A RESOLUTION AWARDING THE BID FOR ELECTRICAL SERVICES TO R F FISHER
ELECTRIC CO, LLC PURSUANT TO A COOPERATIVE PURCHASE CONTRACT ENTERED
INTO BY THE 16 JUDICIAL CIRCUIT COURT OF JACKSON COUNTY, MISSOURI AND
FURTHER APPROVING THE UTILIZATION OF SUCH SERVICES FOR THE INSTALLATION
AND REPAIR OF AN UNINTERRUPTIBLE POWER SUPPLY IN THE DEPARTMENT OF
PUBLIC SAFETY WITHIN BUDGETED AMOUNTS
WHEREAS, the Section 135.170 of the Riverside City Code provides for the City to purchase
goods or services through any other governmental jurisdiction which operates a cooperative
procurement program; and
WHEREAS, the 1 e Judicial Circuit Court of Jackson County, Missouri ( "JACO Circuit Court")
competitively bid electrical services and repairs, including, but not limited to emergency electrical
repairs, preventative maintenance, miscellaneous repairs, replacements, trouble shooting, additions,
and/or new installations, as may be requested from time to time; and
WHEREAS, the JACO Circuit Court awarded such bid to RL Fisher Electric Co, LLC ( "RL
Fisher") on April 14, 2008 for a three year term with the option to extend for an additional three years;
and
WHEREAS, the JACO Circuit Court bid provided for RL Fisher bidder to supply such services
under the same prices and terms of the JACO Circuit Court bid to any municipality located within the
greater Kansas City Metropolitan Trade Area; and
WHEREAS, the City of Riverside has a need to utilize similar services and desires to avail
itself of the terms and conditions of such cooperative procurement contract entered into by the JACO
Circuit Court; and
WHEREAS, the Board of Aldermen find it is in the best interest of the City to approve and
award a blanket purchase contract with RL Fisher to provide such services according to the terms
and conditions of the JACO Circuit Court bid award set forth in Exhibit "A" and herein; and
WHEREAS, the City has an immediate need to utilize electrical services from RL Fisher to
perform the replacement and repair of certain equipment in the Department of Public Safety to
ensure an uninterruptible power supply ( "UPS ") for communications and other equipment vital to the
operations of the City as set forth in the Technical Specifications and Scope of Work attached hereto
as Exhibit "B "; and
WHEREAS, the Board of Aldermen further find it is in the best interest of the City to approve
expenditures in excess of $10,000 but within budgeted amounts for the installation and repair of an
UPS in the Department of Public Safety by RL Fisher;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE MISSOURI AS FOLLOWS
THAT a blanket purchase contract is hereby awarded to RL Fisher Electric Co, LLC
according to the terms and conditions of the cooperative procurement contract entered into by
the 16 Judicial Circuit Court of Jackson County, Missouri attached hereto as Exhibit "A ";
FURTHER THAT expenditures in excess of $10,000, but within budgeted amounts, to
perform the work set forth in Exhibit "B" attached hereto is hereby authorized and approved to be
performed by RL Fisher Electric Co, LLC upon the following:
Submission of a Certificate of Insurance in the minimum amounts required by the City and
approved by the City Administrator naming the City of Riverside as an additional
insured;
Submission of Performance and Payment Bonds in an amount not less than $45,000 (the
City reserves the right to require additional bonds should the amount of work in
progress exceed $45,000);
Acquisition of a city business license; and
Prevailing Wage Order 19 for Platte County applies and prevailing wage documentation
along with an affidavit of compliance must be provided prior to final payment;
FURTHER THAT the work approved herein may be subject to the requirements of Section
292.675 RSMo, which requires all contractors or subcontractors doing work on the project to
provide, and require its on -site employees to complete, a ten (10) hour course in construction
safety and health approved by the Occupational Safety and Health Administration (OSHA) or a
similar program approved by the Missouri Department of Labor and Industrial Relations which is at
least as stringent as an approved OSHA program. Such training must be completed within sixty
(60) days of the date work on the Project commences. On -site employees found on the worksite
without documentation of the required training shall have twenty (20) days to produce such
documentation; and
FURTHER THAT the Mayor, City Administrator, City Attorney, and Finance Director are
hereby authorized to execute all documents and agreements necessary or incidental to carry out
the terms and conditions of such bid award and the City Clerk is authorized to attest thereto.
PASSED AND ADOPTED by the Board of Aldermen and APPROVED by the
Mayor of the City of Riverside Missouri the may of March, 2013.

Contract for Electrical Services — Communications Equipment Uninterruptible
Power Supply
BACKGROUND: The replacement of the existing uninterruptible power supply (UPS) equipment
in the Department of Public Safety was designed by TapanAm Associates. This
work will provide for the installation of new 30kVA UPS equipment to replace
the current GE -brand UPS equipment that is no longer functioning.
The City attempted to place the work necessary to be performed for this
project out to bid as a stand -alone project and received one bid that was
incomplete and therefore, non - responsive to the invitation to bid. The City
Code allows for the City to join with other units of government in cooperative
purchasing of goods and services when the best interest of the City would be
served. In such circumstances, the competitive bidding requirements of the
Riverside City Code are not required as long as the jurisdiction from whom the
City is utilizing a cooperative purchase contract followed completion of its own
internal purchasing procedures.
The work to be performed on this project was competitively bid by the 16'"
Judicial Circuit Court of Jackson County, Missouri. The Circuit Court awarded
the bid to RL Fisher Electric Company, LLC based on a time and materials basis.
RECOMMENDATION: After staffs review of the Circuit Court contract and experience questionnaire
completed by RL Fisher Electric Company, Staff recommends approval of the
resolution to piggyback onto the Circuit Court contract and authorize the work
to be performed by RL Fisher Electric Company for the UPS Equipment
Replacement Project.
BUDGETARY IMPACT: Approximately $54,000 was allocated in the Capitol Improvements budget for
the construction under this contract. The engineer's estimate for the work to
be performed by RL Fisher is $40,739.46. Staff will monitor the expenditures
closely to ensure the budget on this project is not exceeded. If unanticipated
expenditures arise, additional board authorization will be requested before the
work is permitted.
