HomeMy WebLinkAbout1073 Special Use Permit First Student BILL NO. 2011-021 ORDINANCE NO. ! 0`13 AN ORDINANCE GRANTING A SPECIAL USE PERMIT SUBJECT TO CERTAIN CONDITIONS TO FIRST STUDENT FOR OUTDOOR STORAGE IN THE INDUSTRIAL {I) DISTRICT ON PROPERTY LOCATED AT 6700 NW RIVERPARK DRIVE. WHEREAS, pursuant to City Code Chapter 400, Section 400.580 of the Unified Development Ordinance, Application # PC11-05, submitted by First Student, requesting a Special Use Permit to allow outdoor storage in the Industrial (I) District on land owned by Charlie Carpenter located at 67�0 NW Riverpark Drive was referred to the Planning Commission to hold a public hearing; and WHEREAS, after due public notice in the manner prescribed by law, the Planning Commission held a public hearing on May 12, 2011 and rendered a report to the Board of Aldermen containing findings of fact and a recommendation that the Special Use Permit be approved; and WHEREAS, after due public notice in the manner prescribed by law, the Board of ' Aldermen held a public hearing on May 17, 2011 and, based upon all of the information presented, find it is in the best interest of the citizens of the City of Riverside to grant said �� Special Use Permit subject to certain terms and conditions as set forth herein; � NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— GRANT OF SPECIAL USE PERMIT That a Special Use Permit is hereby granted to First Student to allow outdoor storage on property located at 6700 NW Riverpark Drive in the Industrial (I) District, subject to the conditions set forth herein. SECTION 2— CONDITIONS OF APPROVAL AND OPERATION That the following conditions of approval shall apply and be followed during the operation of the business allowed by this Special Use Permit. a. The business shall be operated on the property described above and may not moved to a different location or expanded without first obtaining approvai in accordance with the provisions for special use permits as specified in City Code. b. The business shall keep a maximum of 30 buses located on the property, all of which shall be operable and have a valid license. The number of buses stored on the site shall be limited to those buses used to provide transportation to students within the Park Hill School District. c. Every vehicle shall be parked on a surface approved by the Director of Community Development from time to time and shall be parked in a neat and orderly manner in spaces and/or areas designated on the approved site plan. d. The outdoor storage of vehicle parts, inoperable vehicles, or other miscellaneous suppiies and equipment is expressly prohibited. e. This permit does not relieve the applicant from submitting necessary site plans or applying for all necessary building permits, electrical permits, sign permits, or occupation license required by City Code. The conditions set forth in this permit shall have precedence where such conditions are more restrictive than those set forth in City Code. I f. The Special Use Permit is issued to First Student Bus Service only with the I provision that the business shall be owned and operated by First Student Bus Service, who shall be responsible for its operation. The Special Use Permit � granted herein is not transferable and any change in ownership or control of the business requires issuance of a new Special Use Permit. SECTION 3— FAILURE TO COMPLY. The Riverside Planning and Zoning Commission shall review the Special Use Permit for compliance from time to time. Failure to comply with any of the conditions or provisions contained in this ordinance shall constitute a violation of both this ordinance and the City's Unifled Development Ordinance and shall also be cause for revocation of the Special Use Permit granted herein in addition to other penalties which may be contained in the City Code. SECTION 4— SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 5— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. General Information Applicant: First Student Bus Service Location: 6700 Highway 9 Requested Action: To consider a Special Use Permit (SUP) to allow outdoor storage Zoning: 1- Industrial Existing Land Use: Mid America Power Systems & Services office and warehouse storage. Proposed Land Use: Outdoor storage for the parking of school buses. I Procedure: In accordance with Section 400.580 of the Unified Development Ordinance (UDO), a ! special use permit is required for outdoor storage. Therefore, the procedure for a special use permit is a public hearing before the Planning Commission and the Board of Aldermen after notification has been given in a paper of general circulation at least I S days before the hearing date and property owners within 185' ofthe subject property have been notified of such hearins. These requirements have been fulfilled on this application. Proiect Descriution The applicant, Pirst Student, has applied for a Special Use Permit pursuant to Chapter 400.580 of the Riverside Municipal Code to allow outdoor storage of school buses. The applicant provides transportation for schools in the Park Hill School District. Analvsis The UDO provides specific criteria for outdoor storage (Section 400.580) and the review of special use permits. Following are the relevant criteria. 1. Special U.se Permit: Outdoor storage shall only fie permitted after approval of a special use permit. 2. Screening. Outdoor storage shall be in a fenced open yard adequately screened. The outdoor storage is proposed to be located in a fenced in area north of Highway 9. The fence is chain link and at this time the applicant has not proposed any type of screening. 3. Location: Ozrtdaor storage shall be located in ei�her a side or rear yard. This property is unique because its orientation along the highway makes it dif'ficult to distinguish the different yards. Considering access is obtained from the east and a building is located near this point, staff identifies the east side as the front yard. The applicant is proposing parking buses along the west side of the property, which would be the rear yard. The buses will face Highway 9. The applicant is not proposing to use the building. 4. Appearance: Outdoor storage shall have a neat and orderly appearance. Code enforcement will regularly monitor the outdoor storage to ensure a neat and orderly appearance. Page 1 of 2 5. Setback: All setback reguirements (/'rant - 25 feet, side - I S feet, rear - 20 feet) shall be observed. The application complies with all setbacks. 6. Height: The height of materials shall not exceed the height limitation (4.5 feet) of the zoning district. The application complies with this regulation. 7. Parking Surfuces. Off-street parking and loading areas shall be hurd surfaced. The proposed area of storage is on an existing gravel parking surface. Staff feels that this is a temporary use for this facility and does not recommend requiring the applicant to pave the parking. This will increase the amount of impervious surface and impact drainage in this area. If at some time this becomes a permanent use or the property redevelops staff will work with the property owner to create an appropriate plan that will address stormwater mana�ement. 8. Consistence with the Comprehensive Masler Plan. A goal identified in the Comprehensive Master Plan is improving the appearance of the City, The site was formally used as storage far a trucking facility so the change to storage of buses is not a significant diiFerence in terms visual impact. Further, the site is located in an industrial setting and because passing traffic is traveling along Highway 9 it will be moving at a faster rate of speed. Based on these items, staff believes the proposal does not detract from the overall appearance of the commuviTy.
