HomeMy WebLinkAbout1184 Amending Land Use Code SignsBILL NO. 2013 -007 ORDINANCE NO. 118y AN ORDINANCE AMENDING TITLE IV "LAND USE" OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, SPECIFICALLY ARTICLE VIII "SIGNS ", SECTION 400.710 "SIGNS PERMITTED IN NON - RESIDENTIAL DISTRICTS" (CPO, C -1, 1) WHEREAS, an application has been presented by City staff to amend Title IV: Land Use, Article VIII: Signs, Section 400.710: Signs Permitted in Non - Residential Districts ( "CPO ", "C -1 ", "I ") Subsection 400.710(A) to provide for the allowance of up to two monument signs on any individual business located on a corner lot with at least 250 feet of frontage along each of two arterial streets; and WHEREAS, the Riverside Planning & Zoning Commission, at a public hearing held on January 24, 2013 considered and discussed amendments to the City Code Sections; and WHEREAS, after such consideration and discussion, the Planning & Zoning Commission recommended that the City's Board of Aldermen adopt the proposed amendment; and WHEREAS, during a public hearing held at its meeting on February 5, 2013 the Board of Aldermen considered and discussed the proposed amendment and the recommendation of the Planning & Zoning Commission; and WHEREAS, the Board of Aldermen has determined it to be in the City's best interests to accept the Planning & Zoning Commission's recommendation and adopt the proposed amendment; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendment to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; NOW, THERFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 — AMENDMENT OF SECTION 400.710(A). Subsection 400.710(A) shall be deleted in its entirety and replaced with the following: SECTION 400.710: SIGNS PERMITTED IN NON - RESIDENTIAL DISTRICTS ( "CPO ", A. Individual Businesses. Each individual business shall be allowed a total of three (3) signs with a maximum of one (1) monument sign; provided however, an individual business located on a corner lot with at least two hundred fifty (250) feet of frontage along each of two (2) primary arterial streets shall be allowed a total of four (4) signs with a maximum of two (2) monument signs. Such signage shall be allowed in accordance with the following provisions: 1. Wall signs shall not exceed ten percent (10 %) of the area of the wall on which they are placed with a maximum of one (1) per fagade. BILL NO. 2013 -007 ORDINANCE NO. 113 2. Monument signs shall be located on the premises and be at least three (3) feet from the street right -of -way. The total area of the sign, including the sign face, base and supporting or decorative elements, shall not exceed sixty -four (64) square feet with a maximum height of ten (10) feet above the average grade. 3. Projecting signs shall not exceed six (6) square feet in area and shall not extend more than four (4) feet from the face of the building. 4. Canopy signs shall be located so as to provide sufficient vertical clearance for pedestrian traffic. Only canopies displaying the name of the business shal be considered canopy signs. SECTION 2 — NO REVIVAL The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. SECTION 3 — SEVERABLITY CLAUSE The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. SECTION 4 — REPEAL OF CONFLICTING PROVISIONS This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. SECTION 5 — EFFECTIVE DATE This ordinance shall be in full force and effect from and after the date of its passage and approval.
