A RESOLUTION APPROVING AN AGREEMENT WITH KNAPPCO CORPORATION FOR
DEDICATION OF RIGHT OF WAY FOR THE MATTOX ROAD PROJECT AND ACCEPTING
AND RATIFYING A RIGHT OF WAY DEED AND TEMPORARY CONSTRUCTION
EASEMENT IN CONNECTION THEREWITH
WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest
of the public to acquire certain property further described herein in connection with construction
and maintenance of the Mattox Road Project;
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
THAT the Riverside Board of Aldermen hereby approves, accepts and ratifies the Right
of Way Deed and Temporary Construction Easement, in substantially the form attached hereto
as Exhibits A and B from Knappco Corporation;
THAT compensation in the amount of Ten Thousand Dollars ($10,000.00) for the
conveyances described herein is hereby authorized and approved;
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents, as may be necessary or convenient to perForm all matters herein authorized.

WITNESSETH, that the GRANTOR, in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration to it paid by the GRANTEE, the receipt and sufficiency
of which is hereby acknowledged, does by these presents grant, bargain, sell, convey, and confirm
unto GRANTEE, its successors and assigns, a Right of Way for the construction, nnprovement,
reconstruction and maintenance of a right of way for public use as a street, roadway or
thoroughfaze, including but not limited to, the construction, maintenance and use of conduits, water,
gas, sewer pipes, poles, wires, storm water drainage faciliUes, ducts, cables on, over, along, across,
and under the following described tract of land situated in Platte County, Missouri, to-wit:

GRANTOR fiu�ther states that it is lawfully seized of title to the land through which the
Right of Way is granted and that is has good and lawful right to convey the Right of Way to the
GRANTEE herein.
THIS GRANT and right of way shall, at all times be deemed to be and shall be, a continuing
covenant ruiuiing with the land and shall be binding upon the successors and assigns of the
GRANTOR.

TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made this ��ay of � , 2012, by and between:
KNAPPCO CORPORATION whose address is 4304 NW Mattox, Riverside, Missouri 64150,
GRANTOR, and the CITY OF RIVERSIDE, MISSOURI, a Missouri municipality, whose
address is 2950 N.W. Vivion Road, Riverside, Missouri 64150, GRANTEE.
WITNESSETH, that the GRANTOR, in consideraUon of the sum of Ten Dollazs ($10.00)
and other good and valuable consideration to it paid by the GRANTEE, the receipt and sufficiency
of which is hereby acknowledged, does by these presents grant and convey unto GRANTEE, its
successors and assigns, a temporary construction easement in connection with the MATTOX
ROAD CONSTRUCTION PROJECT over, upon, and across the following described tracts of land

Said temporary construction easement shall temunate rivo (2) yeazs from the date first above
written. Such easement includes the right to survey, construct, maintain, repair, store and remove
equipment and supplies, and erect and remove temporary shuctures on the land and to perform any
other work necessary and incident to the street improvements, including the right to trim, cut, fell
and remove therefrom all underbrush, obstructions, signs, and any other obstacles, within the limits
of the easement, together with the right to remove or relocate conduits, water, gas, sewer pipes,
poles, wires, surface drainage facilities, ducts, or cables; reserving, however, to GRANTOR, their
heirs and assigns, a11 such rights and privileges as may be used without interfering with or abridging
the rights and easement herein acquired.

GRANTOR further states that it is lawfully seized of title to the land through which the
easement is granted and that is has good and ►awful right to convey the easement to the GRANTEE

THIS easement shall be binding upon the successors and assigns of the GRANTOR.

the Mattox Road reconstntction and sanitary sewer extension as part of our Comn�unity Development

GRANTOR, and the CITY OF RIVERSIDE, MISSOURI, a Missouri municipality, whose
address is 2950 N.W. Vivion Road, Riverside, Missouri 64150, GRANTEE.
WITNESSETH, that the GRANTOR, in consideration of the sum of Ten Dollazs ($10.00)
and other good and valuable consideration to it paid by the GRANTEE, the receipt and sufficiency
of which is hereby acknowledged, does by these presents grant and convey unto GRANTEE, its
successors and assigns, a temporary constructioii easement in connection with the MATTOX
ROAD CONSTRUCTION PROJECT over, upon, and across the following described tracts of land
situated in Riverside, Platte Counry, Missouri, to wit:

Said temporary construction easement shall terminate two (2) years from the date first above
written. Such easement includes the right to survey, construct, rnaintain, repair, store and remove
equipment and supplies, and erect and remove temporary structures on the land and to perform any
other work necessary and incident to the street improvements, including the right to trim, cut, fell
and remove therefrom all underbrush, obstructions, signs, and any other obstacles, within the limits
of the easement, together with the right to remove or relocate conduits, water, gas, sewer pipes,
poles, wires, surface drainage facilities, ducts, or cables; reserving, however, to GRANTOR, their
heirs and assigns, all such rights and privileges as may be used without interfering with or abridging
the rights and easement herein acquired.
GItANTOR further states that it is lawfWly seized of title to the land through which the
easement is granted and that is has good and lawfu] right to convey the easement to the GRANTEE
herein.
GRANTEE shall restore tbe ground to substantially the same physical condition that
existed at the time the GRANTEE ar its agents entered upon it.
THIS easement shall be binding upon the successors and assigns of the GRANTOR
TO HAVE AND TO HOLD THE SAME, together with all appurtenances and immunities
thereunto belonging or in any way appertaining, unto the GRANTEE and to its successors and
assigns.
