HomeMy WebLinkAbout1117 Accepting Public Improvements BILL NO. 2012-024 ORDINANCE NO. �� AN ORDINANCE ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED UNDER THE CONTRACT BY AND BETWEEN THE CITY AND APAC-KANSAS FOR THE ARGOSY CASINO PARKWAY NORTH PROJECT AND AUTHORZING FINAL PAYMENT UNDER SUCH CONTRACT WHEREAS, the City issued an Invitation to Bid for the Argosy Casino Parkway North Project within the City which was awarded to APAC-Kansas, Inc. pursuant to Ordinance 2009- 161; and WHEREAS, the City has previously approved changes in plans and construction on the Argosy Casino Parkway Project resulting in a revised contract amount of $7,666,832.32 and the amount of $7,666.84 remains due and owing to APAC under such contract; and WHEREAS, the Board of Aldermen find it in the best interest of the City to authorize, approve and ratify Final Payment to the agreement with APAC in the amount of $7,666.84 and accept all work performed under such contract; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— APPROVAL OF FINAL PAYMENT. Final Payment under the Agreement entered into by and between the City and APAC-Kansas, Inc. in the amount of $7,666.84 is hereby authorized, ratified and approved and the improvements constructed thereunder are hereby accepted by the City. SECTION 2— AUTHORITY TO EXECUTE. The City Administrator and all other required city officials are authorized to execute the final pay order authorized herein together with any and all documents necessary or incidental to the perFormance thereof and to take such other actions and/or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance. SECTION 3— SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 4— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. The seeding was delayed until this year's planting season. The project is now complete. APAC was an excellent partner on this project. They were able to maintain the original timeline of the project after approximately 3 months of delays due to several snow events. Final Contract Amount $7,666,83232 Amount Paid to date $7,659,165.48 Final Payment Amount $7,666.84 RECOMMENDATION: Staff recommends approval of the ordinance and acceptance of final payment to APAC to close the construction contract for the Argosy Casino Parkway North project. BUDGETARY IMPACT: $7,666,832.32 is the total amount under the construction contract for this project.
