I! � 0 AN ORDINANCE APPROVING THE FINAL PLAT OF MINOR PLAT OF DREAM ACRES PLAT, A SUBDIVISION OF THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURI. WHEREAS, Application No. PC12-09 FP, submitted by Jeanette Webb requesting approval of the final plat for Dream Acres, a minor subdivision in the City of Riverside, Platte County, Missouri, was referred to the Planning Commission; and WHEREAS, the Planning Commission considered the application on July 12, 2012 and rendered a report to the Board of Aldermen recommending that the final plat be approved; and WHEREAS, that it is in the best interests of the City of Riverside, Missouri to approve the final plat of Dream Acres as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1— APPROVAL OF FINAL PLAT. That the Final Plat of Minor Plat of Dream Acres, a subdivision of the City of Riverside, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein, is hereby approved, platting the property legally described in Exhibit "A" attached hereto. SECTION 2— APPROVAL OF DEDICATION. That the City of Riverside approves dedication of the streets, municipal uses, easement, access, and utilities shown on the plat, not heretofore dedicated to the public on property owned by the City as shown on the plat. SECTION 3- ACCEPTANCE OF DEDICATION. That the City of Riverside hereby further accepts the dedication of on the plat of all streets, municipal uses, easement, access, and utilities shown on the plat, not heretofore dedicated to the public is hereby accepted for the purpose as therein set out. SECTION 4— ACCEPTANCE OF EASEMENT DEDICATION. That the dedication to the City Riverside of an easement or license to locate, construct and maintain or to authorize the location, construction and maintenance and use of conduits for all or any purpose, water, gas, sewer mains, poles and wires or all or any of them, over under and along the strips of land marked "UTILITY EASEMENT" or "U/E" is hereby accepted for the purpose as therein set out. SECTION 4— REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 5— SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6— EFFECTIVE DATE. Application: Final Plat (Major Subdivision) Current Zoning: R-1 Single Family Residetrtial Existing Land Use: Residential Proposed Land Use: Single Family Residential Number of Praposed Lots: 2 Lots Procedure: This application is a minor subdivision within the UDO. A minor subdivision plat is required when alI lots have frontage on an existing sueet and utilities exist to serve the development. The process for a minor subdivision only requires the submission of a final plat. The final plat will be reviewed by the Planning Commission and final action will be taken by the Board of Aldermen. Analysis Overview: Jeanette Webb is the current owner of the property. She is requesting a final plat of Dream Acres as a replat of Tract E and Tract F to create two buildable lots. Site Layout: The land included in the plat is largely undeveloped with only a house on proposed Lot 2 and a barn in proposed Lot l. The proposed plat will require right-of-way easements along the south and east property lines of proposed Lot 1 and the north and east property lines of proposed Lot 2. Easements: General utility easements adjacent to right-of-way and along interior lot lines allow for future u[iliTy extensions if necessary. This allows for utility extensions without having to take the time to acquire right-of-way in the future at city cost. Access: Access to Lot 2 is along a private drive located on part of Tract 2, Amended Plat of Northwood Acres. Although this is offthe plat, there should be a note showing that access is granted and identifying the book and page where it is recorded. Conformance to City and State Regulations: The plat and proposed use aze in conformance with the Comprehensive Master Plan as the plan identifies the area as appropriate for single family residential use. Staff has provided the applicant with the necessary text changes to the acceptance and signature blocks and access easement. Recommendation Page 1 of 2 Staff finds the application in conformance with the Comprehensive Master Plan, UDO and adopted policies and procedures, and therefore, recommends approval of the Final Plat with the condition that the applicant add the required easements along High Drive and between Lots 1 and 2. Cheir AI Bowman called the meeting to order at 7:00 p.m. Answering roll call were Ray Uhl, Harold Snoderley, Mike Lombardo, Jim Frakes. Mike Soler, Art Homer and Mayor Kathy Rose. Members absent: Cheryl Melton, Steve Kaspar, and Stephan King, Also present: Wagner Communiry Developmenk Approval of Minutes of Commissioner Uhl moved [o approve the minutes of June 28, 2012. June 28, 2012 i Commissioner Soler seconded and the motian was approved � unanunously. Final Plat-Dream Acres Sarah Wagner, Community Development gave an overview of the fmal I plat for Dream Acres. She explained that the applicant, Jeanette Webb i is requesting a fmal plat for a minor subdivision. She would like to plat ' Tract E and F that she owns and move the lot line of Tract E approximately ] 02 feet to the soutli increasing the lot size of the property to the north wl�ile still maintaining two buildable lots that meet city stnndards. The change in lot lines will be recorded as the final plat of Lats 1 and 2 of Dream Acres. The proposed plat does meet the requirements of the UDO and staff recommends approval with the conditions that a utility easement is added around the property lines and tl�at the book and page of the shared drive access agreement for Lot 2 is noted on ffie fmal plat, There was general discussion from the Commission about the driveway access agreement and future plans for the property. Commissioner Snoderley moved to recommend approval of the fmal plat for Dream Acres to the Board of Alderman with the condition that the plat reflect the utility easement and access agreemenU. Commissioner Homer seconded and the motion passed 8-0. Adjourn Commissioner Snoderley moved to edjoum Coromissioner Uhl seconded.
