A RESOLUTION APPROVING AN AGREEMENT WITH JJJ ENTERPRISES, LLC FOR
DEDICATION OF RIGHT OF WAY FOR THE MATTOX ROAD PROJECT AND ACCEPTING
AND RATIFYING A RIGHT OF WAY DEED, UTILITY EASEMENT AND TEMPORARY
CONSTRUCTION EASEMENT IN CONNECTION THEREWITH
WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest
of the public to acquire certain property further described herein in connection with construction
and maintenance of the Mattox Road Project;
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS: '
THAT the Riverside Board of Aldermen hereby approves, accepts and ratifies the Right
ofi Way Deed, Utility Easement, and Temporary Construction Easement, in substantially the
farm attached hereto as Exhibits A, B, and C from JJJ Enterprises, LLC;
THAT compensation in the amount of Thirty Thousand Dollars ($30,000.00) for the
conveyances described herein is hereby authorized and approved;
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents, as may be necessary or convenient to perform all matters herein authorized.

UTILITY EASEMENT
THIS EASElv�1VT, made and granted into this � day of �Q-N , 2012, from
and by JJJ ENTERPRISES, LLC, having and address of PO Box 14132., Parkville Missouri 64152
("GRANTOR") or the CI1'Y OF RIVERSIDE, MISSOURI, a fourth class city and political
subdivision of the Sffite of Missouri, having and address of 2950 NW Vivion Road, Riverside, Missouri
64150, its successors and assigns, ("GRANTEE").
WITNESSETH, that the GRANrOR, in consideration of the sum of Ten Dollars ($10.00) and
otlier good and valuable considerations to it paid by t1�e GRANTEE, the receipt and sufficiency of
which herby aclrnowledges, does the present grant, bargain, sell, convey, and confnn unto said
GRANTEE, its successors and assigns, a Utility Easement over, along, across, and under the lands
hereinafter described, including the right and privilege at any time and from time to time to enter upon
said easement to survey, lay, conslruct, install, palrol, operate, maintain, inspect, alter, repair, rebuild,
replace and remove utilities (including, but not limited to: sanitary sewer, water, telecommunications,
fiber optic, elechic, gas, telephone, and cable TV: and all necessary appurtenances thereto (the
"Improvements")) over, under, through, across and upon the following described lands in Platte
County, Missouri, to wit:
See Exhibit A attached hereto and incorporated herein by reference, subject,
however, to existing easements for public roads and highways, public utilities,
railroads and pipelines.
GRAN'I'EE, its successors and assigns, sha11 have the right of ownership, use and control of all
of the Improvements tluough the above desc�ibed property and for all proper purposes connected with
the installation, construction, patrolling, inspection, reconstruction, atteration, use, inaintenance,
operation, repair, replacement and removal of the Improvements.
GRANTOR agrees not to obstruct or interfere with the installation, construction, patrolling,
inspection, reconstruction, alterations, use, maintenance, operation, repair, replacement and removal of
the Impmvements and to not erect ar cause of allow to be erected, any building or structure other than
fences on said easement.

GRANTOR further states that is lawfully seized of title of the land through which said
easement is granted and that it has good and lawfiil right to convey said easement to the GRANTEE
herein.
GRANTEE shall restore the ground insofar as practicable to is original condition, after laying
of said facilities, or any subsequent maintenance or repair operations. GRAIVT'EE further agree that
any trees, shrubbery, fences, or growing crops damages during laying or maintenance operations, will
be restored to original condition insofar as practicable
THiS GRANT and easement shall, at all times be deemed to be and shall be, a continuing
covenant running with the land and shall be binding upon the successors and assigns of the
GRANTOR.
TO HAVE AND HOLD SAME, together with all appurtenances and immunities thereunto
belonging or in any way appertaining, unto the City of Riverside, and to its successors and assigns
farever.

TEMPORARY CONSTRUCTION EASEMENT

and remove therefrom a11 underbrush, obstructions, signs, and any other obstacles, within the limits
of the easement, together with the right to remove or relocate conduits, water, gas, sewer pipes,
poles, wires, surface drainage facilities, ducts, or cables; reserving, however, to GRANTOR, their
heirs and assigns, all such rights and privileges as may be used without interfering with or abridging
the rights and easement herein acquired.
GRANTOR further states that it is lawfully seized of title to the land through which the
easernent is granted and that is has good and lawful right to convey the easement to the GRANTEE
herein.
