REGULAR MEETING
PLANNING AND ZONING COMMISSION
RIVERSIDE, MISSOURI
Monday, January 12, 2012
7:00 p.m.
The Planning and Zoning Commission for the City of Riverside, Missouri, met in special session in the
Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri.
Mayor Kathy Rose called the meeting to order at 7:00 p.m. Answering roll call were Mayor Kathy Rose,
Al Bowman, Art Homer, Harold Snoderley, Ray Uhl, Steve Kaspar, Mike Soler and Cheryl Melton.
Members absent: Stephen King,, Barbara Snyder, Tyson Spire-Sweet and Alderman Brad Cope. Also
present: Mike Duffy Director of Community Development, Sarah Wagner Community Development and
Keith Payne Fire Marshall.
Approval of Minutes of Commissioner Bowman moved to approve the minutes of December 12,
December 12, 2011 2011.
Commissioner Snoderley seconded and the motion was approved
unanimously.
Minor Change of Use- Sarah Wagner presented the staff report to the Commission. She
3400 NW Vivion Road explained that the applicant, NAWS, is requesting a Minor Change of
Use Permit to allow a spay /neuter clinic on the property at 3400 NW
Vivion Road. The applicant is proposing to open a low cost spay /neuter
clinic. They plan to be open Monday, Wednesday and Saturday from 8
a.m. to 4:30 p.m. with the potential to increase days of operation if there
is a demand. They will have one part time veterinarian on staff with
two to four other part time employees. In addition, the space may also
be used in the evenings for education and obedience classes. The
request is in accordance with adopted policies and plans and is
compatible with surrounding land uses; therefore, staff recommends
approval of the Minor Change of Use Permit with the following
conditions:
1. The applicant is required to have an inspection from the Fire
Marshall and must comply with all regulations.
2. The owner /applicant must install and Knox Box for fire access.
3. The owner /applicant must furnish the City with a letter from a
licensed architect with the reclassification of the building.
Representative from NAWS addressed the Commission and
answered questions.
Commissioner Homer moved to approve the Minor Change of
Use Permit for the Northland Animal Welfare Society (HAWS) at
3400 NW Vivion Road.
Commissioner Uhl seconded and the motion passed 8 -0.
Land Disturbance 4301
NW Mattox Road Mike Duffy presented the staff report to the Commission. He
explained that the applicant, ARCO Construction, will be constructing
a 165,000 sq.ft. manufacturing facility for Premium Waters. Due to
time constraints the applicant has been working, at risk, on the project
moving dirt to surcharge the site. Due to the low elevation of the area, a
large amount of fill is required for this project. The fill will be taken
from the excavation of the distension pond on property to the east. In
terms of erosion control, the following methods will be utilized: silt
fence, existing sediment traps, rock check dam, and curb inlet
protection. The applicant has applied for their MDNR land disturbance
permit and will be required to provide a copy to the City upon approval.
The proposed land disturbance permit are in accordance with the
approved Master Plan and UDO.
Duffy answered questions from the Commission.
Adjournment
Commissioner Bowman moved to approve the Land Disturbance Permit
for Arco Construction at 4301 NW Mattox Road.
Commissioner Soler seconded and the motion passed 8 -0.
Commissioner Bowman moved to adjourn.
Commissioner Soler seconded. The motion passed and the meeting was
adjourned at 7:36 PM
