AN ORDINANCE APPROVING A PRELIMINARY AND FINAL DEVELOPMENT PLAN FOR
PREMIUM WATERS, INC. ON LAND LOCATED AT 4301 NW MATTOX ROAD IN
ACCORDANCE WITH THE UNIFIED DEVELOPMENT ORDINANCE OF THE CITY OF
RIVERSIDE
WHEREAS, an application was filed by Premium Waters, Inc. for approval of both a
Preliminary Development Plan and a Final Development Plan for construction of a
manufacturing facility on 14.44 acres of undeveloped property zoned PD-Planned Development
and located at 4301 N W Mattox Road; and
WHEREAS, after due public notice in the manner prescribed by law, the Planning
Commission held a public hearing to consider the application on January 26, 2012, and
rendered a report to the Board of Aldermen recommending that the Preliminary Development
Plan and Final Development Plan be approved subject to certain conditions; and
WHEREAS, after due public notice in the manner prescribed by law, the Board of
Aldermen held a publ ic hearing on February 7, 2012 to consider such a pplications and based
upon all of the information presented find it is in the best interest of the citizens of the City of
Riverside to approve the Prelim inary Development Plan and the Final Developm ent Plan for
said property upon the terms and conditions provided herein:
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1— PRELIMINARY DEVELOPMENT PLAN APPROVED. The Preliminary
Development Plan dated Decem ber 5, 201 1 for development of property located at 4301 NW
Mattox Road, legally described as Lot 1, Argo Innovation Park, a subdivision in the City of
Riverside, Platte County, Missouri, is hereby approved.
SECTION 2- FINAL DEVELOPMENT PLAN APPROVED. The Final Development
Plan dated December 5, 2011 (the "Development Plan") for development of property located at
4301 NW Mattox Road, legally described as Lot 1, Argo Innovation Park, a subdivision in the
City of Riverside, Platte County, Missouri, is hereby approved, subject to the conditions
provided herein, to allow the construction of a manufacturing facility according to such plan.
SECTION 3— CONDITIONS OF APPROVAL. The following conditions of approval shall
apply with regard to the Final Development Plan approved for development of the property:
1. The manufacturing operation shall be conducted entirely within the building identified
in the Development Plan and no expansion of the building will be allowed without
approval of an amended development plan by the Board of Aldermen.
2. No outdoor storage of materials or debris shall occur on the site other than in the
designated refuse area and storage tank area. The refuse area shall be screened
from street view with similar materials and colors as used in the main building. Six
stainless steel storage tanks shall be altowed to be located on the north side of the
building adjacent to the truck docks for the storage of raw materials required for the
manufacturing process.
3. A separate landscaping plan shall be submitted to the Community Development
Director and the P lanning Commission for approval. Proposed landscaping shall
provide additional screening of the parking areas, substantially conform to the City's
development standards and be considerate of e�hanced site aesthetics. The

Community Development Director shall provide written approval of such landscaping
plan. In the event applicant cannot reach agreement with the Community
Development Director on the landscaping plan, applicant shall subm it the plan to the
Board of Aldermen for approval prior to commencement of operations.
4. The applicant shall submit a lighting plan which shows the location and design of all
exterior lighting to the Com munity Development Director for approval. Proposed
lighting shall conform to all development standards and be considerate of public
views, light pollution and site aesthetics. The Community Development Director
shall provide written approval of such lighting plan. In the event applicant cannot
reach agreement with the Community Development Director on the exterior lighting
plan, applicant shall submit the plan to the Board of Aldermen for approval prior to
commencement of operations.
5. The approval of the Development Plan does not relieve the applicant from
compliance with all other applicable local, state and federal laws, codes, ordinances,
and regulations. The applicant is required to request and obtain approval for all
necessary permits to begin constructing the development.
SECTION 3— AUTHORITY GRANTED. The Mayor, the City Administrator, the City
Attorney and other appropriate City o�cials are hereby authorized to take any and all actions as
may be deemed necessary or convenient to carry out and comply with the intent of this
Ordinance and to execute and deliv er for and on behalf of the City all certificates, instruments,
agreements and other documents, as may be necessary or convenient to perform all matters
herein authorized.
SECTION 4— FAILURE TO COMPLY. That failure to comply with all of the provisions
contained in this ordinance shall constitute violations of both this ordinance and the City's Unified
Development Ordinance. .
SECTION 5— REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed.
SECTION 6— SEVERABILITY CLAUSE. The provisions of this ordinance are severable
and if any provision hereof is declared invalid, unconstitutional or unenforceable, such
determination shall not affect the validity of the remainder of this ordinance.
SECTION 7— EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.
