A RESOLUTION AUTHORIZING, APPROVING AND RATIFYING CHANGE ORDER 2 TO
THE CONTRACT BY AND BETWEEN THE CITY OF RIVERSIDE AND COOK, FLATT 8�
STROBEL ENGINEERS, P A FOR THE DESIGN OF THE ARGOSY CASINO PARKWAY
PROJECT RESULTING IN A REVISED CONTRACT AMOUNT OF $1,837,735.00 FOR
SUCH PURPOSES AND AUTHORIZING FINAL PAYMENT UNDER SAID CONTRACT
WHEREAS, the City selected Cook, Flatt & Strobel Engineers, P A to perForm services
related to the design of the Argosy Casino Parkway project within the City of Riverside, Missouri;
and
WHEREAS, the City has previously approved the original contract amount of
$1,191,695.00 and Change Order 1 on Argosy Casino Parkway in the amount of $385,800.00; and
WHEREAS, the City incorporates all prior addendums and amendments to the said
contract with Cook, Flatt & Strobel Engineers, PA; and
WHEREAS, Change Order 2 on the Argosy Casino Parkway Project has been submitted
and resulting in the amount due to Cook, Flatt & Strobel Engineers, PA ,$260,240.00; and
WHEREAS, the Board of Aldermen find it is in the best interest of the City to authorize,
approve and ratify Change Order 2 to the contract with Cook, Flatt & Strobel Engineers, PA the
amount of $260,240.00, resulting in a total revised contract final pay amount not to exceed
$1,837,735.00.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
THAT Change Order 2 to the contract entered into by and between the City and
Cook, Flatt & Strobel Engineers, PA and incorporated herein by reference resulting in a
revised contract amount not to exceed $1,837,735.00, is hereby authorized, ratified and
approved.
FURTHER THAT all work under the contract with Cook, Flatt & Strobel Engineers, PA
is hereby accepted and approved and final payment under the contract is hereby authorized
and approved;
FURTHER THAT The City Administrator and all other required city officials are
authorized to execute the change order authorized herein together with any and all
documents necessary or incidental to the performance thereof and to take such other actions
and/or execute and deliver for and on behalf of the City all certificates, instruments,
agreements and other documents as may be deemed necessary or convenient to carry out
and comply with the intent of this Resolution.

RE: Change Order for the Design Contract on Argosy Casino Parkway.
BACKGROUND: Previously, staff presented a design contract for the Argosy Casino Parkway
project. Cook, Flatt & Strobel Engineers, PA was awarded the contract. Change
Order #I was submitted for design changes on the west phase of the project.
Change Order #2 is requested for the design changes on the north phase.
Original Contract Amount $ I, I 9 I,695.00
Change Order # I $385,800.00
Change Order #2 $260,240.00
Final Contract Amount $ I ,837,735.00
RECOMMENDATION: Scaff recommends approval of the resolution and acceptance of the Change
Order with Cook, Flatt & Strobel to finalize the Argosy Casino Parkway North
Project.
BUDGETARY IMPACT: The final contract amount is not to exceed $1,837,735.00 and will be expended
out of the Argosy Casino Parkway budget for the design under this contract.

Atlditional Tasks and Scope of Services
Dear Mr. Blackburn:
Thank you for the meeting to discuss the final items concerning the completion of
professional engineering services for the Argosy Casino Parkway project in Riverside.
As you know, this meeting was a follow up to our on-going dialogue after our letter to
the City dated February 4, 2011. When the Argosy Casino Parkway — North project
was bid for construction in November 2009, there was a continued need for on-going
engineering services that were outside of the original and modified contract. Due to
the accelerated schedule for delivery of this project, the need to quickly and
responsively deal with previously unidentifietl changes, and several other unforeseen
circumstances, CFS continued to work to ensure the success of roadway construction.
Even though some of our responsibilities changed during construction, the amount of
engineering effort needed to support the City antl Argosy was extensive, The
following is a list of twenty five tasks we performed that were additional to the original
antl motlified contract:

Initially, these tasks accounted for an additional $424,685.00 in compensation. A detailed breakdown of
these costs had been previously provided. Recognizing our duty and responsibility to the City of Riverside,
we believe it is appropriate to retluce the amount of our Change Order by 40%, from $424,685.00 to an
amount of $260,240.00. In addition, we are only requesting an additional $129,065.03 due to the fact the
City has already compensated CFS for a portion of this work. Thank you in ativance for your consideration
