R-2012-078 A RESOLUTION AUTHORIZING THE GRANTING OF RIGHT OF WAY AND A UTILITY EASEMENT FOR THE NORTHWOOD ROAD PROJECT AND ACCEPTING AND RATIFYING SUCH CONVEYANCES IN CONNECTION THEREWITH WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest of the public to grant certain property owned by the City, further described herein, in connection with construction and maintenance of a roundabout for the Northwood Road Project; BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the Mayor is hereby authorized to execute and deliver the Right of Way Deed and Utility Easement in substantially the same form as attached hereto as Exhibits "A" and "B" and the City Clerk is authorized to attest thereto, and the performance of all actions related thereto are approved, authorized and directed; FURTHER THAT the Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. The recording of the easements were delayed due to the purchase of the property. This recording will designate the permanent RiW and utility easement for the property. RECOMMENDATION: Staff recommends approval. BUDGETARY IMPACT: There is no budgetary impact for this recording. GRANTEE shall restore the ground insofar as practicable to its original condition, after laying of said facilities, or any subsequent maintenance or repair operations.
