HomeMy WebLinkAbout1133 Coop Agreement with Platte Co - TIF BILL NO. 2012-040 ORDINANCE N0.1� AN ORDINANCE APPROVING A COOPERATIVE AGREEMENT WITH PLATTE COUNTY, MISSOURI IN CONNECTION WITH THE WEST PLATTE ROAD TAX INCREMENT FINANCING DISTRICT, RATIFIYING AND CONFIRMING THE EXECUTION AND DELIVERY OF SAME, AND AUTHORIZING CERTAIN ACTIONS IN CONNECTION THEREWITH WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act (the "Act"), Sections 99.800 through 99.865, RSMo, as amended, the City created the West Platte Road Tax Increment Financing District (the "West Platte Road TIF") and approved the West Platte Road Tax Increment Financing Redevelopment Plan (the "West Platte Road Redevelopment Plan") within the City to eliminate blight within the redevelopment area; and WHEREAS, the City has designated tax increment financing revenues from the redevelopment project area to pay or reimburse certain Reimbursable Project Costs as defined in the West Platte Road Redevelopment Plan and the Redevelopment Agreement entered into with Briarcliff Development Company; and WHEREAS, the Act provides that the county in which the West Platte Road TIF is located is to collect such tax increment financing revenues; and WHEREAS, it is desirable and in the best interest of the City to enter into a Cooperative Agreement with Platte County, Missouri pursuant to the Act and Sections 70.210 to Section 70.230, RSMo., as amended, to provide for such collection; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— AGREEMENT APPROVED. That the Cooperative Agreement attached hereto as Exhibit A(which is incorporated herein by reference) is hereby approved. Further, ' the execution of such Agreement by the Mayor and/or City Administrator and the delivery of same to Platte County, Missouri is hereby ratified and confirmed. SECTION 2— AUTHORITY GRANTED. That all actions heretofore taken by the officers, representatives and agents of the City in connection with the transaction contemplated by this Ordinance are hereby ratified and confirmed, and the City shal�, and the officers, representatives and agents of the City are hereby authorized and directed to, take such further action, and execute and deliver such other documents and instruments as may be necessary or desirable to carry out and comply with the intent of this Ordinance, and to carry out, comply with and perform the duties of the City with respect to the Cooperative Agreement. SECTION 3- EFFECTIVE DATE. That this Ordinance shall be in full force and effect from and after its passage and approval. Appr to form: 0 � • Robin Li#trell, Cit Clerk a c hom son, City Attorney Cooperative Agreement THIS AGREEMENT is made and entered into the date and year last below written, by and between Platte County, Missouri, hereinafter refened to as "County", and the City of Riverside, Missouri, hereinafter referred to as "City". WHEREAS, the City pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 RSMo, as amended, approved the West Platte Road Redeveloament Plan and adopted tax increment financing in connection therewith pursuant to ordinances 2007-69 and 2007-70, approved on July 3, 2007 and May 20, 2008, respectively, and WHEREAS, the City subsequently selected a developer and approved a redevelopment agreement with such developer relating to implementation of the Redevelopment Plan pursuant to , ordinance 2007-90, which redevelopment agreement was amended pursuant to ordinances 2009-87 and ' 2009-188; NOW THEREFORE, IT IS AGREED BY THE PARTIES AS FOLLOWS: 1. Purnose of Aereement. This Cooperative Agreement is entered into between the parties pursuant to ' the provisions of Sections 70.210 through 70.230 RSMo, as amended, for the purpose of fostering cooperation in tha calculation, collection and disbursement of Payments In Lieu Of Taxes (PILOTS) , collected by the Platte County Collector with regard to the Tax Increment Financing (TIF) Plan set forth above previously approved by the City of Riverside Tax Increment Financing (TIF) Commission and Riverside Board of Aldermen. 2. Services to be Provided A. County authorizes the Platte County Assessor to provide the Platte County Collector with information as to the total Initial Equalized Assessed Value of phases of the redevelopment projects located within the boundaries of the Riverside TIF plan and the Current Equalized Assessed Value of phases of the redevelopment projects with regard to the Tax Increment Financing (TIF) Plan previously approved by the City of Riverside Tax Increment Financing (TIF) Commission. B. County authorizes the Platte County Collector to collect PILOTS from property located within the boundaries of the Riverside TIF plan and to remit the proceeds thereof to City within fifteen (15) working days after the last day of each month. 3. Pavment tor Services. Before remitting the PILOTS to City, Collector shall withhold the one perc�nt statutory commission together with the one-half percent statutory assessor commission for a total of one and one-half percent of the total PILOTS collected for City. Said commission sha(1 be withheld at the time of disbursement and delivered by the Platte County Collector to the Platte County Treasurer. 4. Term. This Cooperative Agreement far the collection of PILOTS shall commence with the 2009 calendar year and is effective retroactive to such date upon execution of this Agreement by the officials designated by County and City. 5. Renewal, Extension, Modification or Termination. This agreement shall renew automatically from year to yeaz and may be modified or terminated upon thirty (30) days notice prior to the end of any taxable year as to the following tax year. If this Agreement shall be modified as to any of its terms, there shall be an addendum to this Cooperative Agreement executed by the appropriate officials of County and City.
