A RESOLUTION APPROVING THE ADOPTION AND IMPLEMENTATION OF AN
AFFIRMATIVE ACTION PLAN POLICY TO BE UTILIZED IN CONNECTION WITH
COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS AND SUCH OTHER PROJECTS
OR PROGRAMS WHEREIN THE CITY IS THE RECIPIENT OF FEDERAL FUNDING FOR
SUCH PROJECT
WHEREAS, as a condition of the award and expenditure of certain federal funds to
assist with the construction of public projects within the City, the City is required to take
affirmative action to promote the full realization of equal opportunity for women and minorities
with respect to the expenditure of such federal funds and adopt a formal policy with respect to
ensure compliance with an affirmative action plan; and
WHEREAS, the Board of Aldermen find it in the best interest of the citizens of the City of
Riverside to approve the implementation of an affirmative action plan and policy with respect to
the expenditure of federal funds within the City;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
THAT on any project where the city has received federal funds, including but not
limited to, the award of any Community Development Block Grant funds, the City shall
implement the following specific afFirmative action steps directed at increasing the utilization
of Section 3 business concerns as defined under current CDBG program requirements:
1. To ascertain from the city's CDBG program official the exact boundaries af the
Section 3 covered project area, and where advantageous, seek the assistance of
local officials in preparing and implementing the affirmative action plan.
2. To attempt to recruit from within the city the necessary number of lower income
residents through local advertising media, signs placed at the proposed site for the
project, and community organizations, and public or private institutions operating
within or serving the project area, such as Senrice Employment and
Redevelopment (SER), Opportunities lndustrialization Center (OIC), Urban
League, Concentrated Employment Program, Hometown Plan, or the U.S.
Employment Service.
3. To maintain a list of all lower income area residents who have applied either �n
their own or on referral from any source, and to employ such persons, if otherwise
eligible and if a vacancy exists.
4. To insert Section 3 Contract Provisions clause in all contracts and subcontracts
over $100,000 and to obtain documentation of compliance from such contractors
and subcontractors.
5. To contact unions, subcontractors, and trade associations to secure their
cooperation for this program.
6. To ensure that all appropriate project area business concerns are notified of
pending training and economic opportunities generated by the affirmative action
plan covered assistance.

7. To maintain records, including copies of correspondence, memoranda, etc., which
document that the above affirmative action steps have been taken on such
project(s).
8. To appoint or recruit an executive official of the city to serve as the Equai
Opportunity Officer to coordinate the implementation of this plan.
FURTHER THAT the City shall implement such other measures and take such
additional action as is reasonably necessary to comply with the affirmative action
requirements of any award of federal funds with respect to a project.

Non-Discrimination Policy and Grievance Procedure
BACKGROUND: The City has been the recipient of federal funds through the Community
Development Block Grant (CDBG) Fund Program. A condition of the receipt of
federal grant funding is the agreement to adopt and comply with various policies
and procedures implemented by the federal government when engaged in the
administration and expenditure of such funds. With regard to CDBG funding, an
affirmative action plan, non-discrimination policy and grievance procedure are
required. The source of these requirements is known as Exetutive Order
I I 246.
Order I 1246 was issued in 1965 by President Johnson and prohibits employment
discrimination based on race, color, r•eligion, and national origin by those
organizations receiving federal contracts and subcontracts. The Order was
amended in 1967 to include discrimination based on sex. Resolution R-2012-051
formally establishes an anti-discrimination policy within the City to comply with
the federal guidelines. R-2012-051 also establishes a grievance procedure to
address complaints, which is required under the Executive Order.
In addition, Order I I 246 requires placement goals for women and minorities
and mandates federal contractors take affirmative action to promote the full
realization of equal opportunity for women and minorities. In order to be
eligible for CDBG funding, the City is required to adopt a policy to ensure
minorities are notified of opportunities within the City under any contract
utilizing federa! funds. Resolution R-2012-047 establishes an affirmative action
program to be utilized on any project where federal funds are utilized. On
construction contracts, the requirements in R-2012-047 are mirrored in the
contract documents to ensure contractor compliance with the federal
requirements.
