HomeMy WebLinkAbout2007-08-21Minutes of Regulaz Meeting of Boazd of Aldermen of City of Riverside, Missouri August 21, 2007 A regulaz meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on August 21, 2007 at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Fuller, Dazata, Hurt, Salyer, Bruns and Super. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Gregory Mills, Brent Miles, Duector of Planning & Economic Development, Jeff Rupp, Public Works Duector and John McClelland, City Attorney. Minutes of Alderman Dazata moved to approve the minutes for July 17, 2007, seconded by July 17, 2007 seconded by Alderman Bnms, the vote was: Approved Aye: Aldermen Salyer, Dazata, Fuller, Bruns, Super and Hurt. Motion carries. Minutes of Alderman Darata moved to approve the minutes, as corrected for August 7, 2007, August 7, 2007 seconded by Alderman Hurt, the vote was: Approved Aye: Aldermen Darata, Fuller, Salyer, Bruns, Hurt and Super. Motion carries. Public Hearing Mayor Rose opened the Public Hearing at 7:33 p.m to consider a Special Use Permit Opened pursuant to Chapters 400.560 and 400.580 of the Riverside Municipal Code. Brent gave a summary of the staff report as follows: The request is for barbed wire for a proposed new fence on the north side of the existing building has been withdrawn. The second request is for outdoor storage for automobiles for "AutoBody on the Run". The applicant for the property is Block and Company and the user of the space is "Autobody on the Run". The user utilizes a parking lot for storage of automobiles awaiting repair within their facility. The first public hearing was held before the Planning Commission on August 9'" regazding this request. The major topics of discussion at the hearing focused on the visibility of storage at this location, the amount and duration of storage, and the type of business that the storage is being used for (car repair vs. salvage operation). The Planning Commission voted to deny the request and instructed staff to discuss the application with the tenant before the Public Hearing before the Board of Aldermen. Planning and Zoning thought this might be a salvage operation. After meeting with the applicant, staff has been assured that this is an autobody repair operation. Staff recommends an alternative; to recommend approval of the Special Use Permit with aone-year review period, to limit the time frame for storage of cars, and not allow loose parts to be kept in a disorderly fashion. The Levee District has Right-of--Way in the surrounding area and there is a question as to whether the proposed fence is on levee district right-way or on Block & Company's property. The site plan is being compazed with the site plan with the construction of the levee. The business is located at 4110 W. Riverside Street and Mike Cupp is the Mins. 8/21/07 owner. Mr. C4~pp said he wants to keep the place neat and have a cleaner look. The owner said he has 9 employees and he occupies the one building at 4110 W. Riverside Street. Mr. Capp said he can work on 10-12 vehicles in the building at one time and he does have a paint booth. Brent said there is quite a bit of visibility of this business from Highway 9. Becky DeNault, Block & Company said their goal is to maintain their property the way the city would want them to. Becky said she would work with the Levee Board on the location of the fence, i.e. a chain link fence with slats. Evelyn Poe, Planning Commission Member said she has gone to the lot a couple of times over the last 2 weeks and she sees, as of recent, things have been rearranged and would like to see the business stay. Brent said the conditions to operate this business if the Special Use Pemrit is approved aze as follows: (1) Vehicles appropriately pazked (2) Debris kept off the lot or vehicle (3) Spills power washed as cazs aze moved (4) No vehicle left on the lot for more than 60 days (5) Abandoned/totaled vehicles removed and taken to the salvage yazd (6) One yeaz review Brent said, "roughly" 25 vehicles can be stored on the lot. Mr. Chpp said some vehicles have stayed longer than 60 days. Public Hearing Mayor Rose closed the Public Hearing at 7:05 p.m. Closed Special Use Alderman Fuller moved to approve a Special Use Permit for "Autobody on the Run" Permit, 4104 W. Riverside Street to allow storage of vehicles with these stipulations: Approved (1) Vehicles appropriately parked (2) Debris kept offthe lot or vehicle (3) Spills power washed as cazs are moved (4) No vehicle left on the lot for more than 60 days (5) Abandoned/totaledvehkles removed (6) One year review and taken to the salvage yard, investigation of the location of the fence and if the business terminates, the fence is to be removed, seconded by Alderman Bruns, the vote was: Aye: Aldermen Salyer, Dazata, Fuller, Bruns, Super and Hurt. The Northland Neighborhood Inc. audit is still being worked on by Donna Resz, Finance. We were not selected for the MML Innovative Awazd, but we will get honorable mention at the MML Conference Awazds Dinner in September. City Admin David summarized the report to the boazd. Report Animal control calls have changed as to how they aze handled. The Captain's assignments aze now on a rotation schedule to coincide with the City's fiscal year. Mike Shelton, Deputy Emergency Mgmt. Duector has been selected by the Emergency Mgmt. Agcy. to serve on a statewide committee examining emergency management issues across the state. Wetland's consultant, Timothy Bureau has completed the documents necessary for the COE's approval for wetland delineation. The development agreement is being prepazed for the Horizons Development. A draft document for debris management is being worked on for Public Works. Mins. 8/21/07 The Mayor, City Engineer, Sabin Yanez and Staff presented the Vivion East project to the ~ ` work group with great comments. Funding decisions for the project for MARC STP funds will be made at the August 14th MARC meeting. This project is 50% complete. The Sanitary Sewer west of the Northwood Road Phase I project is being worked on and is 20% complete. Horizons S. continues being worked on and is IS% complete. Horizons N. Design is 95% complete. T.E. Woods has submitted preliminary grading plans for the Skyline location. There were 18 applications received for the NNI program The new Riverside signs are 50% complete. National Night Out will be August 7`h at 6:30 p.m in