HomeMy WebLinkAbout2013-02-05 Regular MeetingMINUTES REGULAR MEETING BOARD OF ALDERMEN RIVERSIDE, MISSOURI Tuesday, February 5, 2013 6:15 p.m. The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri, on Tuesday, February 5, 2013. Mayor Rose called the meeting to order at 6:15 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Ron Super, Art Homer, Brad Cope, Seth DeRose, Aaron Thatcher, and Mike Fuller (arrived at 6:20 p.m.). Also present were Interim City Administrator Greg Mills, City Attorney Nancy Thompson, City Clerk Robin Littrell, Community Development Assistant Sarah Wagner, Community Development Director Mike Duffy, City Engineer Travis Hoover, and Administration Director Meredith Hauck. Special Counsel Paul Camp and NorthPoint were also present. MOTION TO ENTER INTO Alderman Thatcher moved that the meeting go into closed CLOSED @ 6:15 P.M. session pursuant to RSMo 610.021 (1) Legal Action and litigation, RSMo 610.021 (2) Leasing, Purchase or sale of real estate, RSMo 610.021(3)Hiring, firing, disciplining or promoting a particular employee, when personal information about the employee is discussed, and RSMo 610.021(12) Sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected, second by Alderman Cope. Yes: Thatcher, Cope, Homer, Fuller, DeRose, and Super. Motion carried 6 -0. MOTION TO ADJOURN Alderman Super moved at 6:57 p.m. to adjourn closed session CLOSED @ 6:57 P.M. with action taken, second by Alderman Cope. Yes: Super, Cope, Thatcher, DeRose, Homer, and Fuller. Motion carried 6 -0. REGULAR SESSION Mayor Rose called the Regular Session Meeting to order at 7:00 p. M. Those in attendance were Mayor Kathy Rose, Aldermen Brad Cope, Mike Fuller, Seth DeRose, Ron Super, Aaron Thatcher, and Art Homer. Also present were Interim City Administrator Greg Mills, City Attorney Nancy Thompson, City Clerk Robin Littrell, Community Development Assistant Sarah Wagner, City Engineer Travis Hoover, Public Works Director Tom Wooddell, Community Development Director Mike Duffy, Finance Director Donna Resz, Fire Chief Gordy Fowlston, Administration Director Meredith Hauck, and Captain Chris Skinrood. PLEDGE OF ALLEGIANCE Mayor Rose led the Pledge of Allegiance. PUBLIC COMMENT None. CONSENT AGENDA Alderman Thatcher moved to approve the consent agenda as presented, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. MINUTES OF 01 -22 -13 Alderman Thatcher moved to approve the minutes of the January 22, 2013 meeting, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. MINUTES OF 01 -29 -13 Alderman Thatcher moved to approve the minutes of the January 29, 2013 special workshop meeting, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. RESOLUTION 2013 -006 Alderman Thatcher moved to approve Resolution 2013 -006 Bill Pay authorizing the expenditure of funds for fiscal year 2012 -2013, for weeks ending January 25 and February 1S in the amount of $99,277.00, second by Alderman Cope. Yes: Thatcher, Cope, DeRose, Fuller, Homer, and Super. Motion carried 6 -0. RESOLUTION 2013 -007 Alderman Thatcher moved to approve Resolution 2013 -007, YMCA 2013 Summer Camp authorizing the city to enter into a summer day camp program agreement with the YMCA, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. RESOLUTION 2013 -008 Alderman Thatcher moved to approve Resolution 2013 -008, Crookham Const. Bid Award awarding the bid for construction for the Lower Line Creek Trail Project to Crookham Construction, LLC, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. RESOLUTION 2013 -009 Alderman Thatcher moved to approve Resolution 2013 -009, Lynchpin Ideas Services authorizing an agreement with Lynchpin Ideas, LLC for newsletter and social media services in an amount not to exceed $12,000, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0 REGULAR AGENDA PUBLIC HEARING @ Mayor Rose opened the Public Hearing to consider the request 7:04 PM for rezoning of property west of NW Mattox Road and South of NW 43 rtl Street from GP -1 to PD in accordance with the Unified Development Ordinance, in the City of Riverside, for development purposes at 7:04 p.m. Community Development Director Mike Duffy reported that this was presented to the Planning Commission. He showed a PowerPoint picture for the Board to view the area. The Planning Commission recommended approval for the rezoning. Having no comments from the public, Mayor Rose closed the public hearing at 7:06 p.m. BILL NO. 2013-005 City Clerk Robin Littrell gave first reading of Bill No. 2013 -005. GP -1 Rezone to PD Alderman Thatcher moved to accept first reading and place Bill No. 2013 -005 on second and final reading, second by Alderman Homer. Yes: Thatcher, Homer, Cope, Super, DeRose, and Fuller. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -005 and enact said bill as ordinance, second by Alderman Super. Yes: Cope, Super, Thatcher, DeRose, Homer, and Fuller. Motion carried 6 -0. PUBLIC HEARING @ Mayor Rose opened the Public Hearing to consider a preliminary 7:08 PM plat and a preliminary development plan for property located West of NW Mattox Road and South of NW 43 in the City of Riverside, Missouri at 7:08 p.m. Community Development Director Mike Duffy reported that this was presented to the Planning Commission two weeks ago and was unanimously approved. This is a preliminary plat and preliminary development plan for 57 acres. This is all for industrial development. A map was shown for further details to the Board. The Planning Commission also approved a grading permit that does not come to the Board for approval. Having no comments from the public, Mayor Rose closed the public hearing at 7:10 p.m. BILL NO. 2013-006 City Clerk Robin Littrell gave first reading of Bill No. 2013 -006. Prelim. Plat and Dev. Plan Alderman Thatcher moved to accept first reading and place Bill No. 2013 -006 on second and final reading, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Super, and Fuller. