HomeMy WebLinkAbout2009-05-14 Planning & Zoning Commission MinutesMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION RIVERSIDE, MISSOURI Thursday, May 14, 2009 7:00 p.m. The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri. Acting Chair Stephen King called the meeting to order at 7:00 p.m. Answering roll call were Harold Snoderley, Ray Uhl, Al Bowman, Evelyn Poe, Stephen King, Cheryl Melton, Art Homer, and Alderman Brad Cope. Members absent: Aaron Locke, Barbara Snyder and Mayor Kathy Rose. Also present: Jackie Carlson with Shafer, Kline and Warren, Mike Duffy, Director of Community Development and Sarah Wagner, Administrative Clerk. Approval of Minutes from Commissioner Harold Snoderley moved to approve the minutes of March 12, 2009 March 12, 2009 as corrected. Commissioner Art Homer seconded and the motion passed. Final Plat and Land Jackie Carlson with Shafer, Kline and Warren gave a staff report to the Disturbance Permit Commission for the Final Plat and Land Disturbance Permit for Briarcliff Hills 2 " Plat. Carlson explained that there are two separate items being considered, but she combined them into one staff report because they had to do with the same location. She explained that The subdivision entails the construction of NW 42 °d Street, which will be an east -west street. The street will provide connection to Valley Lane on the west and the Briarcliff Development on the east. Previously, concerns were raised regarding the intersection of Valley Lane and the proposed road. The applicant has addressed these concerns by conveying additional right -of -way at the intersection, which allows easier turning movements and increased sight distance. Cottonwood Circle will be a north -south cul -de -sac that will connect to NW 42 " Street. The intersection of the two streets will possess a roundabout. All lots will have street access either via NW 42 °d Street or Cottonwood Circle, with the exceptions of lots 10 and 11. Lot 10 may gain street access either via Valley Lane or 42 " Street. Lot 11 will have access to Valley Lane. The approval of the PD zoning and preliminary development plan allowed for the following variances to the R -1 zoning district, which is the most similar zoning to the proposed use. • The minimum lot width of 80 feet is not meet on lots 6, 7, and 8. • The minimum front setback is 20 feet instead of 30 feet. The variances are reasonable and help accommodate the topography and natural assets of the site. Additionally, it should be noted that all buildings will be side entry residences, reducing the need for a large front setback to provide space for a driveway. In terms of land disturbance the following areas are receiving filling — lots 2, 3, tract A, and portions of lots 6, 7 and 8 near the end of the cul- de -sac. Cutting will occur on lot 9. Existing rock is being exposed to create an approximately 12 foot high retaining wall on the north side of NW 42 "d Street on lots 4, 5 and 6. An approximate 8 foot high retaining wall will run along the northern 100 feet of the east side of Cottonwood Circle. Erosion control measures entail the use of a construction entrance, silt fence, super silt fence, sediment traps and gravel filter bags around the storm sewer inlets. Staff finds the application in conformance with the preliminary development plan, Comprehensive Master Plan, UDO and adopted policies and procedures, and therefore, recommends approval of the Final Plat and Land Disturbance Permit. Commissioner Art Homer asked what was going to be done with the unplatted area. Chris Williams with Briarcliff Development Company explained that the unplatted area will remain undeveloped as it stands with trees and forest. Commissioner Evelyn Poe asked if 42 "d Street will tie into the parking lot at the Briarcliff Shopping Center. Chris Williams said that it would. Commissioner Ray Uhl asked if the entrance on 42 "d Street would be made wider. Chris Williams replied that they will be rounding the corner more to improve the sight on that comer for traffic purposes. Commissioner Harold Snoderley asked if the intersection of 42 " Street and Cottonwood Circle would be a round -a -bout. Chris Williams replied that it would be a traffic circle with landscaping in the middle. Commissioner Ray Uhl asked if any builders have been selected for this development. Chris Williams replied that these lots will be sold to individuals who they will work with to design the houses and select builders. Commissioner Art Homer asked if the side entrance driveways would be a requirement. Chris Williams replied that they will be highly suggested. Commissioner Evelyn Poe asked what the average price of the houses would be. Chris Williams replied that the houses would be around $400,000 and be about 3,000 -4,000 square feet. Commissioner Al Bowman moved t recommend approval to the Board of Aldermen for the Final Plat for Briarcliff Hills 2 nd Plat. Commissioner Evelyn Poe seconded and the motion passed. Jackie Carlson reminded the Commission that they are the final authority on the approval of the Land Disturbance Permit as it does not go on to the Board of Aldermen. Commissioner Stephen King asked what the fill amount would be for Briarcliff Hills Land Disturbance Permit. Chris Williams replied that the max is about 10 feet in some areas, but they believe this will be a balanced site where they won't have to bring in any fill or take anything off. Commissioner Cheryl Melton asked about the storm water run -off. Chris Williams replied that it should remain about the same. Much of the water will be directed to storm drains and will be used for the waterfall and pond that are going in. Commissioner Art Homer moved to approve the Land Disturbance Permit for Briarcliff Hills 2 " Plat. Commissioner Cheryl Melton seconded and the motion passed. Public Hearing for a Acting Chair Stephen King Opened the Public Hearing for a Special Use Permit for Special Use Permit for Eiken Trucking at 3339 and 3220 Vivion Eiken Trucking at 3339 Road at 7:18 p.m. and 3220 NW Vivion Road. Mike Duffy, Director of Community Development explained to the Commissioner that the applicant was not able to make it to the meeting tonight and has requested that the public hearing be continued to the June 11, 2009 meeting. Commissioner Harold Snoderley moved to continue the public hearing to June 11, 2009. Alderman Brad Cope seconded and the motion passed. General Discussion Mike Duffy explained that the Commission received a copy of the CIP overview and discussed some of the projects that are planned for the CIP. He also explained to the Commission that at the June 11 th meeting he will be presenting a power point on the functions of the Planning Commission and some of the projects that have been going on and are planned of the future. He also noted that there will be no meeting on May 28 0 ' because there are no agenda items. Adjournment Commissioner Al Bowman made a motion to adjourn.
