RESOLUTION NO. R-2012-080
A RESOLUTION AUTHORIZING, APPROVING AND RATIFYING FINAL PAY FOR THE
AGREEMENT BY AND BETWEEN THE CITY OF RIVERSIDE AND EMBASSY �AWN AND
LANDSCAPING, INC FOR INSTALLATION OF LANDSCAPING ON ARGOSY CASINO
PARKWAY NORTH PROJECT — RESULTING IN A FINAL CONTRACT AMOUNT OF
$134,590.00 FOR SUCH PURPOSES AND ACCEPTING THE IMPROVEMENTS
CONSTRUCTED UNDER SAID CONTRACT
WHEREAS, the City issued an Invitation to Bid for the landscaping along Argosy Casino
Parkway within the City which was awarded to Embassy Lawn and Landscaping, Inc. pursuant
to Resolution R-2011-002 in the amount of $277,560.61; and
WHEREAS, change orders under said contract were previously approved reducing the
contract amount to $134,590.00; and
WHEREAS, the Board of Aldermen find it in the best interest of the City to authorize,
approve and ratify final payment of the contract amount in the sum of $2,84627 resulting in total
payments under the final contract not to exceed $134,590.00 and accepting the improvements
constructed thereunder;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
THAT all work under the contact with Embassy Lawn and Landscaping, Inc. for the
landscaping along Argosy Casino Parkway is hereby accepted and approved and final payment
under the contract in the amount of $2,846.27 is hereby authorized and approved;
FURTHER THAT the City Administrator and all other required city officials are
authorized to execute the change order authorized herein together with any and all documents
necessary or incidental to the perFormance thereof and to take such other actions and/or
execute and deliver for and on behalf of the City all certificates, instruments, agreements and
other documents as may be deemed necessary or convenient to carry out and comply with the
intent of this Resolution.
BE IT REMEMBERED that the above was PASSED AND APPROVED by a majority of
the Board of Aldermen and APPROVED by the Mayor of the City of Riverside, Missouri, this

RE: Argosy Casino Parkway North Landscape — Final Pay
BACKGROUND: Embassy Landscape Group was the contractor for the project. Retainage has
been withheld from the contractor for several months due to incomplete work.
Change Order I was previously discussed by Olsson Associates and was a
deduction in the contract amount. Final payment will be made now that
construction is complete.
Original Contract Amount $277,560.61 '
Change Order -$ I 42,970.61
Fina) Contract Amount $134,590.00
Amount Paid to date $131,743.73
Final Pay $2,846.27
RECOMMENDATION: Staff recommends approval of the resolution and acceptance of the project
closeout.
BUDGETARY IMPACT: $134,590.00 is the total amount paid to Embassy Landscape Group for
construction perFormed under this contract