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -005 and enact said bill as ordinance, second by Alderman Homer. Yes: Cope, Homer, DeRose, Super, Fuller, and Thatcher. Motion carried 6-0. PUBLIC HEARING @ Mayor Rose opened the Public Hearing to consider amending 7:11 PM Title IV "Land Use" of the Riverside Municipal Code, specifically Article VIII "Signs ", Section 400.710 "Signs Permitted in the Non - Residential Districts, in the City of Riverside, Missouri at 7:11 p.m. Community Development Director Mike Duffy discussed the signage for Quik Trip and the options related to this issue. The decision was to amend the code. There are approximately four sites in our city this may affect. This was taken to the Planning Commission after their review approval was recommended. Having no comments from the public, Mayor Rose closed the public hearing at 7:14 p.m. BILL NO. 2013-007 City Clerk Robin Littrell gave first reading of Bill No. 2013 -007. Amend Code Sec. 400.710 Alderman Thatcher moved to accept first reading and place Bill No. 2013 -007 on second and final reading, second by Alderman Cope. Yes: Thatcher, Cope, Fuller, DeRose, Homer, and Super. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -007 and enact said bill as ordinance, second by Alderman Homer. Yes: Cope, Homer, Super, DeRose, Fuller, and Thatcher. Motion carried 6 -0. BILL NO. 2013-008 City Clerk Robin Littrell gave first reading of Bill No. Final Plat Quik Trip 170R 2013 -008. Community Development Director Mike Duffy explained that this is a ministerial action by the Planning Commission and that there will be couple final edits when the mylars are printed. Alderman Thatcher moved to accept first reading and place Bill No. 2013 -008 being amended as stated on second and final reading, second by Alderman Cope. Yes: Thatcher, Cope, Super, DeRose, Fuller, and Homer. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -008 as amended and enact said bill as ordinance, second by Alderman Thatcher. Yes: Cope, Thatcher, DeRose, Super, Homer, and Fuller. Motion carried 6 -0. BILL NO. 2013-009 City Clerk Robin Littrell gave first reading of Bill No. Final Development Quik Trip 2013 -009. Community Development Director Mike Duffy explained that this was heard two weeks ago by the Planning Commission and was approved unanimously with conditions that were explained to the Board. Matt Brooks with Quik Trip stated that they hope to start working by the end of March or first of April. Alderman Thatcher moved to accept first reading and place Bill No. 2013 -009 being amended as stated on second and final reading, second by Alderman Cope. Yes: Thatcher, Cope, Homer, DeRose, Fuller, and Super. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -009 as amended and enact said bill as ordinance, second by Alderman Thatcher. Yes: Cope, Thatcher, Super, Homer, DeRose, and Fuller. Motion carried 6 -0. BILL NO. 2013-010 City Clerk Robin Littrell gave first reading of Bill No. Chapter 100 Bonds - PWI 2013 -010. City Attorney Nancy Thompson gave an overview that included this is a $4 million dollar investment in industrial equipment to the Premium Waters Industrial Plant and that Gary Anderson from Gilmore Bell was present for any questions. Alderman Thatcher moved to accept first reading and place Bill No. 2013 -010 on second and final reading, second by Alderman Cope. Yes: Thatcher, Cope, Fuller, Super, DeRose, and Homer. Motion carried 6 -0. BILL NO. 2013-011 City Clerk Robin Littrell gave first reading of Bill No. 2013 -011. New Hire Jaclyn Carlson Alderman Thatcher moved to accept first reading and place Bill No. 2013 -011 on second and final reading, second by Alderman Homer. Yes: Thatcher, Homer, Cope, Fuller, DeRose, and Super. Motion carried 6 -0. Alderman Cope moved to approve Bill 2013 -011 and enact said bill as ordinance, second by Alderman Homer. CITY ADMINISTRATOR Interim City Administrator Mills reported at 12:30 a.m. on Friday morning, February 1' the process began of striping the wiring from seven streetlights along the river walk sidewalk in the park. He reviewed several issues that are related to this event. Damages are estimated at $3,000. Discussion was held by the Board regarding options for repair with Public Works Director Tom Wooddell. ADMINISTRATION Nothing to report. COMMUNITY DEVELOPMENT Nothing to report. Community Development Director Mike Duffy explained that several months ago MoDot turned some right -of -way over to the City of Riverside. They are now requesting other properties and Duffy referred to a map showing these areas. The current conditions of these sections are not acceptable, but if MoDot would make some improvements, this may be a consideration in the future. We are simply making the board aware that there will more than likely be discussions regarding the MoDot right -of -ways in the future. The other issue to discuss with the Board is DeConink Road. This is a' /2 mile section of the road that we are considering closing. We would like the Board to think about this for the future. We will go through Public Safety and Fire to make sure this option is possible. Closure options were discussed. FINANCE Nothing to report. PUBLIC SAFETY Nothing to report. PUBLIC WORKS Nothing to report. LEVEE BOARD Alderman Super stated that there will be a meeting on February 13 with the Corp of Engineers. MAYOR'S DISCUSSION The Northland Regional Chamber Days in Jefferson City went really well. We had great conversations with our legislators. Many of us will be going back to Jefferson City next week for the MML Legislative Conference. BOARD OF ALDERMEN Alderman Super— Nothing this evening. Alderman Thatcher— Nothing this evening. Alderman Homer — I would like to echo your comments about the legislative trip and it is good to have our presence in Jefferson City. Alderman DeRose — Nothing this evening.
