R-2072-748 A RESOLUTION AUTHORZ�NG, APPROVING AND RATIFYING CHANGE ORDER 5 TO THE AGREEMENT BY AND BETWEEN THE CITY OF RIVERSIDE AND MAX RIEKE BROTHERS, INC. FOR NORTHWOOD ROAD PROJECT — PHASE 2 RESULTING IN A REVISED CONTRACT AMOUNT OF $3,443,906.38. WHEREAS, the City issued an Invitation to Bid for the Northwood Road Project within the City which was awarded to Max Rieke Brothers, Inc. pursuant to Resolution R-2010-081, Change Order 1 to said contract was approved by Resolution 2011-073, and Change Orders 2 and 3 to said contract were approved by Resolution 2011-084; and Change Order 4 to said contract was approved by Resolution 2012-139; and WHEREAS, the Board of Aldermen find it in the best interest of the City to authorize, approve and ratify Change OrderS to the agreement in the amount of $68,457.90, resulting in a total revised contract amount not to exceed $3,443,906.38; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: THAT Change Order 5 to the Agreement entered into by and between the City and Max Rieke Brothers, Inc. and incorporated herein by reference resulting in a revised contract amount not to exceed $3,443,906.38 is hereby authorized, ratified and approved. FURTHER THAT the Mayor, City Administrator and all other required city officials are authorized to execute the change order authorized herein together with any and all documents necessary or incidental to the performance thereof and to take such other actions and/or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution. Riverside's leased lighting system with KCPL ends at the south end of the Roundabout. Original Contract Amount $3,194,940.16 Total of Previous Changes $180,508.32 Total this Change Order $68,457.90 Current Contract Total $3,443,906.38 RECOMMENDATION: Staff recommends approval of the resolution and acceptance of the change order with Max Rieke & Bros. to continue with construction of the Northwood Road phase 2 project. BUDGETARY IMPACT: Approximately $68,457.90 will be expended out of the Northwood Road phase 2 budget in addition to the previously approved contract amount, for the construction under this contract.
