Ordinance No. 2008-92
AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER INTO A
SERVICES AGREEMENT WITH AND PAY CERTAIN FUNDS TO RIVERSIDE
RIVERFEST AND DEVELOPMENT CORPORATION
WHEREAS, Riverside Riverfest and Development Corporation ("Service Provider'") is a
not-for-profit corporation providing services, including the provision of the Riverfest :social
event and activities ("Services"), for the residents of the City of Riverside (the "City").
WHEREAS, Service Provider desires to continue to provide such Services and reciuires
funding to continue to provide the Services within the City.
WHEREAS, the City finds that the provision of the Services is a public purpose and
promotes tourism and the City has the capability and desire to assist Service Provider in
continuing to provide Services to the public with the City.
WHEREAS, the City and the Service Provider have negotiated and agreed upon an
agreement for the Service and payment for the same.
NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of the City of
Riverside, Missouri, as follows:
Section 1. The City finds that the provision of the Services contributes to the we;lfaze
of the City and promotes tourism and that the Services are important to the welfare of the City
and that the provision of funds to assist in providing such Services aze for a public purpose.
Section 2. T`he City of Riverside shall pay to the Service Provider the sum of Thirty
Five Thousand and 00/100 Dollazs ($35,000.00) which funds shall be provided from the C:ity's
Tourism Tax Fund, to assist it in continuing to provide services to the residents of the Cite and
the City, pursuant to a Services Agreement, in substantially the form attached as Exhibit A,
which is hereby approved.
Section 3. The City Administrator is authorized and directed to execute the Services
Agreement, execution of such document being conclusive proof of such approval. T`he City
Administrator is authorized and directed to perform all acts and execute any other documents
necessary or desirable to effectuate the intent of this Ordinance.
Section 4. This Ordinance shall take effect immediately.

THIS SERVICES AGREEMENT entered into on this /~'i~day of 2008, by and
between the CITY OF RIVERSIDE, MISSOURI ("City"), and RIVE IDE ERFEST AND
DEVELOPMENT CORPORATION ("Service Provider").
WHEREAS, Service Provider is a Missouri non-profit corporation that conducts an annual connnunity
event known as Riverside Riverfest, including adult and children's games, other entertainment activities, <uid free
public concerts ("Services") to residents of the City pf Riverside and the public in general.
WHEREAS, Service Provider desires to provide such Services and requires funding to continue to provide
the Services within the City.
WHEREAS, the City desires that Service Provider provide such Services to the City, has found that the
provision of the Services contributes to the welfare of the City as well as the economic and social potential of
the City and its residents, that the Services are important to the welfare of the City, that the Services Iiromote
tourism, and that the provision of funds to assist in providing such services are for a public purpose.
IN CONSIDERATION of the mutual covenants and agreements set forth herein, the parties agree to the
following:
1. That Service Provider shall provide the Services for the City pursuant to the terms of this
Services Agreement, at a time and place to be mutually agreed upon by the City and Service Provider.
2. That the City shall pay to Service Provider the sum of $35,000.00 from the Tourism T~ix Fund
established pursuant to Section 94.875 RSMo.
3. That the Service Provider shall provide the City with the budget for Services prior to the
Riverside Riverfest event, and a final expenditure report within three months after the conclusion of the event.

BACKGROUND:
As presented to you at the July 15, 2008 meeting, the Tourism Commission recommended that
the Riverside Riverfest Development Corporation be funded in the amount of $35,000 from the
Tourism Fund. A motion in this same Board of Aldermen meeting approved the Tourism Board’s
funding requests, including the one for Riverfest
FINANCE OFFICE AND BUDGET BACKGROUND:
$35,000 will be expended from the Tourism Fund’s Long-Term Project Budget.
REVIEWED BY AND RECOMMENDATION:
This ordinance was reviewed by the Communications Department, City Administrator and City
Attorney and it is recommended that the ordinance be approved.
