HomeMy WebLinkAbout2008-085 - Conveyance of Real Property Owned by CityBILL N0.2008-85 ORDINANCE N0.2008-85 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF A TRACT OF REAL PROPERTY OWNED BY THE CITY OF RIVERSIDE, MISSOURI WHEREAS, the City of Riverside, Missouri (the "City") is authorized by Section 79.390, RSMo., to sell or otherwise dispose of any real property owned by the City; and WHEREAS, the staff of the City has determined that the tract of real property described as Lot 12, Indian Hills Estates, a subdivision in Riverside, Platte County, Missouri (the "Property"), is not necessary for any present or reasonably foreseeable public use, and the continued ownership and maintenance of the surplus property is an unnecessary burden to the City; and WHEREAS, the City has advertised for and received competitive bids for the Propert}~. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. This ordinance is intended and is hereby determined and declared to be necessary to accomplish and serve the public purpose of disposing of excess property and reducing ongoing expenses to the City. Section 2. The City shall dispose of the Property by sale to Aaron S. and Angela C. Ens:minger for a purchase price of Thirty Thousand Dollars ($30,000.00), provided the transferee accepts the Property in its present condition without representations or warranties of any kind, further ~sccepts the Property subject to deed restrictions preventing the construction of manufactured or modular housing, and further accepts responsibility for ongoing maintenance of the land in conformance with the Municipal Code. Section 3. The Mayor, the City Administrator, the City Attorney, and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance, and to execute and deliver for and on behalf of the City, all deeds, certificates, instruments, agreements, and other documents as may be necessary or convenient to perform all matters herein authorized.
