AN ORDINANCE APPROVING THE FINAL PLAT OF GATEWOODS 3"' PLAT, A
SUBDIVISION OF THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURL
WHEREAS, Application No. PC12-08FP, submitted by ZG Realty, LLC requesting approval
of the final p at for Gatewoods 3rd Plat, a subdivision in the City of Riverside, Platte County, Missouri,
was referred to the Planning Commission; and
WHEREAS, the Planning Commission considered the application on June 28, 2012 and
rendered a report to the Board of Aldermen recommending that the final plat be approved; and
WHEREAS, the Board of Aldermen find that it is in the best interests of the City of Riverside,
Missouri to approve the final plat of Gatewoods 3rd Plat as set forth herein;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1— APPROVAL OF FINAL PLAT. That the Final Plat of Gatewoods 3` Plat, a
subdivision of the City of Riverside, Platte County, Missouri, a true and correct copy of which is
attached hereto and incorporated herein, is hereby approved platting the property legally
described in Exhibit "A" attached hereto, subject to the additional conditions and modifications
required to be incorporated on such plat contained herein.
SECTION 2— APPROVAL OF DEDICATION. That the City of Riverside approves
dedication of the streets, municipal uses, easement, access, and utilities shown on the plat, not
heretofore dedicated to the public on property owned by the City as shown on the plat.
SECTION 3- ACCEPTANCE OF DEDICATION. That the City of Riverside hereby further
accepts the dedication of all streets, municipal uses, easements, access, and utilities shown an the
plat, not heretofore dedicated to the public for the purpose as therein set out.
SECTION 4— ADDITIONAL CONDITION — UNDISTURBED BUFFER AREA
DESIGNATED. In order to preserve the natural beauty of the property, guard against excessive
erosion and ensure the integrity of the natural slope, an area twenty (20) feet wide shall be reserved
as an undisturbed buffer along the rear lot line of lots 57 through 65. No land disturbance or tree
cutting of live trees is permitted within the undisturbed buffer area without the permission of the
Director of Community Development or designee. Minor landscaping may occur within the
undisturbed buffer area provided the minor landscaping shall be limited to less than twenty percent
(20%) of the land area attributable to each individual lot.
SECTION 5— ADDITIONAL CONDITION — HOMEOWNER ASSOCIATION CREATION
AND COMMON AREA DESIGNATED. The applicant shall create a home owners association to
ensure maintenance of the common areas designated on the plat as Tracts A and B. The
conditions, covenants and restrictions covering the rights and responsibilities of the homeowners
association shall be approved by the Director of Community Development, or designee, and filed
contemporaneously with the plat in the land records of Platte County, Missouri.
SECTION 6— REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed.

SECTION 7– SEVEFtABILITY CLAUSE. The provisions of this ordinance are severable
and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination
shalf not affect the validity of the remainder of this ordinance.
SECTION 8– EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.
BE IT REMEMBERED that the above was read two times by heading only, PASSED AND
APPROVED by a majority of the Board of Aldermen and APPROVED by the Mayor of the City of
Riverside, Missouri, this 2nd day of July, 2012.

Gatewoods 3rd Plat
General Information
Applicant: ZG Realty, LLC.
Location: NW Area of land generally described to be notth of NW 50 ' Street, east of Highway 635, and
west of Gatewoods 1 Plat.
Application: Final Plat (Major Subdivision)
Current Zoning: PD: Planned Development
Existing Land Use: Undeveloped
Proposed Land Use: Sing(e Family Residential
Number of Proposed Lots: 21 lots and 2 common area tracts
Procedure: This application is a major subdivision within the UDO. The final plat will be reviewed by
the Planning Commission and final action will be taken by the Board of Aldermen.
Analvsis
Overview: ZG Realty, LL,C is the current owner of Gatewoods 3' . The preliminary development plan
and preliminary plat for this site were approve in August of 2006 by the Planning Commission and the
Board of Aldermen. Prior to completion of the streets, the developer, T.E. Woods, ran into financial
difficulty. Ultimately the property was foreclosed on by Kearney Commercial Bank which is the
controlling interest of ZG Realty, LLC.
Site Layout & Improvements: All utilities to serve the Gatewoods 3` Plat have now been constructed.
The developer is in the process of completing construction plans for the next phase of the deve(opment.
Conformance to City and State Regulations: The plat and proposed use are in conformance with the
Comprehensive Master Plan as the plan identifies the area as appropriate for single family residential
use. Staff has provided the applicant with the necessary text changes to the acceptance and signature
blocks.
Recommendation
Staff finds the application in conformance with the Comprehensive Master Plan, UDO and adopted
policies and procedures, and therefore, recommends approval of the Final Plat.