the Renner Brenner Park. Project Go! Boot Camp will take place August 7th from 4:30 p.m. to 6:00 p.m at the Community Center. MAST responded to 75 life threatening emergencies, 112 non life-threatening and 26 immediate emergencies in district 7 which includes Riverside. In Riverside, there were 66life-threatening emergencies, 101 non life-threatening emergencies and 21 immediate emergencies. The Department of Public Safety has designated Officer Brent Holland as the Public Information Officer for police and fire issues. On September 11, the Kansa City portaion of the Tour of Missouri, a professional cycling race will pass through Riverside. This is a 600-mile, six day bicycle race starting in Kansas City and ending in St. Louis. City Engineer Sabin Yanez gave an update on the Vivion Road East project saying the STP priorities Report from MARC bridge projects is recommended to be funded at $1.125 million that has been approved . A 41ane bridge is planned for Vivion Road West, walk azea for pedestrians and a trail. Brent said this was a joint effort with the City of Northmoor, but they have no funds and this is a scoring system to receive funding for this project. Quiet Zone Mike Duffy spoke to the boazd on the "Quiet Zone". A diagram was shown of all the Discussion existing raikoad crossings in the City. Brent said there are 3 options to get around the train from blowing the whistle at the crossings: (1) Close an "at grade" crossing (2) Install gates (3) Wayside Homs. The Wayside Horn is a computerized horn and instead of the train blowing its whistle, when the train gets to a certain point on the track, it triggers the horn to sound. TranSystems conducted a wayside horn demonstration on April 16, 2007 at 2 public crossings, Argosy parkway and Mattox Street. The crossings are Argosy Parkway (at grade crossing and the most heavily traveled crossing), Tullison Rd dead ends and this is not actually not a crossing and it is staff's recommendation to shut this crossing as it is not safe, Vandepopulier (at grade crossing) will be eliminated when Horizons Pazkway is in). Mattox is (at grade crossing). Intercontinental is a private crossing and maintained by Intercon, and the other private crossing is at Mike Pursell's property (tank farm). Argosy and the City have entered into a cost sharing agreement for a new bridge just west of the Argosy crossing. Businesses were contacted i.e, Argosy, Intercon and Pursell with Embassy Landscaping. Minn. 8/21/07 Sabin said the recommendations are a Wayside Hom at the Argosy Pazkway crossing ` ~, It is still being detemvned if the Tullison Road Crossing is really closed or not, but this is being investigated. This is not a safe crossing. It is a possibility to cost share with BNSF for a permanent closing. The Tullison Road crossing is not recommended for a Wayside Horn. The recommendation for Vandepopulier is to not install a Wayside Hom. The Mattox Road crossing is recommended for a Wayside Horn. At Intercon, BNSF can be informed to not blow the horn as this is a private crossing. The crossing at the Pursell property (tank farm) needs medians constructed to meet the quiet zone requirements and the hom doesn't have to be blown as this is a private crossing. The road up to the tank farm is private and the city would like to enter into a cost share agreement and Mike Pursell is agreeable to this. Three Hundred Thousand Dollars was budgeted for the Wayside Homs. The timeline to install the Wayside Horns and steps to do so is one year. Brent said he spoke with Brian Evirist at Intercon and it is decision to blow the horn or not. Mr. Evirist's concern is safety for his employees, liability and heavy trucks crossing the lines. Alderman Super asked about maintenance/upkeep. Brent said we can look at the option with Railroad Controls Limited (RCL) the manufacturer of the horns or a local contractor is trained for this or a capable Public Works staff member can be trained. The cost would be $200,000 for two horns and some median cost at the tank farm, azound $20,000 for cost participation. $100,000 at Argosy Pazkway and $100,000 at Mattox and probably less than $20,000 at the tank farm. Parkville was contacted, but they have different goals. Kansas City hasn't been contacted. Tom Burke, Manager at Argosy said there was random comments from people in the hotel, but they were not significant. Street Light Brent said there is a program in place where the City leases street lights from KCPL and Discussion is chazged a monthly fee for each light within the City. KCPL offers two different types of fmishes for their standard street light, spun aluminum and a standard steel pole. The decision needs to be made right of way for the type at Horizons Parkway. Mayor Rose polled the boazd and the choice was spun aluminum. Merrimac Mike Duffy said this project is 50% complete and by the end of next week it should be mostly Drainage done. The Storm Water Engineer will be on site. Discussion Street Maint. The program started today at Vandepopulier. The driveway improvements will be started on Discussion Thursday and should be done in a week and one half. Contact is being made with the resi- dents as the field inspector is on site at Vandepopulier. Some residents have asked to be included in the project, but it will be investigated if they were originally included in the High Drive Project previously. Northwood Rd. Sabin said the Northwood Road project is very well on track and it should be completed in eazly September. Horizons Progress is being made in the Horizons azea. Bill No. 2007-93 Alderman Hurt moved to place Bill No. 2007-93 on its first reading, said Bill authorizing Payment of the payment of certain indebtedness listed therein, seconded by Alderman Bruns the vote Indebtedness was: Aye: Aldermen Darata, Salyer, Bruns, Hurt, Fuller and Super. No. 2007-94 Alderman Bruns moved to place Bill No. 2007-94 on its second reading, and upon Approved passage of same become Ordinance No. 2007-94, seconded by Alderman Darata, the vote was: Aye: Aldermen Super, Fuller, Dazata, Hurt Salyer and Bruns. Motion carries. Aldermen Alderman Bruns said he liked the extra input from the City Administrator on his comments report. Alderman Salyer asked about the Riverside Certification Program Chief Mills said this is a volunteer program and the volunteers will be trained in specific things, such as when a flood occurs.
