coming into the City and being able to handle that amount of flow. Several areas were identified, several drainage basins to the north, most that come through the proposed annexed property. There is a detention basin at the SE corner of the Horizons area at I-635 that handles water that is in there, but if the water comes off the hillside and flows across Highway 9, it gets into channels on the south side, flows underneath the railroad tracks and all comes down to the same area of the SE corner of the Horizons area. We need to have the ability to control storm water before it gets to that detention and make sure it's in compliance with the APWA, It is put into the plat at the time of development and they show how storm water will be handled. The County regulations for storm water management are not as stringent as the City's. It is felt the Horizons area can be controlled if we can also control the upstream areas. Mins. 5/1/07 Alderman Hurt asked if Northwood Road would be able to handle heavy traffic. Brent said Phase I requires 11"pavement wide enough to accommodate 31anes, but the traffic doesn't warrant 3 lanes, so it will be stripped for 21anes with tum lanes for the development and turn lanes for the school. As development occurs in phases, it will be 3 lanes to accommodate all the traffic. Alderman Salyer asked if the green space shown is trees that are already there. Brent said, "Yes". He also asked if the project shown would all be completed in one phase. Brent said up to that point, "Yes" and a 10' pedestrian trail on the west side. Alderman Salyer asked Brent if we would have some influence over the water shed whether this is annexed or not. Brent said very little because it would be under County regulations that are not as strict as the City's. He also asked, if annexed, if the City would do house inspections and Brent said "Yes". Alderman Salyer asked if the annexation doesn't go through if the City will have road improvements anyhow and Brent said, "Yes". Alderman Salyer said if City taxes do happen in the future, it's better to spread it azound. Alderman Bruns said if it came to a vote, the people living in the new houses would want to hold on to their money as much as the other residents and not want more taxes. Brent said construction would start as school let's out and there would be 2 entrances coming onto the road. The 6 phases are the bottom SE corner, middle, bottom SW and 2 northern. The east side will move forwazd as Phase 2 or 3. Public Hearing Closed Mayor Rose closed the Public Hearing at 8:09 p.m. Frank Weatherford's Frank Weatherford, TranSystems spoke to the board about the preliminary comments findings of the wayside horn. The fmding was the static horn produced considerably less noise. This was a pretty accurate test. The proposal to install the static horns, just for construction cost, would be in the range of $100,000 per crossing. The options to take Gaze of the problem is #1, do nothing, #2, move forwazd with the static horns and #3, consider other options. Frank said there is a pattern as to how the engineer blows the horn. The conductor sounds the horn when he gets a visible signal and doesn't when the signal says not too. There are 55 trains a day. Frank says other options for the crossings are: permanent closure, temporary closure, quad gates, medians with existing gates, establishing 1 way streets and wayside horns. Frank has no idea what the other options would cost. Mayor Rose said she remembers from previous discussions the cost being a lot more for quad gates, etc. Alderman Salyer asked if there is anyone we could partner with. David Blackburn said Argosy is the only one at this stage. Frank said the railroad is willing to cooperate with a permanent closure at one of the crossings. Frank thinks Parkville would be interested in partnering. Frank said the City would beaz the maintenance on the horns or could share the cost with businesses. March Court Alderman Super asked about the citations for City ordinances and noticed quite Report, Approved. a few dismissals. Brent said General Ordinance Summons is issued and usually, by the time it gets to court, the matter has been resolved. Mayor Rose said and sometimes there are different charges. Alderman Darata moved to approve the March court report, seconded by Alderman Hurt, the vote was: Mins. 5/1/07 Aye: Aldermen Fuller, Super, Dazata, Hurt, Slayer and Bruns. Motion carries. Acting President of Alderman Bruns moved to approve Alderman Pam Dazata to serve as "Acting the Boazd, Approved President" (also referred to as "Mayor Pro Tem") to serve a one year term, seconded by Alderman Hurt, the vote was: Aye: Aldermen Fuller, Super, Hurt, Salyer and Bruns. Abstain: Alderman Dazata. Motion carries. Healthy Citizen Details have been worked out for the Health Citizen Initiative. Initiative Discussion A memorandum of understanding will be entered into with the Platte County YMCA and North Kansas City Community Center. The City will be paying 75% and the resident will pay 25% and this equates to an individual resident paying $7.25 at NKC Comm. Ctr. and $14.50 montlily for a family. At the YMCA, an individual resident pays $12.50 and a family pays $18.75 monthly membership fee. In addition, they will pay a reduced application fee of $50.00 to the YMCA. The City will pay the first application fee only. Access to all YMCA's is available. It is administered through the YMCA's "Group Plus" program The resident pays the 25% fee at the YMCA and the City is billed for the 75%. The City will verify residency by the resident providing a utility bill and/or a license with a Riverside address. At the time they go to the YMCA, they will be provided residency verification. The City will receive detailed usage from the YMCA. Asemi-annual audit can be provided for the City. At North Kansas City, the resident will pay the full fee and be reimbursed by the City for the 75%. Residents can pay up to only six months for a membership. Brent said the program should be up and running in a week to ten days. Gary Lynn, Executive Director of the Platte County Community Center South said the City will be billed the $50.00 application fee billed twice a month, on the 7`s and 23rd and the 75% fee for however many people sign up that month. The City will receive a list of new members and current members and joining fee