HomeMy WebLinkAbout2008-082 - Welcome PlazaBILL NO. 2008-82 ORDINANCE NO. 2008-82 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO EN'CER INTO A SUPPLEMENTAL AGREEMENT WITH NEARING, STAATS, PRELOGAR & JONES, AIA, FOR CONSTRUCTION OBSERVATION SERVICES FOR THE WELCOME PLAZA PROJECT WHEREAS, the City of Riverside, Missouri ("City") engaged in negotiations with Nearing, Staats, Prelogar & Jones, AIA ("NSPJ") for the provision of design services relate;d to the Welcome Plaza Project under construction by the City (the "Project"); and WHEREAS, the City and NSPJ have previously reached an agreement concerning; the provision of and payment for design services for the Project (the "Agreement"), approved by Ordinance No. 2007-109; and WHEREAS, revisions are necessary to the Agreement due to the need for construction observation, and the concurrent change in the scope and nature of the services. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside shall enter into Supplement #2, in substantially the firm attached hereto as Exhibit A, to the Agreement whereby NSPJ shall provide construction observation services, related to the Project, to the City at a total cost not to exceed $22,500.00. Section 2. This Ordinance shall be in full force and effect from and after its passage and approval. Passed this ~ day of , 2008. Kathleen L. Riverside, Missouri 64150 Supplement 2: Agreement for Construction Observation Services Streetscape & Clock Tower Project 1 City of Riverside, Missouri Dear David: It is our pleasure to submit the following proposal for construction observation services through Nearing Staats Prelogar & Jones Architects, (NSPJ) for the City of Riverside, (Client) for the above referenced project, a proposed streetscape and clock tower along; NW Gateway Ave. and detention pond improvements at Highway 69 along the Gateway Park located in the City of Riverside, Missouri. This proposal is subject to th~~ initial contract and the attached General Provisions dated October 01, 2007 anti executed October 2, 2007. A. Scope of the Project: Task 7 -Architectural and Landscape Architectural Construction Observation Services: NSPJ will provide, as part of our services, observation of construction and coordination with the contractor to resolve issues that arise with thc~ construction of Riverside Welcome Plaza, Clock tower, and detention pond. Work Products: a. Bi-weekly on site coordination meetings with the contractor and/or appropriate sub-contractors. b. Weekly site reviews to observe construction progress. c. Shop drawing and sample review and approval. d. Work Products: a. Attend bi-weekly on site coordination meetings with the contractor and/or appropriate sub-contractors as needed for electrical an~i mechanical aspects of the project. b. Shop drawing and sample review and approval for electrical an~i mechanical aspects of the project. c. Meeting minutes and action item notes. Task 9 -Water Feature Construction Observation Services: NSPJ will provide, as part of our services, coordination with the Water Feature consultant, Larkin Aquatics, Inc. to observe construction of the water feature for the Riverside Welcome Plaza. Work Products: d. Attend bi-weekly on site coordination meetings with the contractor and/or appropriate sub-contractors as needed for water feature aspects of the project. e. Shop drawing and sample review and approval for water feature aspects of the project. f. Architectural Fees: We propose to furnish these consultant services to you on max fee basis per attached fee proposals. (b) If the nature of the scope of services changes or if the construction estimates increase, NSPJ will notify the Client of the revised scope and/or estimated fee before proceeding with further work. Fees by Task Task Fee Task 7 -NSPJ Construction Observation $17,000.00 Task 8 -Henderson Construction Observation $ 3,000.00 Task 9 -Larkin Aquatics Construction Observation 2 500.00 Total Fee Estimate for this Supplement 2 $22,500.00 (excluding Task 4 on call services F~ reimbursable exp.) Supplement 1; December 18, 2007 $ 20,000.00 Original Contract; October 1, 2007 75 000.00 Total Fee Estimate (excluding Task 4 on call services $117,500.00 ~ reimbursable exp.) C. Reimbursable Expenses: Client agrees to pay NSPJ for the following reimbursable expenses: 1. If necessary, Expenses of transportation and living of principals and employees when traveling outside our 7-county area, which is Leavenworth, Platt, Clay, Cass, Wyandotte, Johnson, and Jackson, in connection with the Project. Architect's fee while traveling out of the area in connection with the Project shall be billed at the hourly rate detailed in paragraph B1. Time consumed in travel will be properly charged as a reimbursable expense. Mileage shall be charged at the current I1ZS approved mileage rate. 2. The cost of facsimile transmissions relating to performance of the work. 3. If authorized in advance by Client, structural, mechanical and electrical engineering fees for design and construction period engineering services and special inspections, if required. 5. If authorized in advance by Client, the expense of project representative", overtime work requiring higher than regular rates, colored renderings, perspective drawings or models for Client's use. If this proposal meets with your approval, please sign both copies on spaces provided below, retain one copy for your files and return one copy to this office. The returned, signed copy will be our authority to commence work. If you have any questions, please feel free to call.