REGUiAR MEETING
PLANNI{VG AND ZONING COMMISSION
RIVERSIDE, MISSOURI
Thursday, June 28, 2012
7:00 p.m.
The Planning and Zoning Commission for thc City of Riverside, Missouri, met in regular session in the
Board of Aldermen Chambers at City HaII, 2950 NW Vivion Road, Riverside, Missouri.
Chair A1 Bowman called the meeting to ordar at 7:00 p,m. Answering roll call were Ray Uhl, Harold
Snoderley, Mike L,ombardo, Steve Kaspar, Jim Frakes. Mike Solar and Stephen King and Art Homer.
Membars absent; Cheryl Melton and Mayoc Kathy Rose. Also present: Mike Duffy Director of
Community Development, Sarah Wagner Conunanity Development,.and Keitt Payne, Assistant Fire
Marshall.
Approval of Minutes of Commissioner Snoderley moved to approve the minutes of April 26,
April 26, 2012 2012.
Commissioner King seconded and the motion was approved
unanimously.
Final Plat-Gatewoods 3rd Mike Duffy, Directar of Community Development gave an overvie v of
the final plat for Gatewoods 3rd. He explaind that ZG Realty, LLC is
the curzent owner of Gatewoods 3rd. The preliminary development plan
and preliminary plat for this site were approve in August of 2006 by the
Planning Cornmission and the Board of Aldermen. Prior to completion
of the streets, the developer, T.E. Woods, ran into financial difficulty.
Ultimately, the property was foreclosed on by Kearney Commerciai
Bank which is the controlling interest of ZG Reaity, LLC. All utilities to
serve the Gatewoods 3rd Plat have now been constructed. The developer
is in the process of completing construction plans for the next phase of
the development. The plat and proposed use are in conformance with
the Comprehensive Master Plan as the plan identifies the area as
appropriate for single family residential use. The east side of the
property has a 20 foot buffer zone for the creek of non-disturbance
staff is requiring that the developer note that on the plat prior to
recording.
Commissioner Snoderley asked if there was a similar agreement with a
buffer zone on the west side of the property near Interstate 635.
Duffy replied that there is a utility easement on that side and a majority
of the lots will ba cut-de-sac that will have large lots.
Commissioner Solar asked what the slope on the buffer zone to the
creek was and weather if would require stabilization

Duffy replied that is was a 2:1 ratio and that because of the buffer zone '
stabilization would most likely not be reguired.
Commissioner Solxr asked if this buffer zoned allowed for sufficient lot
sizes.
Jim Reynolds with ZG Realty replied that some of the lots may require
retaining walls in that area, but that will be on a case by case basis.
Commissioner Kaspar asked if the homes would be sunilar to those in
phase 1 and 2.
Reynolds replied that they want to keep a similar format and price
range.
Commissioner Solar asked about a home owners association.
Reynolds replied that there will be one but he was not certain when it
would take effect.
Commissioner Solar asked what the schedule of beginning
constructions would be.
Reynolds said they would like to start as soon a possible.
Commissioner Kaspar asked about the remaining lots in Gatewoods 1
and 2.
Reynolds said they are also working on marketing those.
Commissioner Caspar asked about Tract B.
Duffy replied that that was part of the drainage.
Commissioner Kaspar moved to recommend approval of the final plat
for Gatewoods 3rd to the Board of Alderman with the condition that the
plat reflect the 20 foot buffer zone on the east side of the property.
Commissioner Uhl seconded and the motion passed 9-0.
General Discussion- Duffy gave a short power point presentation to the Commission
Gateway Redevelopment referenoing NW Gateway. Duffy asked the Commission to think about

redevelopment of Gateway and how it pertains to fhe Master Plan and
where the Commission would like to see it go and what the staps should
be.
Adjoum Commissioner Kaspar moved to adjourn.
Commissioner Snoderley seconded. The motion passed and the
meeting was adjourned at 7:56 p.m.
