AN ORDINANCE APPROVING THE FINAL PLAT OF RIVERSIDE HORIZONS INDUSTRIAL III
EAST, A REPLAT OF LOTS 11 AND 12 OF RIVERSIDE HORIZONS EAST FIRST PLAT AND
LOT 2 OF THE REPLAT OF LOT 73 RIVERSIDE HORIZONS EAST FIRST PLAT, IN THE CITY
OF RIVERSIDE, PLATTE COUNTY, MISSOURI
WHEREAS, Application No. PC12-11, submitted by the Industrial Development Authority of
the City of Riverside, Missouri requesting approval of the Final Plat of RIVERSIDE HORIZONS
INDUSTRIAL III EAST, a subdivision in the City of Riverside, Platte County, Missouri, was referred
to the Planning Commission; and
WHEREAS, the Planning Commission considered the application on September 24, 2012 and
rendered a report to the Board of Aldermen recommending that the final plat be approved; and
WHEREAS, that it is in the best interests of the City of Riverside, Missouri to approve the
Final Plat of RIVERSIDE HORIZONS INDUSTRIAL III EAST as set forth herein;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1— APPROVAL OF FINAL PLAT. That the Final Plat of RIVERSIDE
HORIZONS INDUSTRIAL III EAST, a subdivision of the City of Riverside, Platte County,
Missouri, a true and correct copy of which is attached hereto and incorporated herein, is hereby
approved, platting the property legally described in Exhibit "A".
SECTION 2- ACCEPTANCE OF DEDICATION. That the City of Riverside hereby further
accepts the, dedication of all streets, municipal uses, easement, access, and utilities shown on the
plat, not heretofore dedicated to the public for the purpose(s) as therein set out.
SECTION 3— REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed.
SECTION 4— SEVERABILITY CLAUSE. The provisions of this ordinance are severable
and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination
shall not affect the validity of the remainder of this ordinance.
SECTION 5— EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.

All of lots 11 and 12 Riverside Horizons East First Plat, a subdivision in the City of Riverside,
Platte County, Missouri, according to the recorded plat thereof, AND all of Lot 2 of the Replat of
Lot 13 Riverside Horizons East First Plat, a subdivision in the City of Riverside, Platte County,
Missouri, according to the recorded plat thereof, more particularly described as follows:
Beginning at the NoRhwest comer of said Lot 2, said point being on the Southerly righ[-of-way line of 41 st Street as it now
exists; thence coiacident with said rightof-way line along the following comses: South 89°35'34" East, 174.20 feet; thence
Southeasterly, on a tangent curve to the right, 117.87 feey said curve having a radius of 314.00 fcet; thence South 68°OS'OS"
East, 974.62 feet to the Northeast comer of said Lot 11; theuce departing said right-of-way line, South 21 ° 54'S5" West,

All or a part of Lot 2, REPLAT OF LOT 13, RIVERSIDE HORIZONS EAST
FIRST PLAT, and Lofs 11 and 12, RIVERSIDE HORIZONS EAST FIRST
PLAT, subdivisions in the City of Riverside, Platte County, Missouri, according to
the recorded plats thereof, to be replatted as LOT 1, RIVERSIDE HORIZONS
INDUSTRIAL III EAST
Ladies and GenUemen:
The City of Riverside, Missouri (the "City") and Briarcliff Realty, LLC (now known as BR
NorthPoint, LLC) entered into that certain Master Development Agreement (the "MDA") on
May 10, 2011. Thereafter, with the City's consent, BR NorthPoint, LL.0 assigned its righu and
obligations under the MDA to Briucliff Horizons, LLC, which changed its name with the
Missouri Secretary of State on February 24, 2012 to Riverside Horizons, LLC (the "Developer"),
an affiliated entity of BR NorthPoint, LL.C.
The MDA provides the Developer with certain vested rights to purchase, from time to dme, all or
a portion of the property within the area of land delineated by the MDA known as the `Briazcliff
Horizons Site." The Developer now desires to purchase, pursuant to the terms and conditions
contained in the MDA, all or a part of Lot 2, REPLAT OF LOT 13, RNERSIDE HORIZONS
EAST FIRST PLAT, and Lots 11 and 12, RIVERSIDE HORIZONS EAST FIRST PLAT,
subdivisions in the City of Rivetside, Platte County, Missouri, according to the recorded plats
thereof, to be replatted as LOT 1, RIVERSIDE HORIZONS INDUSTRIAL III EAST as
depicted and described on the enclosed proposed Final Plat prepared by Renaissance
Infrnstructure Consuldng ("RIC"). The Purchase Price for the Property shall be $212,263.00,
which is based upon the NIDA's purchase price of $0.50 per square foot and the Property's
measured square footage of 424,526 squaze feet as set forth in the proposed Finat Plat.

Therefore, pursuant to SecGon 7.5(a) of the MDA, the Developer hereby provides the City with
the required thirty (30) day prior written notice of the Developer's intent to purchase the pmperty
described and depicted on Exhibit A hereto on October 19, ?Al2. The developing party will be
Horizons Industrial III, LLC, a Delaware limited liability company, and joint venture between
BR NorthPoint, LLC and The Northwestem Mutual Life Insurance Company.
