A RESOLUTION APPROVING AN AGREEMENT WITH CYNTHIA A. NEWMAN 8� DALE P.
NEWMAN FOR DEDICATION OF RIGHT OF WAY FOR THE MATTOX ROAD PROJECT
AND ACCEPTING AND RATIFYING A RIGHT OF WAY DEED IN CONNECTION
THEREWITH
WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest
of the public to acquire certain property further described herein in connection with construction
and maintenance of the Mattox Road Project;
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF 7HE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
THAT the Riverside Board of Aldermen hereby approves, accepts and ratifies the Right
of Way Deed in substantially the form attached hereto as Exhibit A from Cynthia A. Newman
and Dale P. Newman;
THAT compensation in the amount of Three Thousand Dollars ($3,000.00) for the
conveyances described herein is hereby authorized and approved;

FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City o�cials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents, as may be necessary or convenient to perForm a!I matters herein authorized.

whose address is 2950 N.W. Vivion Road, Riverside, Missouri 64150, GRANTEE.
WI1"NESSETH, that the GRANTOR, in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideraUon to it paid by the GRANTEE, the receipt and sufficiency
of which is hereby acknowledged, does by these presents grant, bazgain, sell, convey, and confirm
unto GRANTEE, its successors and assigns, a Right of Way for the construcUon, nnprovement,
reconstruction and maintenance of a right of way for public use as a street, roadway or
thoroughfaze, including but not Innited to, the conshuction, maintenance and use of conduits, water,
gas, sewer pipes, poles, wires, storm water drainage facilities, ducts, cables on, over, along, across,
and under the following described tract of land situated in Platte County, Missouri, to-wit:

GRANTOR further states that it is lawfully seized of title to the land through which the
Right of Way is granted and that is has good and lawfitl right to convey the Right of Way to the
GRANTEE herein.
THIS GRANT and right of way shall, at all times be deemed to be and shall be, a continuing
covenant nuuiiiig with the land and shall be binding upon the successors and assigns of the
GRANTOR.

Riverside, Platte County, Missouri, described as follows:
COMMENCING at the Southtivest corner of the Southeast Quarter of Sec6on 6, Township SO
Nortl�, Range 33 West; thence South 89 degrees 23 minutes 51 seconds East along tlie South line
of the Southeast Quazter of said Section 6 a distance of 1004.93 feet to a point on the Southerly
prolongation on the West right of way of Mattox Road; thence North 0 degrees 15 minutes 59
