HomeMy WebLinkAbout1186 Final Development Plan QuikTrip 170RBILL NO. 2013 -009 ORDINANCE NO. 11 86 AN ORDINANCE APPROVING A FINAL DEVELOPMENT PLAN FOR QUIKTRIP CORPORATION ON LAND LOCATED AT 4600 NW GATEWAY IN ACCORDANCE WITH THE UNIFIED DEVELOPMENT ORDINANCE OF THE CITY OF RIVERSIDE WHEREAS, an application was filed by QuikTrip Corporation for approval of a Final Development Plan for construction of a convenience store and gas station on previously developed property zoned C -1 Commercial and located at 4600 NW Gateway; and WHEREAS, after due public notice in the manner prescribed by law, the Planning Commission held a meeting to consider the application on January 24, 2013, and rendered a report to the Board of Aldermen recommending that the Final Development Plan be approved subject to certain conditions; and WHEREAS, after due public notice in the manner prescribed by law, the Board of Aldermen held a meeting to consider the application on February 5, 2013 and based upon all of the information presented find it is in the best interest of the citizens of the City of Riverside to approve a Final Development Plan for said property upon the terms and conditions provided herein: NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 — FINAL DEVELOPMENT PLAN APPROVED. The Final Development Plan dated January 12, 2013 (the "Development Plan ") for development of property located at 4600 NW Gateway, and legally described as Lot 1 QuikTrip Store No. 170R, a subdivision of the City of Riverside, Platte County, Missouri, is hereby approved, subject to the conditions provided herein, to allow the construction of a convenience store and gas station according to such plan. SECTION 2 — CONDITIONS OF APPROVAL. The following conditions of approval shall apply with regard to the Final Development Plan approved for development of the property: No outdoor storage of materials or debris shall occur on the site other than in the designated refuse and product display areas. The refuse area shall be screened from street view with similar materials and colors as used in the main building. A separate landscaping plan shall be submitted to the Community Development Director for approval. Proposed landscaping shall provide additional screening of the parking areas, substantially conform to the City's development standards and be considerate of enhanced site aesthetics. The Community Development Director shall provide written approval of such landscaping plan. In the event applicant cannot reach agreement with the Community Development Director on the landscaping plan, applicant shall submit the plan to the Board of Aldermen for approval prior to commencement of operations. The applicant shall submit a lighting plan which shows the location and design of all exterior lighting to the Community Development Director for approval. Proposed lighting shall conform to all development standards and be considerate of public views, light pollution and site aesthetics. The Community Development Director shall provide written approval of such lighting plan. In the event applicant cannot reach agreement with the Community Development Director on the exterior lighting plan, BILL NO. 2013 -009 ORDINANCE NO. applicant shall submit the plan to the Board of Aldermen for approval prior to commencement of operations. 4. The approval of the Development Plan does not relieve the applicant from compliance with all other applicable local, state and federal laws, codes, ordinances, and regulations. The applicant is required to request and obtain approval for all necessary permits to begin constructing the development. SECTION 3 — AUTHORITY GRANTED. The Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. SECTION 4 — FAILURE TO COMPLY. That failure to comply with all of the provisions contained in this ordinance shall constitute violations of both this ordinance and the City's Unified Development Ordinance. . SECTION 5 — REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 6 — SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 7 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval.
