A RESOLUTION ACCEPTING A PERMANENT EASEMENT FROM THE MARK S. JANSEN
REVOCABLE TRUST IN CONNECTION WITH THE ARGOSY CASINO PARKWAY STREET
IMPROVEMENT PROJECT
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
THAT the Board of Aldermen find it to be in the best interest of the City to approve and
accept the Permanent Easement, in substantially the form attached hereto, from the Mark S.
Jansen Revocable Trust, and authorizing payment therefore in the amount of Eleven Thousand
Three-Hundred Dollars {$11,320.00);
FURTHER THAT the City Clerk, or her designee, is hereby authorized and directed to
file a fully executed copy of such Permanent Easement with the Recorder of Deeds in Platte
County;
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City o�cials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution a�d to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents, as may be necessary or convenient to pertorm all matters herein authorized.

PERMANENT EASEMENT
THIS PERMANENT EASEMENT agreement, made this �� day of
, 2012, by and between Mark S. Jansen, Trustee for the
Mark . J en Revocable Trust, owner of property herein described, hereinafter known as
"Grantor", and the City of Riverside, Missouri, a municipal corporation, hereinafter known as
"Grantee".
WI1'NESSETH, that the Grantor, in consideration of the sum of Ten ($10.00) Dollars and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged,
does by these presents grant, remise, release and convey, unto said Grantee, its successors and
assigns, a permanent easement to provide right-of-way and/or bridge maintenance under, in, up
(aerial) over, and upon the following described real estate being and situated in the County of
Platte, and the State of Missouri, to-wit:
A tract of land for permanent easement purposes lying southeasterly of U.S. Interstate 635 and
south of Missouri State Highway 9 and located in the northwest '/< of the northwest '/o of section
9 and in the southwest Y< of the southwest '/4 of section 4, all in township 50 north, range 33
west, in Riverside, Platte County, Missouri, bearings are referenced to the Missouri State Plane
Coordinate System, 1983, West Zone, and more particularly described as follows:

Commencing at the northwest comer of section 9, TSON, R33W; thence 588°46'35"E, a
distance of 753.88 feet to a point on the northerly line of existing Burlington Northern
Santa Fe Right-of-Way line and being the Point of Beginning; thence S69°03'28"E, a
distance of 48.09 feet along said existing right-of-way; thence N19°56'23"E, a distance
of 237.68 feet thence S64°2T10"W, a distance of 54.41 feet; thence S19°55'28"W, a
distance of 203.66 feet thence S46°41'28"W, a distance of 22.20 feet to the Point of
Beginning, containing 9,378 square feet or 0.2153 acres, more or less.
The above described easement is graphically depicted in E�ibit A, attached hereto and
incorporated herein by this reference.
Grantor states that it is lawfully seized of title to the land through which said easement
is granted and that it has good and lawful right to convey said easement to Grantee.
This easement shall, at all times be deemed to be and shall be, a continuing
covenant running with the land and shall be binding upon the successors and assigns of the
Grantor, unless amended, in writing, by the parties hereto.
TO HAVE AND TO HOLD THE 5AME, together with all appur[enances and immuniUes
thereunto belonging or in any way appertaining, unto the City of Riverside, a fourth class city of
the State of Missouri, and to its successors and assigns forever.