members. If someone moves, the YMCA would reimburse the resident. Sabin Yanez Sabin Yanez with Cook, Flatt & Strobel provided a fee proposal for providing Cook, Flatt & Strobel construction inspection services for the Horizons Parkway South project. There Comment need for a senior construction inspector to act as the point of contact for the City on this project and also coordinate activities with the existing city inspection staff. Construction Alderman Dazata moved to approve Cook, Flatt & Strobel to provide Inspection Services on site inspection services for the Horizons Parkway South on site inspection for Horizons Pky So, project for a fee of $94,735.00, seconded by Alderman Hurt, the vote was: Approved Aye: Aldermen Hurt, Bruns, Dazata, Salyer, Super and Fuller. Motion carries. City Engineers Update Sabin Yanez said they held apre-construction meeting with Radmacher Brothers and they working on the shop drawing reviews and the trailer has been set for the Horizons project. The water low area is also being looked at. Radmacher is targeting October as completion for the road project. Mins. 5/1/07 Sabin is gathering data from MoDot to better report to the board on the Vivion Road bridge issue. The data they are gathering is work taking place, rating, traffic statistics/accident and traffic report. This information should help the board to make a decision on how to proceed. We should know in July if the City gets MARC funding for this and if the project moves up on the priority list. Mike Duffy, Shaffer, Kline & Warren gave an update to the boazd on Cliffview. Temporary construction easements have been obtained. Concrete has been poured the concrete approach just down from the `Tax Center'. The next week or so the streets should be cleaned to do surface work. The Apartment owners aze thankful to the City for the work being done. Mike said they were going to do a water study for Public Safety. David met with a representative of Mo. American Water Company's St. Louis office and they aze putting together a new model for the system and will shaze the model with the City so the water study won't have to be done. At the board's May 15's meeting, Mike will be bringing some recommendations for street overlay on all roads that need improvements and phasing this work. Brent's comment Brent said the Maintenance Agreement for the levee will be passed by Resolution at the Levee at the Levee Board meeting. As for the Line Creek Trail, Brent said he is still waiting on the railroad. Mayor's comments Mayor Rose said they are partnering with Platte County for National Trails Day on June 2°d at E.H. Young Pazk. Mayor Rose said on Sunday morning she hit a deer at High Drive and I-635 and the deer hit the front fender and came through the car windshield, broke 21egs and went running off into the woods. This is the third person in her family this year that has come in contact with a deer. Mayor Rose said there needs to be some kind of control of the deer. Maybe there needs to be a public hearing. Alderman Hurt suggested extending bow season near the levee azound January and will bring this up at the Levee Boazd meeting. John McClelland said he is involved in an extended azchery issue and the public becomes very contentious about this matter. Mike Fuller Alderman Super moved to approve Alderman Mike Fuller as the Representative Pazk Boazd Rep. for the Pazk Boazd, seconded by Alderman Bruns, the vote was: Approved Aye: Aldermen Super, Dazata, Hurt, Salyer and Bnu~s. Abstain: Alderman Fuller. Motion carries. Mark Salyer Alderman Hurt moved to approve Alderman Mark Salyer as the Planning & P&Z Representative Zoning Representative Commission Representative, seconded by Alderman Approved Fuller, the vote was: Aye: Aldermen Fuller, Super, Darata, Hurt and Bruns. Abstain: Alderman Salyer. Motion carries. Mins. 5/1/07 Resolution No. 2007-06 Alderman Bruns moved to approve Resolution No. 2007-06 expressing the intent Induce Briazcliff Dev. of the City of Riverside, Missouri to induce Briarcliff Development Company, at Co. to perform certain its sole risk, to perform certain preliminary work relating to the proposed West preliminary work....... Platte Road Redevelopment Plan and to provide certain reimbursements for the cost thereof, seconded by Alderman Darata, the vote was: Aye: Aldermen Super, Darata, Fuller, Hurt, Salyer and Bruns. Motion carries. Bill No. 2007-42 Alderman Super moved to place Bill No. 2007-42 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Bruns the vote was: Aye: Aldennen Super, Darata, Fuller, Hurt, Salyer and Bnms. Motion carries. Ordinance No. 2007-42 Alderman Darata moved to place Bill No. 2007-42 on its second reading, Approved and upon passage of same become Ordinance No. 2007-42, seconded by Alderman Bruns, the vote was: Aye: Aldermen Bruns, Super, Fuller, Darata, Hurt and Salyer. Motion carries. Brent's comment The milling and overlay projects will be presented on May 15'" and included in this will be High Drive driveways. The asphalt work will be bid with the City's other asphalt work. The City had an Engineer's estimate on the Merrimac drainage improvements and the contractor's estimate came in about 40-50% higher than the Engineer's so this work will be bid out this week. Construction should start mid June. David's comment David said the Mo. Amer. Water Co. didn't want to paint the water tower until fall because of sweating of the tank but, Mo. American was told the boazd wanted it painted before fall. A logo has not been decided upon. Alderman comments Alderman Salyer asked about following up with the developer on disposal of trees at "Hidden Acres". Brent said they are still working with the project engineer. Alderman Bruns he's been very impressed this last year with the staff, especially with Budget and Finances keeping the boazd on course. He asked if there are any tenants in the Horizon area. Brent said the City cannot make individual deals with tenants and the City needs to sell all their property and have the developer make those deals. The City is now going through the due diligence process and the City has given out 40 books to interested parties. Alderman Bruns said it would be nice to have a sprinkler park in the City. Alderman Super said the Missouri Municipal League published information that the courts have allowed trails to be on the levee's.
