RESOLUTION NO. R-2012-70
A RESOLUTION ACCEPTING, APPROVING AND RATIFYING A RIGHT OF WAY DEED
FROM THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF RIVERSIDE,
MISSOURI IN CONNECTION WITH THE MATTOX ROAD PROJECT
WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest
of the public to acquire certain easements fu�ther described herein in connection with
construction and maintenance of the Mattox Road Project;
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
THAT the Riverside Board of Aldermen hereby approves, accepts and ratifies the Right
of Way Deed attached hereto as Exhibit A from the Industrial Development Authority of the City
of Riverside, Missouri;
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
' appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and !
other documents, as may be necessary or convenient to perform all matters herein authorized.

RIGHT OF WAY DEED

THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CTl'Y OF RIVERSIDE,
MISSOURI. whose address is NW Vivion Road, Riverside, Missouri 64150, GRANTOR, and the
City of Riverside, Missouri, a Missouri municipality, whose address is 2950 N. W. Vivion Road,
Riverside, Missouri 64150, GRANTEE.
WITNESSETH, that the GRANTOR, in consideration of the sum of Ten Dollazs ($10.00) and
other good and valuable consideration to it paid by the GRANTEE, the receipt and sufficiency of
which is hereby acknowledged, does by these presents grant, bazgain, sell, convey, and confirm unto
GRANTEE, its successars and assigns, a Right of Way for the construction, nnprovement,
reconstruction and maintenance of a right of way for public use as a street, roadway or thoroughfaze,
including but not l'united to, the construction, maintenance and use of conduits, water, gas, sewer pipes,
poles, wires, storm water drainage facilities, ducts, cables on, over, along, across, and under the
following described tract of land situated in Platte County, Missouri, to-wit:
See Exhibit A, attached
GRANTOR further states that it is lawfully seized of title to the land through which the Right
of Way is granted and that is has good and lawfiil right to convey the Right of Way to the GRANTEE
herein.
THIS GRANT and right of way shall, at all times be deemed to be and shall be, a continuing
covenant mm�ing with the land and shall be binding upon the successors and assigns of the
GRANTOR.

TO HAVE AND TO HOLD THE SAME, together with all appurtenances and immunities
thereunto belonging or in any way appertaining, unto the GRANTEE and to its successors and assigns

All that part of Lot 5, ARGO Innovation Park, a subdivision lying in the Southeast Quarter of
Section 6, Township 50 North, Range 33 West, in the City of Riverside, Piatte County, Missouri,
described as follows:
COMIViENCING at the Southwest comer of the Southeast Quarter of Section 6, Township 50
North, Range 33 West; thence South 89 degrees 23 minutes 51 seconds East along tha South line
of the Southeast Quarter of said Section 6 a distance of 1039.93 feet to the Southwest comer of
