A RESOLUTION ACCEPTING EASEMENTS IN CONNECTION WITH THE SANITARY
SEWER PROJECT IN HORIZONS
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
THAT the Riverside Board of Aldermen ("Board") hereby approves, accepts and ratifies
the Sanitary Sewer Utility Easement in substantially the form attached hereto as Exhibit A, from
the Industrial Development Authority of the City of Riverside, Missouri;
FURTHER THAT the City Clerk or her designee is hereby authorized to file fully
executed copies of the easement document with the Platte County Recorder of Deeds office;
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents, as may be necessary or convenient to perform all matters herein authorized.

A 40 foot wide Sanitary Sewer Easement lying 20.00 feet on both sides of the following
described centerline and whose sidelines are lengthened or foreshortened to terminate at their
respective property lines, being all that part of the South half of Section 5 and all that pait of the
North half of Fractional Section 8, all lying in Township 50 Nortli, Range 33 West, in the City of
Riverside, Platte County, Missouri, described as follows:
COMMENCING at the Northwest corner of the Northwest Quarter of Fractional Section 8, �
Township 50 North, Range 33 West; thence South 88 degrees 52 minutes ]0 seconds East along
the North line of the Northwest Quarter of said Fractiona! Section 8 a distance of 425.70 feet to a

By the granting of this easement, it shall not be construed to prohibit the GRAN'I'OR, or GRANTOR'S
successors or assigns, from using or developing the property in any manner without interfering witl� or
abridging the rights and easement herein granted, including but not limited to the laying out, establishing
and constructing pavement, surfacing of road�vays, parking lots, curbing and gutters along, upon, over or
across said easement or any portion thereof; provided, however, said easement shall be kept free from
additional depth of overburden, buildings, and any other stnicture or obstruction (escept sidewalks,
roadways pavement, parking lot pavement, grass, shrubs, fences, or curbs), which will interfere with the
GRANTEE in entering upon said adjacent land and easement for the purpose of laying, constructing,
reconstructing, operating, repairing and maintaining such sewerage improvements and appurtenances.

RE: Horizons Sanitary Sewer Easement
BACKGROUND: This easement is for the sanitary sewer main that runs from Horizons Parkway
to the lift sution. KCMO originally was adamant that it needed an exclusive
private 60' wide easement for the main. Staff negotiated the terms to reduce the
width to 40' and provide for a joint dedication to Riverside and KCMO. Most
importantly, the easement also allows Riverside to grant the right to use of the
easement area to others as long as there is no interference with the right to lay
and maintain the sanitary sewer improvemenu. The installation of pavement
and landscaping is specifically allowed within the easement area.

RECOMMENDATION: Staff recommends approval.
