Home My WebLink About1093 Final Payment Pyramid Excavation BILL NO. 2011-041 ORDINANCE NO. �v �3 AN ORDINANCE AUTHORZING, APPROVING AND RATIFYING FINAL PAYMENT FOR THE AGREEMENT BY AND BETWEEN THE CITY OF RIVERSIDE AND PYRAMID EXCAVATION FOR THE HORIZONS LIFT STATION PROJECT RESULTING IN A REVISED CONTRACT AMOUNT OF $6,093,069.22 WHEREAS, the City issued an Invitation to Bid for the Horizons Lift Station Project within the City which was awarded to Pyramid Excavation pursuant to Ordinance 2008-91; and WHEREAS, the City has previously approved changes in plans and construction on the Horizons Lift Station Project in the total amount of $130,173.27; and WHEREAS, the Board of Aldermen find it in the best interest of the City to authorize, approve and ratify Final Payment to the agreement with Pyramid Excavation in the amount of $21,047.95, resulting in a total revised contract amount not to exceed $6,093,069.22; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— APPROVAL OF FINAL PAYMENT. Final Payment to the Agreement entered into by and between the City and Pyramid Excavation and incorporated herein by reference resulting in a revised contract amount not to exceed $6,093,069.22 is hereby authorized, ratified and approved. SECTION 2— AUTHORITY TO EXECUTE. The City Administrator and all other required city officials are authorized to execute the change order authorized herein together with any and all documents necessary or incidental to the performance thereof and to take such other actions and/or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comp�y with the intent of this Ordinance. SECTION 3— SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 4— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. BACKGROUND: Pyramid Excavation was the contractor for the construction of the Lift Station. A discrepancy in quantities between the City and the contractor occurred during the project. It was necessary to seek the advice of Paul Campo and Olsson Associates. A settlement was reached and presented to the BOA. This Resolution presents the previously agreed upon amount for change orders and final payment to the contractor. Original Contract Amount $5,941,848.00 Total of Previous Changes $ I 30,173.27 Total this Change Order $21,047.95 Current Contract Total $6,093,069.22 RECOMMENDATION: Staff recommends approval of the resolution and acceptance of final payment to Pyramid Excavation to close the Horizons Lift Station project.
